Area of Operation and Parties Bound 2.1 This award shall apply within the whole of the State of New South Wales and shall apply to and be binding on any person or persons employed in the occupation of a Professional Surveyor in the private sector who has qualifications which enable that person to obtain membership of the Institution of Surveyors, Australia, NSW Division Incorporated, except those persons in subclause 2.2; 2.2 This award does not apply to: Employees of the Crown; Employees in the coal mining industry; Employees of municipal or shire councils; Employees of Rail Access Corporation, Freight Rail Corporation, Rail Services Authority and State Rail Authority of New South Wales; Employees of Pacific Power, Macquarie Generation, Delta Electricity and Transgrid; Employees of Energy Australia, Integral Energy, Northpower, Great Southern Energy, Advance Energy and Australian Inland Energy. Employees of Sydney Water Corporation; Employees of Hunter Water Corporation; Employees of the Roads and Traffic Authority; Employees of the Office of Marine Administration, Sydney Ports Corporation, Newcastle Ports Corporation, Port Kembla Ports Corporation, the Marine Ministerial Holding Corporation and the Waterways Authority; Employees of the Broken Hill Proprietary Company Limited or Tubemakers of Australia Limited, or any corporation which is a related corporation (within the meaning of the Companies (NSW) Code 1981) of either The Broken Hill Proprietary Company Limited or Tubemakers of Australia Limited. 3. Definitions 3.1 APESMA shall mean the Association of Professional Engineers, Scientists and Managers, Australia. 3.2 Act shall mean the Surveyors Act 1929 as from time to time amended. 3.3 Regulations shall mean the Surveyors (General) Regulation 1982 and the Surveyors Practice Regulation 1996 as from time to time amended. 3.4 Professional Surveying duties shall mean duties carried out by a person in any particular employment the adequate discharge of any portion of which duties requires qualifications of the employee acceptable to the Institution of Surveyors, Australia for admission to the grade of at least Graduate member. 3.5 Professional Surveyor shall mean an employee qualified to carry out professional surveying duties as above defined and shall include employees classified as Graduate Surveyor, Registered Surveyor, Group B Professional Surveyor and Group C Professional Surveyor as contained in clause 4, Salaries and Classification. 3.6 Graduate Surveyor shall mean a person who has successfully completed a course of studies approved by the Surveyors’ Board or the Institution of Surveyors Australia whom is entitled to enter a training agreement with a Registered Surveyor. Professional Surveyors (Private Industry) (State) Award [AN120441 – NSW] 2 3.7 Cadastral work shall, when referred to in the body of the award, have the same meaning as survey contained in the Act. 3.8 Registered Surveyor shall mean an employee qualified to carry out professional surveying duties as defined above and who is registered in accordance with the provisions of the Act as defined above and who is not classified as a Group B Professional Surveyor or a Group C Professional Surveyor as contained in clause 4, Salaries and Classifications. Professional Surveyors (Private Industry) (State) Award [AN120441 – NSW] 3 Professional Engineers’ Award – State 2002 [AN140227 – Qld] 1.3. Application of Award 1.3.1 Subject to clause 1.3, this Award applies throughout the State of Queensland to employers of Professional Engineers as defined in clause 1.6 and to all employee Professional Engineers so defined and are primarily engaged in undertaking Professional Engineering Duties. 1.3.2 Exclusion from Coverage 1.5. (a) Employees covered by the Public Service Act 1996 (b) Employees of Queensland Rail, the Port of Brisbane Authority, the Gladstone Area Water Board, the Metropolitan Regional Abattoir Board, the Gold Coast Waterways Authority, Bulk Grains Queensland, the Bureau of Sugar Experiment Stations, Harbour Boards, Colleges of Advanced Education, Universities, Public Hospital Boards and the Corporation of the Trustees of the Sisters of Mercy, Mater Misericordia Public Hospital. (c) Academic staff, and staff appointed in accordance with academic conditions of employment, who are employed by Universities; (d) Employers who are members of The Australian Sugar Milling Council, Union of Employers; (e) CSR Limited; (f) Australian Sugar Research Ltd; and (g) MIM Holdings Limited, Mount Isa Mines Limited, Copper Refineries Pty. Ltd., Carpentaria Exploration Company Pty Ltd, Carpentaria Gold Pty. Ltd., Abbot Point Bulkcoal Pty. Ltd., Oaky Creek Coal Pty Ltd, Collinsville Coal Company Pty Ltd, Newlands Coal Pty Ltd., and Townsville Transport & Services Pty. Ltd. (h) This Award does not apply to employees covered by the Surveying (Private Practice) Award - State. Parties Bound This Award is legally binding upon the employees as prescribed by clause 1.3 and their employers, and upon the Association of Professional Engineers, Scientists and Managers, Australia, Queensland Branch, Union of Employees and its members. 