TERMS & CONDITIONS (AMENDMENT)
Only diesel will be provided by the department as per average of the jeep.
The fuel average will be maintained by the owner and should not be in any case
below 12Km./per litre.
The driver will be provided by the contractor/owner/authorized representative of
the vehicle having current driving license of the driver.
Owner will be responsible for any damage, defects etc. occurred in vehicle and
shall ensure timely repair/services/maintenance of vehicle so that
Corporation/Nigam work may not suffer.
If any accident occurred during the engagement of the vehicle in this division, the
owner of the vehicle will be responsible for making payment of compensation in
terms of Compensation Act- 1929 and M.V.Act.
The timings of jeep/vehicle will be 8.00 A.M. to 10.00 P.M. in case of emergency,
vehicle/jeep will be used for 24 Hrs. for which no extra payment will be made to
the owner. The driver shall be available for this emergency.
Payment will be made to the owner in running bills/vouchers.
In case, vehicle remains out of order continuously for more than 6 hrs. for which
no charges will be paid to the owner for that day.
The vehicle shall be utilized as per instructions of Executive Engineer, EUTD,
Aligarh.
The vehicle may be used with in state/out of state as required.
Road Tax, Insurance charges etc. and any other liabilities or tax on the vehicle will
be paid timely by the owner of the vehicle as per Motor Vehicles Act and Motor
Vehicles Regulations-1998 and amended from time to time by the Govt. of U.P.
The agreement can be terminated at any time without any prior notice to the
owner/contractor.

If the owner (Contractor) fails to provide vehicle without advance intimation to
the department, the penalty @ Rs. 300/- (Rs. Three Hundred Only) per day upto
maximum Rs. 3000/- (Rs. Three Thousand Only) will be imposed and will be
deducted from his pending bills/liabilities.
All disputes arising out of and touching thereto the subject matter of this/order
shall be subject to the conditions as laid down in form-A only.
All disputes are subject of local court at Aligarh/and High court of Allahabad
only.

GENERAL INSTRUCTIONS TO TENDERERS
1.
Tender shall be submitted in two parts, Part-I containing earnest money and Part-II
containing rates schedule and other documents i.e. last income tax clearance
certificate, past experience etc. Part-II of the tender will be opened only of those
tenderers who have submitted the requisite amount of earnest money in Part-I.

The conditional rates, shall not be considered. The tenders should be completed in all
respects, otherwise tender will liable to be rejected.
3.
The tenderers are required to go through all the instructions / conditions / procedures
and specifications carefully and strict compliance, before submitting their tender and
filling the tender document shall be made.
4.
In case the tenderer is prepared to offer any rebate or reduction in the price, the same
should clearly defined and mentioned in the tender.
5.
The undersigned shall not be bound to accept the lowest or any particular tender and
reserve the right of accepting / rejecting the whole or any portion or all the tender
work without assigning any reason what so ever.
6.
The earnest money of the successful tenderers shall be adjusted towards the security
deposit.
7.
The successful tenderers will have to enter into an agreement within seven days of
receiving the intimation of accepting of the tender will have to deposit the requisite
amount of security amounting 5% of the value required under clause of general
conditions of form contact ‘A’ No. exemption whatsoever shall be granted in any
case in this regard. The security can be furnished in the form of Bank Guarantee in
favour of the Executive Engineer, Electricity Urban Test Division, Type III/5 Lal
Diggi, Aligarh.

In case of dispute, the decision of the Superintending Engineer, EUDC, Aligarh will
be final and binding on both the parties.
9.
Quantity can vary upto a limit ±10% to a total value of the order.
10.
Telephone and Telegraphic Tender will not be accepted.
