MINUTES OF THE WAYNE TOWNSHIP BOARD OF TRUSTEES MEETING HELD MARCH 17, 2015 Mr. Bradley Coffman called the meeting to order at 7:02 pm. Roll call: Mr. Davidson - present; Mr. Foley- present; Mr. Coffman - present. The following were also present: Administrator, Donald Edwards; Fiscal Officer, Darrell Coffman; Zoning Inspector and Asst. to the Administrator, Erin Hartsock; Amy Cameron, Warren County Soil and Water and Residents Dave O’Banion, George R. Cherryholmes and Andrew Jacobs. Board President, Bradley Coffman welcomed those in attendance. Mr. Coffman led those in attendance in the pledge of allegiance to the flag. Mr. Foley motioned to approve the Minutes of the previous meeting. Mr. Coffman seconded the motion. Upon call of the roll thereon the vote resulted as follows: Mr. Foley – yea, Mr. Davidson – yea, Mr. Coffman – yea. CITIZEN’S COMMENTS: There were no citizen comments. DEPARTMENT REPORTS: ROAD DEPARTMENT: Road Department Supervisor, Scott Camery reported as follows: Current department activities have focused on “post snow” maintenance of the snow removal equipment. This includes replacing and repairing steering components on the International single axel and replacing the front brakes and wheel seals on the #2 Mack tandem. All repairs have been completed and the equipment has been returned to service. With the weather “letting up” we have started on another round of “pothole patrol” we should have this completed this week. More substantial work will be required for roads where the asphalt toward the center has experienced significant deterioration. This will require digging up the damaged areas and repaving the affected areas—most notably on Ellis-Lincoln Rd. Once this work is completed, stump removal along Corwin Rd. and berming throughout the Township will continue. The 5310 John Deere mowing tractor is on Govdeals and Mr. Camery is working with JD Equipment regarding the purchase of the new replacement tractor. Mr. Camery has received a new office computer. Administration is currently in the process of transferring files and data from the old to the new. Currently the Roads Department is at 100% equipment availability. 1 MINUTES OF THE WAYNE TOWNSHIP BOARD OF TRUSTEES MEETING HELD MARCH 17, 2015 Mr. Foley inquired whether or not the Roads Dept. had plans to sweep the roads free of grit used in the salt treatments as they had done after previous winter. Mr. Camery responded that the previous winter had been among the harshest in recent history and thus there was much more grit present on the roadways following winter weather events. That said, he would reevaluate the need for such an action as the weather continued to improve and spring rains had an opportunity to wash the grit away naturally. FIRE DEPARTMENT: Fire Chief, Paul Scherer followed by reporting as follows: Chief Scherer recently submitted the 2015 - 2016 State EMS Grant. He is working on closing out the 2014-2015 State EMS Grant. The previously discussed AED for the Twp. Admin Building has been purchased (with State EMS Grant dollars) and is located in the Reception Desk area. CPR and AED usage training will be provided at a future date for township employees. Chief Scherer issued a reminder that the Washington Twp. Contract expires end of the year. He went on to report that Medicount, a company that purchased MBI sent a package detailing terms of service that will require signatures of the Board. It was discussed that the packet mostly contained much of the former company’s terms. It was decided that Administrator, Gus Edwards would look over the packet for consistency prior to the Board signing the documents. Chief Scherer presented a new applicant to ensure that the she was appropriate under Ethics guidelines due to her being his niece. The matter will be decided on at a later meeting. Chief Scherer concluded by stating that Mutual Aid information was emailed out previously for the Trustees to be better informed. ZONING DEPARTMENT: Zoning Inspector, Erin Hartsock reported on the following: The Zoning Commission heard an application to rezone 5970 Middletown Rd. on March 5th. The commission unanimously recommends approval of the application. The Trustees are scheduled to hold the final public hearing on April 7th at 8:00 p.m. Ms. Hartsock continued by stating that Wright State University students are helping to put together a workshop designed to get feedback from residents regarding land use/zoning. It will be similar to the Comprehensive Planning format, but more group-directed/driven and focusing more on zoning issues. 2 MINUTES OF THE WAYNE TOWNSHIP BOARD OF TRUSTEES MEETING HELD MARCH 17, 2015 The workshop will be held at two (2) different times and days to make attending such a workshop more accessible for residents. Scheduled dates are as follows: Tuesday, March 24th at 7:00 pm OR Saturday, March 28th at 10:00am. The workshop is open to any and all residents wishing to attend, however approx. 50-60 invitations were expressly sent to random property owners in three (3) categories to better ensure a representational mix of perspectives: those who live in subdivisions, those who own 10-19 acres of land, and those who own in excess of 20 acres. Ms. Hartsock concluded by discussing 6326 Corwin Rd. She stated that she had received a complaint regarding the condition of the property and followed up with the resident accordingly. After much progress had been made removing vehicles and debris the previous year, the resident was less motivated about such efforts this year. The Board discussed options moving forward and it was decided that Ms. Hartsock should continue working with the resident in achieving as much clean-up as possible rather than turn the case over to the County Prosecutor’s Office at this time. ADMINISTRATOR REPORT: Administrator, Donald Edwards reported the following: The sewer line from the office finally unthawed last week. The lid on the grinder pump will need to be resealed. Staff have located the valve box at the street and will be digging up the back flow preventer and having the County Water & Sewer determine if there is a need to push a new line under SR 73 to prevent freezing. Mr. Edwards continued to state that Enterprise Pipeline Company is going to be in the area sometime between now and the end of April. They are running a “Smart Pig” through the pipeline for inspections. This is an ongoing 24-hour process that will require surveyors to enter and exit properties along the right of way as quickly as possible, by foot, truck and or 4-wheelers. They will be gathering their information and data as the “Smart Pig” passes. All affected property owners have received letters but some residents may still have questions when they see this activity. Mr. Edwards discussed the OKI Regional Planning Forum, to be held on March 27th. This will be an informational forum to discuss the Fort Ancient World Heritage Site and the resulting surge in tourism it is expected once Ft. Ancient receives this designation. Tree and shrub plantings for the Middletown Road Stream Bank Restoration Project is scheduled for mid-April. The asbestos samples on the property at 9908 N. Cin.-Col. Rd. have been pulled for testing. Mr. Edwards had talked with Jack Cameron from Clearcreek Township about LED lighted Stop signs for Township Line Road and SR 73. ODOT stated that the data did not warrant them but they are agreeable to installing and maintaining them if Clearcreek pays for them. Additional discussions involved the intersection at Township Line and Old 122, but Clearcreek is not interested in installing LED stop signs at that intersection. The Warren County Engineer’s office is looking at doing an intersection improvement at Old 122 in 2018. 3 MINUTES OF THE WAYNE TOWNSHIP BOARD OF TRUSTEES MEETING HELD MARCH 17, 2015 Discussions continued over the various intersections. Chief Scherer stated that he believed that the intersection of Township Line and Old 122 had more accidents than the other intersection, however the other intersection had a fatality last fall and received more attention. He also believed that Clearcreek may not see Old 122/Township Line as a priority as they do not as often respond to this area. OLD BUSINESS: LAEPP Program Special Guest, Amy Cameron, of Warren County Soil and Water along with applicant/resident Dave O’Banion discussed the three (3) agricultural easement applications with the Trustees and the location in regards to the flood plain and other agricultural and conservation easements. Mr. Edwards explained that a decision should not be made lightly as it is for perpetuity and the positioning of the farms along Route 42 would effectively prohibit the extension of utilities to the northern areas of the township. He explained that the cost would be great to extend services for over a mile with no property owners to share the cost through this stretch. Additionally, it could serve to isolate existing development in Sandy Run and prohibit the extension of Cook-Jones Rd. identified as a prime objective in the Comprehensive Plan. Mr. O’Banion explained that he was undertaking this process to honor the wishes of this deceased mother and the Homestead farm was his top priority and would also be the highest scoring farm for the program. After some discussion of the possibilities regarding development and growth along this route in the next 50 years or beyond. The Board in general was less supportive of the property that lies to the west of Route 42 and more supportive of the land that follows the Little Miami River, the well field recharge area and the flood plain. Mr. O’Banion stated that he would be willing to divide the Church farm across Route 42, removing the western portion and retaining the eastern portion for the sake of the LAEPP application if that would make it easier for the Trustees to support. The Trustees thanked Mr. O’Banion and stated that they would have a decision in Resolution form at the next meeting, April 7th. Ms. Cameron stated that the applications must be submitted to ODA by April 15th and that should be enough time for Soil and Water to process the details of the application. QUESTION OR CONCERNS OF THE BILLS: None NEW BUSINESS: Chairman Coffman announced that after hearing discussions regarding energy aggregation, he was more amendable to entertain discussions regarding how this might benefit Wayne Township residents. Anecdotally, it saved Hamilton Township residents a lot of money and a Mr. Weber, a Trustee there spoke 4 MINUTES OF THE WAYNE TOWNSHIP BOARD OF TRUSTEES MEETING HELD MARCH 17, 2015 highly of it. Discussions continued regarding the territory split of Duke and DP&L residents in the area and that this would not complicate any aggregation efforts and how best to approach voters with this option and the educational that campaign would need to be waged. No conclusions were reached. LEGISLATION: 2015-11 A RESOLUTION APPROVING PERMANENT APPROPRIATEIONS FOR THE YEAR 2015 Mr. Edwards presented for consideration and Mr. Davidson moved for adoption of said resolution. Mr. Coffman seconded the motion and upon call of the roll thereon the vote resulted as follows: Mr. Foley – yea, Mr. Davidson – yea, Mr. Coffman – yea. The resolution was therefore adopted the 17thday of March 2015. CORRESPONDENCE: Warren County Combined Health District- newsletter EXECUTIVE SESSION: At 8:35 p.m., Mr. Coffman made a motion to go into Executive Session citing ORC 121.22(G)1 to discuss personnel matters. Mr. Davidson seconded the motion and upon call of the roll thereon the vote resulted as follows: Mr. Foley – yea, Mr. Davidson – yea, Mr. Coffman – yea. At 9:20 p.m., Mr. Coffman made a motion to adjourn out of Executive Session and return to the Open meeting. The motion was seconded by Mr. Foley. Action taken: The Board of Trustees acknowledge the retirement letter of Homer Ramby after 50 years of dedicated volunteer service to the Wayne Township and the Wayne Township Fire Department.
