Lockwood South, is located in the tourist area of the central goldfields of Victoria,
and should therefore be granted a liquor licence.

14 2006 MELBOURNE COMMONWEALTH GAMES — The Order of the Day was read
for the resumption of the debate on the question, That this House congratulates all
those involved in making the 2006 Melbourne Commonwealth Games the most
successful Commonwealth Games ever held and a credit to all the people of
Victoria, and specifically congratulates:
(1) the Games Volunteers whose dedication ensured the smooth running of all
events and who put a charming and helpful face on Victoria;
(2) the hard working staff from organisations including the Organising Committee,
M2006, the Office of Commonwealth Games Co-ordination within the
Department for Victorian Communities, Victoria Police and Transport Operators
who were the backbone of the Games;
(3) the 4,500 Athletes from across the Commonwealth, who brought so much
entertainment and joy through their courageous and inspiring efforts;
(4) all those involved in the Commonwealth Games Cultural Program, Festival
Melbourne 2006, who provided another element to the Games, making it a truly
unique Festival; and
(5) all the people of Victoria, who through their unparalleled support and
enthusiasm, once again showed to the world that Melbourne is simply the Best.

DRUGS, POISONS AND CONTROLLED SUBSTANCES (AGED CARE SERVICES)
BILL — The President announced the receipt of a Message from the Assembly
presenting a Bill to amend the Drugs, Poisons and Controlled Substances Act 1981
to provide for the administration of drugs of dependence, Schedule 9 poisons,
Schedule 8 poisons and Schedule 4 poisons to certain residents in aged care
services, to amend the Nurses Act 1993 to create an offence of directing or inciting
unprofessional conduct and for other purposes and desiring the agreement of the
Council.
On the motion of Mr Gavin Jennings, the Bill was read a first time and ordered to be
printed and to be read a second time on the next day of meeting.

JUSTICE LEGISLATION (MISCELLANEOUS AMENDMENTS) BILL — The
President announced the receipt of a Message from the Assembly acquainting the
Council that they have agreed to the amendments made in this Bill by the Council.
PETITIONS —
FLUORIDATION OF VICTORIAN WATER SUPPLIES (CENTRAL HIGHLANDS) —
Ms Dianne Hadden presented a Petition bearing 298 signatures from certain citizens
of Victoria praying that the Legislative Council of Victoria does not support the
addition of fluoride to any Victorian water supply, including water in the Central
Highlands and Grampians Wimmera Mallee Water Authority regions, in view of
current scientific doubts regarding its safety.

HAILEYBURY COLLEGE ACCESS — Mr Noel Pullen presented a Petition bearing
257 signatures from certain citizens of Victoria requesting the closure of all
residential street access to Haileybury College within the residential zoned

entrance on South Road.

HATTAH-NOWINGI TOXIC WASTE FACILITY — The Honourable David Davis
moved, That this House condemns the Government’s plan to site a toxic waste
dump at Hattah-Nowingi in the Sunraysia district and particularly expresses its
concern that the Government’s plan will allow —
(1) the siting of the toxic waste dump between Hattah Lakes National Park and
Murray Sunset National Park and near the Ramsar listed Hattah Lakes;
(2) development of a toxic waste dump near the Sunraysia food-bowl with its rich
agricultural, horticultural and viticultural industries, thereby placing them at risk;
(3) a potentially devastating impact on the Murray River, Australia’s largest river,
which is located just 15 km away from the proposed toxic waste dump site;
(4) the exposure of communities along the ‘Calder corridor’ and alternative routes
to the danger inherent in transporting loads of toxic waste over 500 km from
Melbourne to Hattah-Nowingi; and
(5) the development of this toxic waste dump without satisfactory investigation of
alternatives including programs to reduce the quantities of industrial waste;

and calls on the Government to abandon its flawed environmental effects process
and indicate to the Victorian community that the planned toxic waste dump at
Hattah-Nowingi will not proceed.

10 DRUGS, POISONS AND CONTROLLED SUBSTANCES (PROHIBITION OF
DISPLAY AND SALE OF COCAINE KITS) BILL — The President announced the
receipt of a Message from the Assembly presenting a Bill to amend the Drugs,
Poisons and Controlled Substances Act 1981 to provide for a prohibition on the
display and sale of cocaine kits and to amend that Act to further provide for offences
committed by bodies corporate and for other purposes and desiring the agreement
of the Council.

the Sustainable Forests (Timber) Act 2004 to provide that transfer of certain licences
to management by VicForests does not occur, to consequentially amend the
National Parks (Otways and Other Amendments) Act 2005 and for other purposes
and desiring the agreement of the Council.

PETITION — PROTECTION OF PUBLIC EDUCATION AND TRAINING — Ms
Glenyys Romanes presented a Petition bearing 63 signatures from certain citizens of
Victoria requesting that any new legislation dealing with the State Public Education
and Training System — (1) be separate and distinct from any legislation dealing with
private schools; (2) defines public education as free, secular and universal; public in
purpose, outcome, ownership and accountability; and accessible to all children; (3)
gives primacy to public education in all areas; and (4) includes proper, transparent,
publicly accessible accountability measures for expenditure of all taxpayers’ money.

15 VALUATION OF LAND (AMENDMENT) BILL — The President announced the
receipt of a Message from the Assembly presenting a Bill to amend the Valuation of
Land Act 1960, the Victorian Civil and Administrative Tribunal Act 1998 and the
County Court Act 1958 and for other purposes and desiring the agreement of the
Council.
On the motion of the Honourable Justin Madden, the Bill was read a first time and
ordered to be printed and to be read a second time on the next day of meeting.
16 ROAD SAFETY (DRUGS) BILL — The President announced the receipt of a
Message from the Assembly presenting a Bill to amend the Road Safety Act 1986 to
include "ecstasy" in the random drug testing program for drivers, to amend the Road
Safety (Drug Driving) Act 2003 to remove the sunset on that program and for other
purposes and desiring the agreement of the Council.
On the motion of Ms Candy Broad, the Bill was read a first time and ordered to be
printed and to be read a second time on the next day of meeting.
17 ADJOURNMENT — Mr John Lenders moved, That the House do now adjourn.
