Red Bull MX Project – Rules & Regulations Contest Sponsor: Red Bull Canada, Ltd. 1. To Enter: No Purchase Necessary. The Red Bull MX Project Contest (the “Contest”) is open to all legal residents of Canada and the United States. Contest begins at 12:01 am Eastern Time (“ET”) May 30th, 2012 and ends 11:59:59 pm ET June 22nd, 2012 (the “Contest Period”). Visit http://www.redbull.ca/ktm (“Contest Website”) during the Contest Period and enter the Contest by entering your information in the registration form. Entrants will be contacted via e-mail for any reason pertaining to the Contest. Only one entry per person throughout the Contest Period. No automated entry devices and/or programs permitted. All entries must be received by no later than 11:59:59 pm ET June 22nd, 2012 (the “Contest Closing Date”). Entries will be rejected and/or removed if entry form is not fully completed and submitted by the Contest Closing Date. 2. Registration Requirements: Entries must be submitted via the Contest Website and all fields of the registration form must be completed accurately to be considered valid entries. All entries will be entered into a random draw. Entries not complying with these Official Contest Rules may, at the sole and absolute discretion of the Contest Sponsor, be disqualified and/or removed. Entries will not be eligible if submitted by any method not specified above or if received after the Contest Closing Date. In the event that the potential winner is determined by the Contest Sponsor to be ineligible for any reason, including by reason of failure to comply with these Official Contest Rules, or is unable for any reason to participate in Red Bull MX Project, such entrant will be disqualified and the Contest Sponsor or its representatives may contact an additional entrant at their sole and absolute discretion, as applicable. The Prize: The Red Bull MX Project Contest Prize (the “Prize”) consists of having the privilege to design Colton and Tyler’s Motocross helmet. There is no retail value of the prize. To be eligible to participate in the Red Bull MX project Contest, each potential winner (and if the potential winner is at least 18 years of age but under the age of majority in his/her province/territory/state of residence, his/her parent or legal guardian) will be required to return a signed Declaration and Release of liability and publicity (the “Release”), in the Contest Sponsor’s designated form and within the time period specified on the form, and correctly answer a mathematical skill-testing question, without aid or assistance, as set forth on the Release, failing which the opportunity to participate in the Red Bull MX Project Contest qualifier will be forfeited and the Contest Sponsor reserves the right to select another potential winner (see Rule 4 above). 3. All prizes must be accepted as awarded and may not be transferred, or exchanged and have no cash surrender value, PROVIDED HOWEVER, that the Contest Sponsor reserves the right to substitute a prize, or portion of a prize with a similar prize (including without limitation a cash award) for whatever reason. 4. Eligibility: The Contest is open to all legal residents of Canada and the United States and entrants must be at least 18 years old on the date of entry and not an employee of, or domiciled with an employee of, the Contest Sponsor, its affiliated companies, representatives, agents, advertising or promotional agencies. The Contest is subject to all applicable federal, provincial, and municipal laws and regulations. By participating, entrants agree to abide by and be bound by these Official Contest Rules and to accept the decisions of the Contest Sponsor as final. 5. Winner Notification: On June 25th, 2012, the winner will be announced on redbull.ca/ktm. 6. Additional Terms: By participating, entrants agree to a) these Official Contest Rules and the decisions of the Contest Sponsor which are final in all respects; and b) release, indemnify and hold harmless the Contest Sponsor and its subsidiaries, affiliates, officers, directors, employees, agents, dealers, advertising and promotional agencies and prize suppliers from all liability relating to the Contest, participation in the Contest and the acceptance or participation in the Prize. 7. The Contest Sponsor shall not be responsible for print or typographical errors in any Contestrelated materials. All entries become the property of the Contest Sponsor, which assumes no responsibility for lost, stolen, delayed, damaged, misdirected incomplete, illegible entries or for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any entry to be received by the Contest Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof. Further, the Contest Sponsor, its advertising and promotion agencies will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the contest. Any attempt to deliberately damage or undermine the legitimate operation of this contest is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they mutilated, forged, falsified, altered or tampered with in any way. All matters related to this Contest (including, without limitation, its operation and/or issues concerning the construction, validity, interpretation and enforceability of these Official Contest Rules) shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein. 8. The Contest Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux (“Régie”), to withdraw or amend this contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Contest Sponsor that interferes with the proper conduct of this contest as contemplated by these rules. 9. The Contest Sponsor and those associated with them will bear no legal liability, expressed or implied, regarding the use of the winning Submissions by the Sponsor and THE CONTEST SPONSOR SHALL BE HELD HARMLESS BY AN ENTRANT IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE CONTEST RULES. 10. The Contest Sponsor is collecting personal data about entrants for the sole purpose of administering this contest and by entering this contest, each entrant expressly consents to the Contest Sponsor, its agents and/or representatives, storing, sharing and using the personal data submitted for this purpose. No further informational or marketing communications will be received by entrants unless entrants provide explicit permission as indicated on the entry form. 11. For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. 12. If the identity of an on-line entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. The sole determinant of time for the purposes of receipt of a valid entry or vote in this Contest will be the Contest server machine(s).
