MINUTES OF THE WAYNE TOWNSHIP BOARD OF TRUSTEES MEETING HELD April 7, 2015 Mr. Bradley Coffman called the meeting to order at 7:02 pm. Roll call: Mr. Davidson - present; Mr. Foley- present; Mr. Coffman - present. The following were also present: Administrator, Donald Edwards; Fiscal Officer, Darrell Coffman; Zoning Inspector and Asst. to the Administrator, Erin Hartsock; Amy Cameron, Warren County Soil and Water and Kelly Maloney from the Mary L. Cook Library. The following residents were also present: Dave O’Banion, H. Art Carney, George R. Cherryholmes, Andrew Jacobs, Gary Breeze, Ray Lamb, Gail Rash, Mary Frommling and Dick Shaw. Board President, Bradley Coffman welcomed those in attendance. Mr. Coffman led those in attendance in the pledge of allegiance to the flag. Mr. Foley motioned to approve the Minutes of the previous meeting. Mr. Coffman seconded the motion. Upon call of the roll thereon the vote resulted as follows: Mr. Foley – yea, Mr. Davidson – yea, Mr. Coffman – yea. CITIZEN’S COMMENTS: Gary Breeze commented that there was a pothole on Corwin Rd. beneath the Route 73 overpass. He also commented that the grit/gravel on the road at Smith Rd. and Corwin Rd. was troubling for motorcyclists. Gail Rash commented that the street light at the corner of Smith Rd. and Route 73 was out. Andrew Jacobs thanked the Roads Department for working with the County in clearing the ditch plugs/clogs along Elbon Rd. DEPARTMENT REPORTS: ROAD DEPARTMENT: Road Department Supervisor, Scott Camery reported as follows: Now that the winter weather events have subsided and the Department is finishing up the removal of sticks in preparation for mowing season. After this, the Roads crew is scheduled to repair the winter’s potholes. There have been many drainage complaints around the township. This is standard as a result of spring rains. Mr. Camery reported that he has contacted OUPS for several spots where he will need to dig and/or repair ditches. These will be marked this week so that he can get started late this week and into next week. The Village of Corwin has a culvert that is failing. Mr. Camery has spoken with the Mayor of Corwin and has reached an agreement for his Department to do the work and the Village will reimburse the Township for materials. The 5310 John Deere tractor has sold on Govdeals.com. Payment was received by Govdeals.com late Monday. Pickup is being scheduled for Friday, after which, Govdeals.com will release the funds into the Township’s account. The new tractor from JD Equipment should be here on or about April 20th. MINUTES OF THE WAYNE TOWNSHIP BOARD OF TRUSTEES MEETING HELD April 7, 2015 Mr. Camery is working with Mr. Edwards confirming a date for a sweeper truck to remove the grit remaining from the winter weather treatments from some of our subdivision roads. Tree clean up on Corwin Rd is complete. Once weather permits, the bulldozer is already in place and ready to proceed with re-grading. Mr. Camery went on to report that the Roads Department assisted Warren County Highway Department with some ditch clearing and “plugs” that happened late last week and over the weekend. He concluded by reporting that the Department is currently at 100% equipment availability. FIRE DEPARTMENT: Fire Chief, Paul Scherer reported as follows: Chief Scherer began by reporting March’s monthly activities. The Wayne Township Fire Department responded to 66 EMS calls and 16 Fires for a total run tally of 82. This is down 7 from this time last year. Chief Scherer went on to state that March reports had been emailed to the Trustees. Equipment status was as follows: Engines, Tankers & Rescue have been serviced with minor repairs (belts, hoses, & air cleaners) 94 Seagrave needs muffler will need replaced soon as it is starting to rust out All the Bay doors were serviced and adjusted where needed Chief Scherer reported that he is working to close out 2014 – 2015 State EMS Grant Looking forward, the yearly Drivers Skills check-offs is scheduled for April 18th & 19th. He went on to remind all present that the annual WTFD Fish Fry will be held this weekend, April 11th and 12th. Chief Scherer concluded by stating that Trustee action/attention was warranted in regards to a letter written by WTFD, Inc. concerning the Fire Department’s website and security and public cameras. ZONING DEPARTMENT: Zoning Inspector, Erin Hartsock reported on the following: Ms. Hartsock began by stating March’s monthly activity report: three (3) single family residences; one (1) accessory bldg.; one (1) addition; three (3) porches and/or decks. Eight (8) permits were issued. All fees have been collected and deposited. Ms. Hartsock continued by stating that the Board of Zoning Appeals held a public hearing on March 19th to hear a conditional use application submitted by Jerry Stacy of 8554 Cedar Hill Rd. to operate as a federal firearms dealer from an accessory building. The application was approved contingent on the following conditions being met: 1. The hours of operation will be limited to the hours stated by Mr. Stacy in the course of his presentation: a. Tuesdays and Thursdays from 2:00-6:00 p.m. and Saturdays from 9:00 a.m.-5:00 p.m. 2. There is no signage permitted so as to better blend with the surrounding neighborhood. 3. No sales from the residence is permitted MINUTES OF THE WAYNE TOWNSHIP BOARD OF TRUSTEES MEETING HELD April 7, 2015 4. The lot shall only be accessed from Cedar Hill Rd., not from Route 42. The conditional use will be administratively reviewed in two years and if any of the conditions are not complied with, then a new hearing will be in order. Ms. Hartsock stated that there has been four (4) applications submitted to date for the Alternate positions on the Zoning Commission. She felt that the applicants all have their own unique strengths and backgrounds. Selections will need to be made in the coming weeks as the rewrite of the Zoning Code will begin next month. Regarding nuisances, the RV, grader and shipping container on Mr. Harris’ vacant agricultural property on O’Neall Rd. have been moved to the rear of the property off the road. Ms. Hartsock provided a brief update on the status of the SCFI fiber optic installation in the northwestern section of the Township. She stated that SCFI is still awaiting the USDA RUS grant award announcement, but the project continues to move forward. Permits are being obtained as well as pole attachment agreements with DP&L and request has been submitted to Mr. Schweitzer for permission to locate a “fiber hut” on a stretch of greenspace where currently there are several utility boxes already in place. She concluded by announcing that the Warren County Chamber Alliance Prioritization Process (CAPP) has selected the SCFI fiber-to-the-home project a top priority and will be lobbying for support of the project to the USDA and State representatives in Washington DC. ADMINISTRATOR REPORT: Administrator, Donald Edwards reported the following: Mr. Edwards began by addressing questions regarding new traffic control plans and other improvements at the intersection of Old 122 and Township Line Road. The Warren County Engineer’s Office has advised that they are entering into an engineering contract with American Structurepoint to design a roundabout at that intersection. They will use federal funds with construction scheduled in 2018. Mr. Edwards went on to state that the State Auditor has finished the Township’s biennial audit last Friday for the years of 2013 and 2014. This was an “Agreed Upon Audit” procedure which saves the Township and thus, the tax payers about half the cost of a full audit. This is the second time we have been through this type of audit procedure, so by law, the next audit must be a full audit. Mr. Edwards reported that he and Mr. Camery attended the BWC Ohio Safety Congress one day last week and each sat in on several different and informative classes. In addition to gaining new insights on safety issues, their attendance will also help the Township in meeting the Safety Council attendance requirements that we were behind on. Mr. Edwards concluded by stating that he is working on a couple of new policies that address security cameras and usage of the Internet, Email, Social Media and other township communication platforms. Route 42, also referred to as the O’Banion Homestead, Parcel #06263000220, containing 138.318 acres, owned by David O’Banion, located on both the east and west side of US Route 42, was deemed compatible with the township’s development plans as laid out by the “Comprehensive Land Use Plan 2030”. Additionally, participation in the program is also compatible with the Village of Waynesville’s “Well Head Protection Zone” and “Time of Travel” for the well field, along with this farm being on an O.D.O.T. designated “Ohio Scenic By-Way”]. RESOLUTION 2015-13 A RESOLUTION TO THE EXTENT PERMITTED BY LAW, AUTHORIZING PARTICIPATION IN THE OHIO LOCAL AGRICULTURAL EASEMENT PURCHASE PROGRAM Mr. Edwards presented for consideration and Mr. Coffman moved for adoption of said resolution. The resolution was therefore adopted the 7thday of April 2015. 