NEW ALBANY CITY COUNCIL MEETING MINUTES November 19, 2013 CALL TO ORDER: Mayor Ferguson called to order the New Albany City Council Meeting of November 19, 2013 at 6:30 p.m. at Village Hall, 99 West Main Street, New Albany, Ohio. Attending were City Manager Joseph Stefanov, Deputy City Manager Debra Mecozzi, Community Development Director Jennifer Chrysler, Public Service Director Mark Nemec, Police Chief Greg Jones, Public Information Officer Scott McAfee, City Law Director Mitchell Banchefsky, City Engineer Edward Ferris, and Clerk of Council Betty Bosko. Mayor Ferguson led the assemblage in the Pledge of Allegiance. Council Member Briscoe moved, Council Member Pleasnick seconded and Council voted with six yes votes to approve the minutes of the November 5, 2013 meeting as amended. ADDITIONS OR CORRECTIONS TO THE AGENDA: Mayor Ferguson moved to add item 121.22(G)(2) to consider purchase of property for the public use, to the Executive Session scheduled later in the meeting. Council Member Fellows seconded and Council voted with six yes votes to approve the addition. HEARING OF VISITORS: NONE BOARD AND COMMISSION REPORTS: PLANNING COMMISSION: Council Member Briscoe reported that the Commission met and heard four items: A variance for a skylight in a residence: The Preliminary Plat and the Final Plat for the planned Round-about at the intersection of Market and Main Street. RECORDS COMMISSION: Council Member Spalding reported that the Board met this evening prior to the Council meeting and heard two submissions of revised RC-2 forms which were both approved with amendments requested. CORRESPONDENCE AND COMMUNICATIONS: NONE SECOND READING AND PUBLIC HEARING OF ORDINANCES: ORDINANCE O-30-2013 Mayor Ferguson read by title AN ORDINANCE TO DECLARE THE IMPROVEMENT OF CERTAIN PARCELS OF REAL PROPERTY TO BE A PUBLIC PURPOSE, EXEMPT 100% OF THAT IMPROVEMENT FROM REAL PROPERTY TAXATION, REQUIRE THE OWNERS OF THOSE PARCELS TO MAKE SERVICE PAYMENTS IN LIEU OF TAXES, PROVIDE FOR THE DISTRIBUTION OF THE APPLICABLE PORTION OF THOSE SERVICE PAYMENTS TO THE NEW ALBANY PLAIN TOWNSHIP LOCAL SCHOOL DISTRICT AND THE EASTLAND FAIRFIELD CAREER & TECHNICAL SCHOOLS, ESTABLISH A MUNICIPAL PUBLIC IMPROVEMENT TAX INCREMENT FUND FOR THE DEPOSIT OF THE REMAINDER OF THOSE SERVICE PAYMENTS, SPECIFY THE PUBLIC INFRASTRUCTURE IMPROVEMENTS THAT DIRECTLY BENEFIT THOSE PARCELS, AND APPROVE AND AUTHORIZE THE EXECUTION OF ONE OR MORE TAX INCREMENT FINANCING AGREEMENTS Mayor Ferguson opened the Public Hearing on this ordinance. Council Member Pleasnick moved, Council Member Briscoe seconded and Council voted with six yes votes to approve Ordinance O-32-2013. 2 NEW ALBANY CITY COUNCIL MEETING MINUTES November 19, 2013 ORDINANCE O-33-2013 AN ORDINANCE TO AMEND APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES DURING THE FISCAL YEAR ENDING DECEMBER 31, 2013 Mayor Ferguson opened the Public Hearing on this ordinance. Hearing no comments or questions from the public, she closed the Public Hearing. Council Member Pleasnick moved, Mayor Ferguson seconded and Council voted with six yes votes to approve Ordinance O-33-2013. INTRODUCTION AND FIRST READING OF ORDINANCES: ORDINANCE O-35-2013 AN ORDINANCE TO INCREASE THE COMPENSATION OF THE MAYOR AND COUNCIL MEMBERS OF THE CITY OF NEW ALBANY Mayor Ferguson questioned whether this ordinance is needed, as Ordinance O-37-2013 is saying the same thing. Deputy City Manager Debra Mecozzi explained that this legislation is required to be done according to the Charter, and has always preceded an increase in salary for elected officials. Mayor Ferguson said she thinks that is what Ordinance O-35-2013 and O-37-2013 is saying is redundant and it seems we have two pieces of legislation saying the same thing. Ms. Mecozzi said the wording could be amended on Ordinance O-37-2013 prior to second reading and Ordinance O-352013 could be done away with. Mayor Ferguson moved, Council Member Fellows seconded and Council voted with six yes votes to table Ordinance O-352013. ORDINANCE O-36-2013 AN ORDINANCE TO MAKE APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES OF THE CITY OF NEW ALBANY, STATE OF OHIO, DURING THE FISCAL YEAR ENDING DECEMBER 31, 2014 Mayor Ferguson set this ordinance for Second Reading and Public Hearing at the Council meeting on December 3, 2013. ORDINANCE O-37-2013 AN ORDINANCE TO REPEAL AND REPLACE THE CODIFIED ORDINANCES OF THE CITY OF NEW ALBANY, CHAPTER 113 “COUNCIL” SPECIFICALLY SECTIONS 113.01 “SALARY OF THE MAYOR” AND 113.02 “SALARY FOR MEMBERS OF COUNCIL” Mayor Ferguson scheduled this ordinance for Second Reading and Public Hearing on December 3, 2013. 3 NEW ALBANY CITY COUNCIL MEETING MINUTES November 19, 2013 RESOLUTIONS RESOLUTION R-48-2013 A RESOLUTION ACCEPTING THE DONATION OF CERTAIN PROPERTY LOCATED IN NEW ALBANY ON BEECH ROAD NORTH OF SMITH’S MILL LOOP AND SOUTH OF JUG STREET City Manager Stefanov explained that this property was donated by the New Albany Company for our second water tower. This will be a new water tower to service the business park northeast into Licking County. Council Member Marsh questioned the size of the property indicating that in his opinion it was too large a piece of land. Mr. Stefanov stated that this is a 2,000,000 million gallon tower and it will have a large supporting structure, with landscape screening. He said that there needs to be a driveway on each side for future if needed to use as a satellite fire department. Council Member Pleasnick moved, Council Member Briscoe seconded and Council voted with six yes votes to approve Resolution R-48-2013. RESOLUTION R-49-2013 A RESOLUTION TO AMEND RENEW AND EXECUTE THE EMPLOYMENT AGREEMENT WITH THE CITY MANAGER FOR 2014 This is the annual review for the City Manager. Mayor Ferguson expressed her gratitude for the excellent job Mr. Stefanov has done for the community in the 13 years he has been City Manager. She said “He has attracted a record number of new businesses to our state and our city, and helped build one of the largest planned business campuses in the country. We feel very fortunate that Joe Stefanov has chosen to spend a significant part of his professional career here in New Albany and are very grateful for his dedication and hard work.” Mayor Ferguson moved, Council Member Pleasnick seconded and Council voted with six yes votes to approve Resolution R-49-2013. RESOLUTION R-50-2013 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A 2014 HEALTH SERVICES CONTRACT ON BEHALF OF THE CITY OF NEW ALBANY, OHIO WITH FRANKLIN COUNTY PUBLIC HEALTH Mr. Stefanov said the is our annual contract with Columbus for plumbing inspections and other public health related services. Dr. Marsh questioned holding up on this piece of legislation in order to negotiate a voting seat on the board. Mr. Stefanov said we need their various services in order to continue to provide services to the residents. Mayor Ferguson moved, Council Member Marsh seconded and Council voted with six yes votes to approve Resolution R50-2013. 4 NEW ALBANY CITY COUNCIL MEETING MINUTES November 19, 2013 OTHER BUSINESS: FOR DISCUSSION: ORDINANCE O-34-2013 AN ORDINANCE TO MAKE APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES OF THE CITY OF NEW ALBANY, STATE OF OHIO, DURING THE FISCAL YEAR ENDING DECEMBER 31, 2013 Staff presented the remaining presentation of the 2014 budget and discussion ensued regarding the various funds and capital improvements for the coming year. This Ordinance will have Second Reading and Public Hearing on December 3, 2013. Public Service Director Nemec presented Council with a selection of choices for the guardrail for the proposed foot bridge on Thompson Road. Council saw uses of wooden and metal bridge structures and heard the merits of both choices. There is a savings with the metal bridge however there is maintenance required on the metal that is not required for the wooden. Mayor Ferguson moved, Council Member Pleasnick seconded and Council voted with four yes and two no (Marsh and Spalding) to opt for the wooded guardrails for the project on Thompson Road. Mayor Ferguson presented her thoughts on erecting a feature at the entrance to Resch Park. She suggested a boulder and will check on the cost of having it placed. She requested using some of Council Discretionary funds for the purchase of the feature. Mayor Ferguson made a motion to allow her to spend up to $5,000 from the Council Discretionary fund for the sign for Resch Park, Council Member Fellows seconded and Council voted with six yes votes on the motion. Council Member Spalding distributed a draft of the New Albany Bicycle use Master Plan Proposal. This document includes work that has already been done on the comprehensive master plan for creating a plan that should become a component of the overall New Albany Strategic Plan. He asked for city support in creating and hosting a Bicycle Use Steering Committee. Council comments were favorable to the project. STANDING COMMITTEE REPORTS: A. Finance Committee- No report. B. Administration Committee:-No report. 5 NEW ALBANY CITY COUNCIL MEETING MINUTES November 19, 2013 REPORTS OF REPRESENTATIVES: A. Council Representative to MORPC: Mr. Stefanov reminded Council of the Economic Development Summit planned for December 6th, and several Council Members are registered for this meeting. B. Representative to Plain Local Schools- No report. C. Council representative to Plain Township-No report. REPORTS OF VILLAGE OFFICIALS: A. Mayor-The Mayor’s Court Report showed a deposit to the City in the amount of $5,447.40 for the month of November, 2013. B. Clerk of Council-The department of Liquor Control sends out notification annually that all liquor permits are renewed in February of each year. If there are any objections from the municipality, action must be taken in the form of legislation to request a hearing for that establishment. Pursuant to Council and the New Albany Police Chief Jones, there are no objections to the liquor permits in New Albany being renewed for 2014. Council was given the most updated list of new applicants for Boards and Commission for discussion in Executive Session. C. Finance Director- No report. D. City Manager- No report. E. City Attorney – No report POLL FOR PUBLIC COMMENT: NONE POLL FOR COUNCIL COMMENT: NONE EXECUTIVE SESSION: Mayor Ferguson moved, Council Member Pleasnick seconded and Council voted with six yes votes to enter into Executive Session pursuant to ORC 121.22 (G)(1) for personnel discussion, and 121.22(G) (2) regarding pending or imminent litigation. Mayor Ferguson moved, Council Member Briscoe seconded and Council voted with six yes votes to come out of Executive Session.