1.6. Definitions 1.6.1 "Act" means the Industrial Relations Act 1999 as amended or replaced from time to time. 1.6.2 "Association" means The Association of Professional Engineers, Scientists and Managers, Australia, Queensland Branch, Union of Employees. 1.6.3 "Commission" means the Queensland Industrial Relations Commission. Professional Engineer’s Award – State 2002 [AN140227 – Qld] 4 1.6.4 "Experienced Engineer" means a Professional Engineer whose duties require qualifications at least equal to those of a Member of The Institution of Engineers, Australia. These qualifications are as follows: (a) is a Member of the said Institution; or (b) having graduated in a 4 or 5 year course at a University recognised by The Institution of Engineers, Australia, has had 4 years' experience as a Qualified Engineer; or (c) not having so graduated, has had 5 years of experience as a Qualified Engineer. 1.6.5 "Graduate" means a "Qualified Engineer" who is the holder of a University Degree (4 or 5 year course) recognised by The Institution of Engineers, Australia or is the holder of a degree, diploma or other testamur which: (a) has been issued by a Technical University, an Institute of Technology, a European Technical High School (Technische Hochschule) or Polytechnic, or other similar educational establishment; (b) and is recognised by the Institution as attaining a standard similar to a University degree; (c) and has been issued following: (i) A course of not less than 4 years' duration for a full time course; or (ii) A part-time course of sufficient duration to attain a similar standard as a 4 years' full-time course. 1.6.6 "Professional Engineering Duties" means duties carried out by a person who requires qualifications at least equal to those of a Graduate member of The Institution of Engineers, Australia. 1.6.7 "Professional Engineer" means a person qualified to carry out Professional Engineering Duties as defined above. The term "Professional Engineer" will include "Qualified Engineer" and "Experienced Engineer" as defined. 1.6.8 "Qualified Engineer" means a Professional Engineer other than an "Experienced Engineer' as defined, that is, qualified to become a Graduate member of The Institution of Engineers, Australia. Scope, Persons Bound and Locality 1.3.1 This Award applies throughout South Australia and is binding on any person employed in categories as set out in Schedules 1 and 2, whether as employers or employees and whether members of an association or not. 1.3.2 This Award is not binding on: 1.3.2.1 persons employed by stock and station agents, timber merchants, banks, architects, surveyors or cartographers. 1.3.2.2 trade apprentices 1.3.2.3 persons who for a term not exceeding two years are employed in a drawing office as part of a course of training in a profession other than draughting or for an executive or administrative position. 1.3.2.4 persons mainly engaged in the supervision of employees, where such employees are outside the coverage of this Award. 1.3.2.5 persons engaged in the shipbuilding industry. 1.3.2.6 any person employed in the service of the State of South Australia. 1.3.2.7 any person employed by a local government authority, The Broken Hill Proprietary Company Limited, OneSteel Manufacturing Pty Ltd, The Broken Hill Associated Smelters Pty Ltd, I.C.I Alkali (Aust) Pty Ltd and The Flinders University of South Australia or any employees thereof. 1.5. Definitions In this Award except where otherwise indicated: 1.5.1 Association means: (a) an association, society or body formed to represent, protect or further the interests of employers or employees; or (b) an organisation or a branch of an organisation, registered under the Commonwealth Act. 1.5.9 Union means the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union (SA State Council). Structural Engineers Thermodynamic Engineers Ventilation Engineers Definitions 1.5.1 Association shall mean the Association of Professional Engineers Australia, (Western Australian Branch), Organisation of Employees. 1.5.2 Commission shall mean the Western Australian Industrial Relations Commission. 