CALL FOR PROPOSAL CONSULTANCY FOR PROVIDING TECHNICAL ASSISTANCE IN DRAFTING CHILD MARRIAGE BILL FOR KHYBER PAKHTUNKHWA, BALUCHISTAN AND AZAD JAMMU & KASHMIR Mode of assignment: Provide technical assistance in drafting Child Marriage Bill for Khyber Pakhtunkhwa (KP), Baluchistan and Azad Jammu & Kashmir (AJK) for policy advocacy regarding child marriages. Duration of consultancy: 30 days (starting from the signing of contract) Requested documents: The proposal must be supported with following documents: Cover letter Company or personal profile of a lead consultant Sample copy of the most recently completed assignment of the same or similar nature Proposal document along with consultancy fee details covering all expenses Deadline for the submission of proposal: July 06, 2014 Expected date of initiation of consultancy: July 16, 2014 Payment Schedule: 40% advance payment will be made after the signing of contract for the proposed assignment as first installment. 30% will be paid on the receipt of first draft document while remaining 30% payment will be made upon satisfactory delivery of deliverables after incorporation comments by Rahnuma-FPAP. Email address: urooj.virk@fpapak.org Background: Rahnuma-FPAP feels that Child Marriage (CM) is a serious violation of basic human rights which takes away a child’s right to education, choose when to marry and to choose his/her life partner. It also promotes gender-based violence and affects both the present and the next generation through psychological, social and health consequences. To control the incidents of CM in Pakistan, Rahnuma FPAP focused its efforts at two levels; i. Community sensitization and mobilization to reduce the incidents of CM and improved access to SRHR services by child/early marriage survivors in targeted communities in Pakistan. ii. Advocating to prioritize the issue at Policy and Program level and to create conducive environment for its implementation. A Media Kit on the issue of CM was developed for the media persons and advocacy Kit reflecting the facts and figures about causes & repercussion of CM, relevant laws, and religious point of view etc. Tool kits on CM for Peer educators were developed in Urdu. Similarly, pictorial booklets, leaflets and posters, handbooks for in school youth on CM in Urdu and English, visual documentaries i.e. Sana’s Journey, Noori Goes Missing etc. in Urdu with English subtitles containing different messages related to CM were made available. A comprehensive national situation analysis on child marriage was conducted to encouraging quantitative and qualitative researches that provide meaningful information and authentic statistics on CM. Similarly, a legal review of the Child Marriage Restraint Act, 1929 was done to identify gaps and areas of revision. Commitments were solicited from government and policy makers for reforms in Child Marriage laws through interactive dialogues and meetings and actively involved in drafting Bill with in line departments to revise the Child Marriage Restraint Act to be tabled in Punjab province by prioritizing child and early marriages as an issue in provincial policies. The issue was also raised in UPR and CPD 45th session. FPAP formally joined and collaborated with the national and provincial networks/ alliances against child marriages to strengthen the advocacy efforts. Media was actively engaged for mobilization and advocacy against child marriages and gathering public support. Media was involved through series of media workshops to play a proactive role around this issue and highlight the gaps and what needs to be done. Comprehensive advocacy tools were developed to highlight the issues of Child Marriage and the failure of legal framework to address the issue. Media covered the issue in leading print and electronic media houses in all provinces through Articles writing, News clippings, News itemscase of child marriage, Features- Legal aspect, Health aspect, social and cultural aspect, human rights aspect and Radio show. Furthermore, concept of peer education was introduced for community sensitization on the issue and awareness raising sessions. The Sindh Child Marriage Restraint Act 2013 was passed in the provincial assembly declaring marriage below the age of 18 punishable. The Sindh Assembly is the first assembly in the country to pass a bill of this kind. The bill was presented in the assembly last year by Sindh Minister for Culture Sharmila Farooqi as well as provincial minister Rubina Saadat Qaimkhani. The Child Marriages Prohibition Act had classified the offence as cognizable, non-bailable and non-compoundable. The Child Marriages Eradication Act, however, had held it only as a cognizable offence. So in the light of above, and to facilitate the same efforts of drafting the Child Marriage Bill in AJK, Baluchistan and Khyber Pakhtunkhwa, technical assistance is required. Project Objectives: To increase the number of young people with access to an essential package of youthfriendly services in Pakistan To increase access to comprehensive, gender-sensitive, rights-based sexuality education in Pakistan. To influence policy change that prioritizes the sexual and reproductive health needs of young people within national health systems Pakistan Purpose of this consultancy assignment: The purpose of this assignment is to draft child marriage bill for Khyber Pakhtunkhwa, Baluchistan and Azad Jammu Kashmir to influence the policy change that prioritize the issue of child marriages in Pakistan. Consultant will be responsible for: Review the relevant existing laws, policies, and rules and regulations of national and provincial level discussing the issue of child marriage. Review the existing child marriages bill passed in the Sindh assembly Draft the child marriage bills for Khyber Pakhtunkhwa, Baluchistan and Azad Jammu Kashmir keeping in view their particular socio-cultural and political scenario. Submitting revised version of both bills within 3 working days after incorporating feedback by Rahnuma FPAP on the draft bill Rahnuma FPAP will provide: Relevant project documents Reference material on child marriages available in the organization The Consultant applying for this assignment must have: Experience and knowledge of providing technical assistance in drafting different bills especially on the social issues like child marriage Understanding and sensitivity for socio-cultural and political dynamics related to the issue of Child Marriage of both provinces Master’s degree in Law, Political Sciences, Sociology, Gender and Women Studies or equivalent in relevant field Background and understanding of Human Rights, Women Rights, Child Rights Sexual and Reproductive Health Rights and Developmental issues in context of Pakistan At least 5 years’ experience of professional writing on social issues Excellent English writing and analytical skills Commitment to produce quality deliverables within given timeframe