4 MINUTES OF THE WAYNE TOWNSHIP BOARD OF TRUSTEES MEETING HELD April 7, 2015 After careful consideration of the following applications, Wayne Township must withhold support of these applications for the following reasons: 1. [7663 US Route 42 farm (Warren County parcel ID: 06312260050), also known as the “Church Farm”, located on the west side of US Route 42 containing 49.38 acres: The Board of Trustees views this property as having good development potential as well well situated for roadway connectivity for other existing residential developments in the Township. 2. Northern farm containing three (3) parcels on the east side of US Route 42 (Warren County parcel IDs: 06213000181 (62.929 ac), 06213000182 (36.848 ac), 06202000040 (2.424 ac): The Wayne Township “2030 Comprehensive Plan” calls for a road expansion to connect CookJones Rd. with Wilson Rd. With such an expansion, the need for new residential development to help defray the costs associated with such projects is evident. The expansion is identified as most opportune through the middle of this farm. For this reason, further feasibility studies will need to be done before the application of this farm can be reconsidered for support]. RESOLUTION 2015-15 A RESOLUTION TO ADDRESS CONCERNS FOR AUTHORIZING PARTICIPATION IN THE OHIO LOCAL AGRICULTURAL EASEMENT PURCHASE PROGRAM ON A FARM OWNED BY DWIGHT MICHENER Mr. Edwards presented for consideration and Mr. Coffman moved for adoption of said resolution. [Regarding Wayne Township’s withholding of support of the participation of the following farm in the ODA’s LAEPP Agricultural Easement Program: 4980 Old Route 73, Warren County Parcel ID# 05072000080, containing 101.07 acres, owned by Dwight Michener was deemed not compatible with the township’s development plans as laid out by the “2030 Comprehensive Plan”. Additionally, this property partially lies within the “Urban Service Boundary” of the Land Use Plan and connects to the Village of Waynesville’s corporation limits. The property is poised for the expansion of suburban development with the Village of Waynesville’s Adamsmoor Dr. stubbing into this parcel. On the north side of the property a Wayne Township’s subdivision, the Reserve of Waynesville, has a street (Cierra Way) that stubs into this parcel. This parcel is also shown as being in the suburban residential zone and has access to water, sewer and natural gas]. The motion was seconded by Mr. Davidson. Upon call of the roll thereon, the vote resulted as follows: Mr. Foley – yea, Mr. Davidson – yea, Mr. Coffman – yea. No actions were taken. PUBLIC HEARING: ZONING MAP AMENDMENT (5970 MIDDLETOWN RD. FROM RECREATIONAL TO RURAL RESIDENTIAL) At 8:00 p.m., Mr. Coffman made a motion to open the public hearing to consider an amendment to the Wayne Township Zoning Map. Mr. Foley seconded the motion and all were in favor. Ms. Hartsock, told the purpose of the public hearing. The applicants, Ronald and Mary Frommling entered into land contract with The Richard R. Shaw Trust, Richard Shaw, Trustee to purchase 22.935 acres contingent on the successful residential rezoning of the property. Ms. Hartsock continued to share the letter of support provided by the WCRPC and the resolution of support provided by the Wayne Township Zoning Commission. Ms. Frommling gave a brief presentation outlining the acquisition of the property and their wishes to reside in the current home under residential zoning. Ms. Gail Rash of 5317 O’Neall Rd. stated her support of the applicants. Mr. Gary Breeze of 5260 O’Neall Rd. stated his support of the applicants. Mr. Andrew Jacobs inquired if the applicants intended on retaining the property’s agricultural status. Ms. Frommling replied that they had no such plans. Mr. Coffman stated that the determination made tonight would be effective in thirty (30) days or May 7 th unless a referendum of petition were received within the 30 days. Having no further questions or need of discussion, Mr. Coffman made a motion to close the public hearing. Mr. Foley seconded the motion and all were in favor.
