Down payments are applied to the purchase price of the puppy. A down payment of $300.00 is required to reserve
your puppy. Down payments are non-refundable unless the contract is changed prior to it being placed.
Reservation order is determined by the date the down payment is received. Placing a down payment does not guarantee
you will receive a puppy from a particular litter. This is nature, the size and sex within a litter are out of my control. If
there isn't a puppy available in the litter you have reserved your puppy on, then your down payment will move to the
next available litter of your choice, based on the reservation date. If a puppy you reserved is offered to you and you
turn the puppy down, you will forfeit the deposit. Puppy selections are made at 8 weeks of age by the breeder, the
Breeder's decision is final as to the puppy the Buyer will receive, but we will make every effort to provide Buyer with
the puppy desired by working together to select the right puppy for your home and family.
The balance of the puppy is to arrive by the puppies 6th week birthday if you plan to pay with personal check or wire
transfer. I will accept a Postal Money Order, Wal-Mart money transfers or Western Union during the 7th week.
Cash is the ONLY acceptable form of payment on day of pick up.
When the pup is ready to go to its new home, the buyer agrees to be ready. If I must "hold" the puppy and wait for you
to be ready, there is a $15.00 a day boarding fee.
Deposits are transferable to another litter if you must cancel or change your mind up to the 6th week birthday of your
pup. Any cancellations or postponements after the pups 6th week birth date, the down payment will not be transferable
to another litter or to the future.

Sales Adoption CONTRACT and GUARANTEE for pet-companion Puppies.

In consideration of a purchase price of ____________, the Seller, Michelle Gordon, transfers to Purchaser, privileges
and responsibilities associated with the ownership of the above described dog as specified in the following.
Registration application is being provided.
The purchaser agrees to the following terms of sale:
**Buyer agrees to take this dog to vet within 72 hours from time of taking possession for a physical exam. The dog
has been examined by breeders vet and has been found in good health. The pup has received its first set of shots and
has been wormed. All worming and shot records have been provided.
*Buyer agrees this dog will be spayed or neutered by 13 months of age. Buyer agrees to provide to the breeder written
proof of spay/neuter from vet when this is completed.
*Buyer agrees this dog is not to be bred. This dog is not to be used in any cross-breeding or creation of a new
"designer" dog. This dog is being sold as a pet or companion animal. This dog is not being sold as a breeding
potential dog, therefore an AKC limited registration is being provided. A limited registration does not allow for
offspring to be registered.
*Buyer agrees this dog will NOT be re-registered with another registry club with out written permission. If buyer does
re-register, the buyer agrees to pay a fine of $5000.00 to the breeder as well as all legal fees if legal action is needed.
*Buyer agrees to love this dog!!!!! Feed the dog according to the directions provided by the seller or a licensed
Veterinarian. Fresh water will always be available to the dog. Provide for the welfare of the dog by having yearly
health checks, parasite prevention program, yearly vaccinations as recommended by his/her Veterinarian, and heart
worm prevention where applicable. Provide a clean, safe environment where the dog will not be subject to teasing or
abuse. Pup must be kept and maintained NuVet Plus supplements, vitamin C and glucosamine for life.
*Buyer agrees that this dog will not be tied or solely kenneled. Buyer agrees this dog will be a family member,
spending quality time with its family in and out of the house. Buyer agrees this dog will not be left to wander alone or
unattended.
**Buyer agrees to never shave this animal, except for medical reasons.
**Buyer agrees at 2 years of age to screen the dogs hips and elbows via OFA, and to register results with OFA.
*All training and social upbringing is the responsibility of the purchaser.
**Any shipping or transportation costs are the responsibility of Buyer.
***If the buyer defaults on any portion of this contract or the animal isn't receiving proper care where the animals
welfare is in jeopardy, the breeder has the right to take back the Newfoundland immediately and the buyer will return
all registration papers. This is for the entire length of the dogs life. Then there will be NO REFUND. If breeder has to
take legal action against buyer, then buyer will be responsible for all legal cost. All legal action required will be in the
location where the breeder resides.
*If the purchaser finds for any reason that he/she cannot keep this dog, the BREEDER MUST BE NOTIFIED to assist
with other adoption arrangements. If a new home is not available within the time needed by the buyer, then the dog is
to be returned to breeders property for rehoming, the buyer will assume all cost to return the dog to the breeder.
Written permission must be obtained from breeder to sell or give this dog to another party. At no time is the dog to be
rehomed without written permission.

Our Guarantee:
**This dog is GUARANTEED to be non-affected by cystinuria. This dog’s parents have been screened for: hip
dysplasia, elbow dysplasia, SAS (subvalvular aortic stenosis) and cystinuria. Buyer acknowledges that Breeder has
taken reasonable precautions to prevent the puppy from acquiring hereditary faults. However, due to the hereditary and
environmental causes of such faults the Breeder cannot guarantee that the puppy will not contract such diseases or
ailments, BUT in the event that the puppy is diagnosed by a licensed veterinarian, verified by a specialist chosen by
breeder and has been evaluated by OFA with severe crippling hip dysplasia in the first 12 months of life, then a
replacement puppy will be offered from the next available litter. Buyer must contact breeder and provide original xrays
to breeder for submission to breeders specialist. Xrays must be taken in approved OFA view. After specialist has
reviewed xrays, they will be returned to buyer for submission to OFA for evaluation. All written documentation from
vet, specialist and OFA must be submitted to breeder within 30 days of the last document, then a replacement puppy
will be offered from the next available litter. This guarantee does not cover mild or moderate hip dysplasia. If in the
first 12 months of life the puppy is diagnosed with moderate or severe SAS, after written documentation within 30 days
of a Doppler exam being performed by a board certified cardiologist, then a replacement puppy will be offered from the
next available litter. The replacement pup will be of the same sex, quality and color, there is no health guarantee on the
replacement pup. If for some reason it is determined that the problem was not inherited, but a problem due to lack of
care, involving anything including improper nutrition, injury or environmental issues that could have been avoided,
there will be no replacement puppy. If the dog is overweight, the guarantee is null and void. If any part of this contract
is not followed or is broken without written approval, the guarantee is considered void. Any other arrangements have
to be APPROVED BY THE BREEDER.
The REGISTERED NAME of the dog shall begin with the word BYDAND'S.
IN NO CASE WILL THE BREEDER BE HELD LIABLE FOR ANY DAMAGE OR INJURY CAUSED BY
THIS DOG.
