ORDINANCE NUMBER 40-2011

AN ORDINANCE TO AMEND SEC. 27.5-26 OF THE

CODE OF ORDINANCES, CITY OF ALEXANDRIA

BY ADDING REVISED LOCAL LIMITS FOR CITY OF ALEXANDRIA

WASTEWATER TREATMENT PLANT UNDER THE CITY’S WASTEWATER

PRETREATMENT PROGRAM

WHEREAS, the City of Alexandria NPDES permit require municipalities with approved pretreatment programs to develop local discharge limits to regulate nondomestic discharges into the Publicly Owned Treatment Works, (POTW); and

WHEREAS, the City of Alexandria implements the Pretreatment Program as required by the NPDES permit to prevent interference with the treatment plant, pass through of pollutants through the POTW, proper sludge use and disposal, and meet water quality standards; and

WHEREAS , the Department of Environmental Quality has reviewed the proposed revisions to the City of Alexandria local discharge limits and found the revision acceptable for the purpose of issuing a public notice; and

WHEREAS, the City of Alexandria published the proposed local discharge limits in the legal section of the Town Talk allowing a 30-day comment period for the public; and

WHEREAS, the City of Alexandria did not receive any public comments concerning the proposed local discharge limits; and

WHEREAS , to properly implement this change, the local discharge limits must be added to the City’s wastewater ordinance, and

NOW THEREFORE,

SECTION I: BE IT ORDAINED by the Council of the City of Alexandria, Louisiana, in legal session convened that Article VII, Section 27.5-26 of the Waste Water Pretreatment

Program is hereby amended to include the following local discharge limits:

Heavy metals and toxic materials contained in waste discharged to the public sewers shall not exceed the following listed pollutant levels:

SECTION II: BE IT FURTHER ORDAINED, that this ordinance shall become effective upon signature by the Mayor, or, if not signed or vetoed by the Mayor, upon expiration of the time for ordinances to become law without signature by the Mayor.

SECTION III: BE IT FURTHER ORDAINED, that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this ordinance which can be given effect without the invalid

provisions, items, or applications, and to this end the provisions of this ordinance are hereby declared severable.

SECTION IV: BE IT FURTHER ORDAINED, that all ordinances or parts of ordinances in conflict herewith are hereby repealed.

THIS ORDINANCE, was introduced on the 22 nd

day of March, 2011.

THIS ORDINANCE having been submitted in writing, introduced and published, was then submitted to a final vote as a whole, the vote thereon being as follows:

YEAS: Fowler, Gibson, Villard, Goins, Silver, Johnson, Larvadain.

NAYS: None.

ABSENT: None.

AND THE ORDINANCE was declared adopted on this the 5 th

day of April, 2011 and final publication was made in the Alexandria Daily Town Talk on the 8 th

day of April, 2011.
