Invitation to tender

2. The ground to adopt the negotiated procedure under Article 125 of the Hungarian
Public Procurement Act (hereinafter Kbt.):
Article 125 §. section (2) subsection b). Contracting authorities may conduct a negotiated
procedure without a public tender notice in the following cases:
- when, for technical or artistic reasons, or for reasons connected with the protection of
exclusive rights, the services or products may be supplied only by a particular organisation or
person.
3. The method, the final date and the place for collecting the tender specifications as well
as the terms of payment of any sum to be paid for such documents, if the contracting
authority has drawn up such documents but did not send them concurrently with the
invitation to tender:
The tender specification will be sent with the invitation to tender (free).

Database access licence agreement.
6. The term of the contract or the time limit for delivery:
Time limit for delivery: December 31, 2011
7. Place of delivery:
Hungarian and outside the country institutions of higher education and scientific institutions
(see attached in Appendix A in the tender documentation).
8. Conditions for settling the price and reference to the applicable laws:
Payment of the invoice is performed with respect to the stipulations of subsections (2)-(7) of
the section 305 of Kbt. Winning tenderer may submit a part bill at the half of the service with
amount of 50 % of the total price and may submit a final invoice at the end of the service for
the remaining amount of the price.
9. Acceptance or prohibition of variant (alternative) offers:
Variant (alternative) offers are prohibited. Partial offer is not permitted.

Evaluation criteria (Article 57):
The lowest price
The contracting authority draws tenderer’s attention to make his offer according to the
“Declaration of offer”!
11. Grounds for exclusion from the participation in the procedure:
The existence of the stipulations mentioned in the Article 60 (1) and in the Article 62 of the
Kbt. Grounds for exclusion must be certify according to the Article 63 (2) - (9) of the Kbt.
Tenderers, and in the case outlined in paragraph 1 (b) and (c) and Article 71 (5), their
subcontractors intended to be employed for more than 10% of the public procurement value,
and the organisations providing resources for the tenderer
(a) shall make a written statement in the tender that they are not subject to Article 60 (1) and
they are entitled to certify this;
(b) in the case of winning the contract the tenderer (in the case of joint tenders the tenderers)
shall certify in accordance with paragraphs 2 to 5 and Article 63/A (1) within eight days
following the announcement of results, that they are not subject to Article 60 (1) or – if
prescribed by the contracting authority – to Article 61 (1), provided it has not been certified in
the tender.
The contractor, the sub-contractor intended to be employed for more than 10% of the public
procurement value, the organisations providing resources for the tenderer have to submit a
statement issued by the Notarie according to the above point a) or b).
If the contractor, the sub-contractor intended to be employed for more than 10% of the public
procurement value, the organisations providing resources for the tenderer does not justify the

grounds for exclusion within 8 days from the advertisement of the results of the tender, or
made a false declaration in this regard, its/their tender is invalid according to the Article 88.
(1) i).
Certificates of Article 60. (1) may be submit in simple copy.
12. Suitability criteria and the stipulations (Article 69 /2/)
The methods to verify the (economic/financial/technical/professional) capability of the
tenderer:
- a statement of the tenderer’s total turnover (2009)
- a statement of the tenderer’s turnover in respect of the subject of the contract (2009)
- a list of the internet database services in the past three years (indicating at least the
sums, dates and recipients involved 2008-2010).
Facts for qualifying the tenderer uncapable for the performance of the agreement
(verification terms):
Economic and financial uncapability:
The total turnover in the year 2009 doesn’t amount 500,000 euro;
The turnover in the year 2009 in respect of the subject of the contract doesn’t
amount 250,000 euro.
Technical and professional uncapability:
the tenderer hasn’t got at least one reference regarding internet database
service provision in the past three years (2008-2010.)
The tenderer itself shall meet the stipulated verification terms.

Whether the correction of deficiencies is permitted or not:
The correction of deficiencies is permitted.

19.
The process of negotiations and the related fundamental rules prescribed by the
contracting authority:
The contracting authority plans to negotiate in one turn in order to determine the terms and
conditions of the contract. Nevertheless the contracting authority reserves the right to
negotiate in further turns if it were necessary. The tenderer shall be represented by person
entitled for commitment.
The tenderer may not be able to give more unfavourably offer to contracting authority than
before.

24. Others:
The tender announcer has established the terms of financial and economical capability stricter
than stated in Article 12 (2) of the Kbt.
The tenderer shall be bound to his offer as a result of negotiations for the period of 30 days
that starts from the date of the announcements of result.
The tender documentation shall be signed officially by the tenderer. The tender must be sent
in two samples (original and copy) in closed packing.
The tender shall indicate:
(a) that part (parts) of the public procurement for the performance of which the tenderer
employs a subcontractor for not more than 10% of the contract value,
(b) the subcontractors intended to be employed by the tenderer for the performance of more
than 10% of the contract value and that part (parts) of the public procurement for the
performance of which the indicated subcontractors contribute, and
(c) the organisation providing resources for the tenderer.

Sample of signature of the tenderer and of his subcontractor in a simple copy.
The tender shall contain the tenderer’s and his subcontractor’s and his following documents:
- record of court registration referring to the representatives of the tenderer;
- declaration of accepting the a/m conditions of the invitation.
Act on Public Procurements (2003:CXXIX) shall be decisive for all circumstances not
mentioned in this invitation.
