COVER SHEET (All Fields Mandatory) EGB12700 Specialist Legal Services The DfT wishes to procure temporary consultancy resource to lead the market research and development of a DfT owned rail legal services contracting vehicle. The project is split into 3 phases and is expected to last a total of 1 year. We are looking to offer a three month contract initially with possibility to extend up to a total one year (3months + 2 further optional extensions of 6months and 3months). Project Aims The appointed commercial specialist will lead the market research and development of the DfTRail Legal services framework. The project will consist of 3 phases. Phase 1 will consist of a project feasibility study and include market consultation with legal firms and key stakeholders for the development of a procurement strategy. The subsequent phases following the initial contract period, phases 2 and 3, will consist of the full procurement process for setting up the new rail legal services framework should the recommended procurement strategy be approved by DfT Board members. As a minimum, the appointed consultant firm will be expected to work with the client team consisting of DfT’s Passenger Services Procurement Excellence team (PET), DfT Legal Team, procurement specialists in Group Commercial services (GCS), Government Legal Department (GLD) and Crown Commercial Services (CCS) as well as the market. Main Duties and Responsibilities Formulate, lead and develop a legal services procurement strategy. Lead market research and supplier engagement to understand market capability, appetite for innovative solutions and barriers to engagement. Engage internal stakeholders in identifying and/or exploiting procurement options, whilst seeking to implement sustainable solutions to internal challenges on engagement of rail specific legal advice. Lead liaison with DfT and its agencies, CCS, GLS, DfT internal Legal Advisers on cross-cutting procurement issues to inform strategic options and solutions. Set out procurement strategic options, highlighting advantages, disadvantages and formulating optimal recommendations to deliver savings and a sustainable supply of Rail specific legal advice from the market to meet demand. Develop high level process design for the recommended contracting vehicle. Lead the procurement from inception through to implementation and award (pending procurement strategy approval by DfT senior management). We expect that the commercial specialist consultant will in Phase 1: - develop the procurement strategy as a result of market and supplier engagement combined with ongoing consultation with DfT stakeholders and the client team - undertake initial work to prepare for the procurement competition V1.5 Oct 14 Phase 2 and 3 (if the contract is extended): - Lead and manage the procurement of the framework end to end including transition to the new service. Staff and Line Management Responsibilities: - At this time there are no line management responsibilities. However, the successful candidate will need to be able to work across virtual teams to delegate and manage completion of elements of the activity. In the event the procurement recommendation is approved at the completion of Phase 1, the team may be expanded and the successful candidate will be expected to have previous experience of line management including steering teams and virtual teams through to successful delivery. Strong teamwork (across multiple stakeholders at a range of grades and specialisms) will be key to enable delivery. Experience Essential: Proven experience of leading complex procurements (strategy development and hands on delivery) which deliver savings and efficiencies in a commercially focused organisation in private and/or public sector. Experience of working in a fast paced environment and able to hit the ground running, with minimal supervision. Successful track record in analysing and mitigating commercial risks on large scale complex projects. Strong communication skills with demonstrable experience of influencing and negotiation skills. Knowledge and proven expertise in EU Procurement Legislation. Previous experience of line management including steering teams and virtual teams through to successful delivery. Have a background in developing complex commercial strategies. Must be highly self-motivated commercial professional with a strong work ethic and interest in the Rail Industry. Able to demonstrate previous experience of developing and delivering procurement strategies for specific categories that have delivered savings and improved customer services. Proven experience of delivering innovative and strategically important procurements in a complex and fast-paced environment. Desirable: Holds Prince 2. Holds CIPS/MCIPS Qualification.
