On joint motion of all Councilmembers present, the following resolution was
offered:
RESOLUTION NO. 123837
A resolution ratifying a Cooperative Endeavor Agreement between the
Parish of Jefferson and JGT Acquisition Company, L.L.C. d/b/a All
American Grease Services Companies to provide for a no-cost pilot
program to recycle used cooking oil collected at the Jefferson Parish
trash drop-off site locations at 400 David Drive, Metairie, Louisiana
and 6440 Lapalco Boulevard, Marrero, Louisiana. (Parishwide)
WHEREAS, Art. VII, Sec. 14(C) of the Louisiana Constitution of 1974 provides
that for a public purpose, the State and its political subdivisions may engage in
cooperative endeavors with each other, with the United States or its agencies, or with any
public or private organization, corporation or individuals; and
WHEREAS, Jefferson Parish desires, as authorized under the Jefferson Parish
Charter §1.01(11), to implement a Cooperative Endeavor Agreement designed to provide
for refuse collection and disposal facilities for the benefit of the citizens of Jefferson Parish;
and
WHEREAS, the public purpose is described as conducting and facilitating a Pilot
Program designed to properly recycle used cooking oil waste by allowing the JGT
Acquisition Company, L.L.C. d/b/a All American Grease Services Companies to pickup, transport and recycle used cooking oil collected from Jefferson Parish residents; and
WHEREAS, Jefferson Parish has a reasonable expectation of receiving a benefit of
JGT Acquisition Company, L.L.C. d/b/a All American Grease Services Companies’
donation of services, which include providing the proper containers for collection of the
waste oil, removing the collected oil from the Jefferson Parish trash drop-off sites and
transporting the used cooking oil to their recycling facility, thereby reducing the Jefferson
Parish landfill disposal costs and over-head costs and helping to prevent any cooking oil
waste from polluting and damaging the Jefferson Parish storm drain system and the
receiving water bodies, which is at least equivalent to the consideration provided for in this
Agreement; and
WHEREAS, Jefferson Parish operates two (2) trash drop-off locations which are
managed by Progressive Waste Solutions of LA, Inc. (PWSLA), one on David Drive in
Metairie, and one on Lapalco Boulevard in Marrero. Currently, waste auto fluids are
collected for recycling at these two locations. These two sites have the proper facilities
necessary to collect and store certain household hazardous wastes; and
WHEREAS, the Jefferson Parish agreement with PWSLA reserves the right to require
PWSLA to provide additional Solid Waste collection services at the trash drop-off sites as
deemed necessary by Jefferson Parish; and
WHEREAS, this Pilot Program provides Jefferson Parish with an option to continue
the Parish’s commitment to protect the environment by diverting used cooking oil from the
waste stream; and
WHEREAS, the citizens of Jefferson Parish will benefit from the efforts of these
parties working together; and
WHEREAS, Jefferson Parish desires to cooperate with JGT Acquisition Company,
L.L.C. d/b/a All American Grease Services Companies in the implementation of the Project;
and
WHEREAS, the transfer or expenditure of public funds or property is not a gratuitous
donation.
NOW, THEREFORE, BE IT RESOLVED by the Parish Council of Jefferson Parish,
Louisiana, acting as governing authority of said Parish:
SECTION 1. That the Cooperative Endeavor Agreement between the Parish of
Jefferson and JGT Acquisition Company, L.L.C. d/b/a All American Grease Services
Companies to provide for a no-cost pilot program to recycle used cooking oil collected at
the Jefferson Parish trash drop-off site locations at 400 David Drive, Metairie, Louisiana
and 6440 Lapalco Boulevard, Marrero, Louisiana is hereby ratified.
SECTION 2. That there are no direct costs associated with this Agreement.
SECTION 3. That the Chairman of the Jefferson Parish Council, or in his absence
the Vice-Chairman, be and is hereby authorized to execute any and all documents
necessary to give full force and effect to this resolution.
The foregoing resolution having been submitted to a vote, the vote thereon was as
follows:
