A Bill Concerning Eminent Domain

1 WHEREAS , eminent domain allows the government to expropriate private property to

2 meet the necessary needs of the majority, and

3 WHEREAS, these needs usually mean developing infrastructure and projects for the

4 betterment of the society, and

5 WHEREAS, the Supreme Court ruling on Kelo v. City of New London has loosened the

6 requirements for what constitutes as “necessary”, and

7 WHEREAS, this has allowed eminent domain to cater to the needs of the few for

8 economic purposes, therefore be it

9 RESOLVED by the student Congress here assembled that a reform is imperative in the

10 area of eminent domain. However this would not be to collapse eminent domain

11 altogether, but to reevaluate what becomes necessary when removing American citizens

A Resolution Concerning Democratic Sovereignty

1

Whereas, the democratic process asks voters to choose “yes” or “no” to various

2 referendums, ballot measures, bond issues, or candidates, and

3 Whereas, depending on the specified location, either a plurality or simple majority of

4 voters aligning on one side of the issue at hand is required for the issue to pass or

5

7 for the candidate to be elected, and

6 Whereas, the various state Supreme Courts comprise far fewer individuals than the electorate as a whole, and

8 Whereas, court challenges to the certified results of an election undermine the democratic

9 process,

10 Therefore, be it resolved by the TFA Student Congress here assembled that the various

11

12 state Supreme Courts be prohibited from overturning the certified results of an election except for cases of voter fraud.
