BENTLEYVILLE BOROUGH MINUTES
CONTINUED REGULAR MEETING
Tuesday, December 16, 2014
7:00 pm at the Bentleyville Municipal Complex
The continued meeting of December 2, 2014 was reconvened at 7:00 pm on December 16 th, 2014 by
a call to order and pledge of allegiance led by Council President Stan Glowaski. Roll was called with
councilors Roy Larimer, Gary Damich, Bill Jobes, Stanley Glowaski, Robert Paul, Shannon Watson
and Tim Jansante being present. Also present were Mayor Thomas Brown, Solicitor Dennis Makel,
Secretary Kim Sacco and Code Enforcement Officer Kerry Krider.
It was moved by Tim Jansante and seconded by Roy Larimer to approve the minutes of Regular
meeting on December 2, 2014. All were in favor.
It was moved by Bob Paul and seconded by Bill Jobes to begin testimony in the condemnation
hearing for 117 Main Street per the request of John Solomon, owner, who arrived in council
chambers at 7:10pm.
The complete transcript of the hearing will be provided by the stenographer.
There was a motion by Bill Jobes, seconded by Gary Damich to go into executive session at 8:03pm
All in were in favor.
After executive session Bob Paul moved to close testimony, Mr. Jobes seconded the motion and all
were in favor.
Mr. Solomon was informed that council would present findings of fact at their next regular meeting.
New Business:
Council President Stan Glowaski, on behalf of Ave Maria Church requested that council consider
vacation the portion of Abromitis Street that is wholly contained in the parcels of property owned by
Ave Maria Church. Kerry Krider addressed council with zoning concerns that Ave Maria applied for
variances regarding setbacks. If the street is vacated the church would not need to get the
variances. Mr. Glowaski thought that the borough could save money by not having to maintain it. An
ordinance would need to be passed to vacate…the ordinance would need to have a provision that
any existing utilities would continue to exist in that easement. Bob Paul asked about how many feet
are needed for the setbacks, Bob thought that setbacks should be grandfathered in. Kerry told him
that new construction cannot be grandfathered in. The Zoning board recommended vacating
Abromatis. Bob thinks that it would be easier to grant the variance, he was not in favor of vacating
the road. It was moved by Gary Damich to vacate Abromatis Street. The motion was seconded by
Stan Glowaski. Shannon Watson questioned whether the vacation was a way to get around the
current regulations. The vote was called Roy Larimer - abstain, Bill - yes, Gary - yes, Bob - no,
Shannon - no, Tim - No. Roy changed his vote from and abstention to a no. The motion didn’t
pass.
It was moved by Bill Jobes, seconded by Shannon Watson to reappointment Dennis Makel as
Solicitor for 2015. All were in favor.
It was moved by Roy Larimer and seconded by Bill Jobes to reappointment of Widmer Engineers at
existing rate for 2015. All were in favor.

Fort Cherry Ambulance tendered a 90 day written notice for withdrawal of services. Council will
meet with Ron Sicchitano Jr on December 22nd at 6:30pm for a work session discussing how the
borough can proceed to procure ALS services for the Borough once Fort Cherry is gone.
Part time police position, 6 resumes were received. Police committee will review theM at 6pm
worksession on December 22nd, 2015.
It was moved by Bob Paul and seconded by Bill Jobes to adjourn the reconvened meeting. All were
in favor.