1.5.3 Professional Engineers: (a) 'Professional Engineering Duties' shall mean engineering duties carried out by a person in any particular employment the adequate discharge of any portion of which duties requires qualification of the employee as (or at least equal to those of) a graduate member of the Institution of Engineers, Australia. (b) 'Professional Engineer' shall mean an adult person qualified to carry out professional engineering duties as defined above. The term "Professional Engineer" shall embrace and include "Qualified Engineer" and "Experienced Engineer" as hereinafter defined. (c) 'Qualified Engineer' shall mean a Professional Engineer other than an "Experienced Engineer" as hereinafter defined; that is, it shall mean a person who is, or is qualified to become, a graduate member of the Institution of Engineers, Australia. (d) 'Experienced Engineer' shall mean a Professional Engineer with the undermentioned qualifications in any particular employment the adequate discharge of any portion of the duties of which employment requires qualification of the employee as (or at least equal to those of) a Member of the Institution of Engineers, Australia. The aforesaid qualification is as follows: (i) that they are a Chartered Member of the said Institution; or (ii) that the person, having graduated in a four year or a five year course at a university recognised by the said Institution, has had four years' experience on professional engineering duties since becoming a Qualified Engineer; or (iii) that the person, not having so graduated, has had five years of such experience. (e) 'Graduate Engineer' shall mean a "Qualified Engineer" who is the holder of a university degree (four or five year course) recognised by the Institution of Engineers, Australia or is the holder of a degree, diploma or other testamur which: (i) has been issued by a technical university, an institute of technology, a European technical high school (Technische Hochschule) or polytechnic or other similar educational establishment; and (ii) is recognised by the Institution as attaining a standard similar to a university degree; and completed the following: Western Australian Professional Engineers (General Industries) Award 2004 [AN160336 – WA] 9 (A) a course of not less than four years' duration for a full-time course after a standard of secondary education not less than the standard of examination for matriculation to an Australian University; or (B) a part-time course of sufficient duration to attain a similar standard as a four years' full-time course, after a similar standard of secondary education. 15. Named Parties to the Award 15.1.1 The parties to this Award are: (a) the Association of Professional Engineers Australia (Western Australian Branch) Organisation of Employees; and (b) the respondent employers listed in Clause 16. Scope This award applies to the whole of Tasmania to any person or persons, or class of persons employed in architectural duties as hereinafter defined but not including: Architects employed in State Government Departments or Instrumentalities, Local Government Authorities or Port Authorities and/or Marine Boards. 5. Award Interest (a) The following employee organisation has an interest in this award under Section 63(10) of the Industrial Relations Act 1984: The Association of Professional Engineers, Scientists and Managers, Australia. (b) The following organisation is deemed to have an interest in this award pursuant to Section 62(2) of the Industrial Relations Act 1984: the Tasmanian Chamber of Commerce and Industry Limited. (c) The following organisation is deemed to have an interest in this award pursuant to Section 62(3) of the Industrial Relations Act 1984: the Tasmanian Trades and Labor Council. 7. Definitions ‘Architectural duties’ shall mean duties carried out by Architects, Experienced Architects, Graduates of Architecture and Students of Architecture. ‘Architect’ shall mean an employee who is registered under the Architects Act 1929. ‘Experienced Architect’ shall mean a Graduate of Architecture who is performing the duties as defined for Level 2 - Experienced Architect. ‘Graduate of Architecture’ shall mean an employee who (a) has passed an examination of a university, college, school or public institution for the training of architects, the passing of which examination is recognised by the Council of the Royal Australian Institute of Architects as conferring an entitlement to apply for admission to corporate membership of that Institute and (b) is working towards gaining registration under the Architects Act 1929. ‘Student of Architecture’ shall mean an employee who is normally enrolled in a course of Architecture and who is employed to gain experience in the practice of Architecture.
