ATTENTION IRRIGATORS Ordinance No. 91-4 An Ordinance prohibiting water from any irrigation ditch or sprinkler system to flood or spray upon county road, or to thereby obstruct or prevent vehicular traffic, or render the ROAD UNSAFE FOR VEHICULAR PASSAGE. WHEREAS, Sections 7-14-2101 and 7-14-2102, Montana Code Annotated gives and grants the Board of County Commissioners authority to layout, maintain, control and manage county roads and bridges and the Board of County Commissioners may, in its discretion, do whatever is necessary for the best interests of the county roads; and WHEREAS, the sprinkling, flooding or flowing of irrigation waters upon or across the county roads cause deterioration of such roads resulting in increased costs to the public and possible obstruction of said county roads. SECTION 1: The Beaverhead County Commission hereby decrees it to be unlawful to purposely or knowingly permit or allow water from any irrigation ditch to flow over, or for any irrigation sprinkler system to spray on any county road, or to thereby obstruct or prevent vehicular traffic, or render the county road unsafe for vehicular traffic. SECTION 2: Any person found guilty of a violation under Section 1 shall be fined in the sum not to exceed One Hundred Dollars ($100.00) and/or be imprisoned in the county jail for a term not to exceed thirty (30) days or both.
