Ivica Crnić, president SOME ISSUES CONCERNING COMPENSATION OF IMMATERIAL DAMAGE Compensation of immaterial is one of the institutes often occurring in practice. In this paper the author presents certain issues, which he considers of special interest for the practice based on the frequency of the cases concerning the matter. Initially, the author refers to the regulations defining the concept of immaterial damages, elaborates when such damage is legally recognized and when not and writes about dilemmas with respect to the existing legal terminology. In the second part of the paper the author deals with various forms of immaterial damage (physical pains, various forms of mental sufferings, disfigurements and fear). With that respect, the author especially refers to the circumstances to be considered when a fair financial compensation is awarded, since the amount of the compensation, and consequently the fair compensation of the injured person, depends on such circumstances.
