The Hiawatha City Council met in special session in the Hiawatha Council Chambers on November 24, 2014. Mayor Tom
Theis called the meeting to order at 3:00 P.M. Council members present: Marty Bruns, Bob Wheeler, Dennis Norton, Bob
Rampulla, and Dick Olson. Staff present: City Administrator, Kim Downs; Finance Director, Cindy Kudrna; and City
Attorney, Mark Parmenter. Guests: Mike Adams from JCG Land Services.
Bob Rampulla moved the approval of the agenda, second by Bob Wheeler. Motion carried.
Authorizing participation in the Municipalities Continuing Disclosure Cooperative Initiative
Finance Director Kudrna explained the Securities Exchange Commission (SEC) is asking cities to look at their Continuing
Disclosure Statement; this statement gets sent to the state and has to be sent within 210 days. The City’s report to the SEC
has to be completed by December 1, 2014. Kudrna asked Maggie Burger of Speer Financial to review the City’s bond
issuances to determine how many were filed beyond the 210 day requirement. By completing this process the City is selfreporting possible misstatements or omissions made in offering documents relating to municipal securities in the past five
(5) years. This is not the City’s fault and Hiawatha is not the only city required to complete this report. There is no penalty
associated with this process.
Rampulla presented RESOLUTION #14-242 authorizing participation in the Municipalities Continuing Disclosure
Cooperative Initiative of the Securities and Exchange Commission, seconded by Olson. Roll call vote: AYES: Wheeler,
Olson, Norton, Rampulla, Bruns. NAYS: None. RESOLUTION #14-242 adopted.
Possible Closed Session as per Iowa Code 21.5(j) to discuss the possible purchase of particular real estate
Rampulla moved to go into closed session as per Iowa Code 21.5(j) to discuss the possible purchase of particular real
estate at 3:04 P.M., seconded by Wheeler. Roll call vote: AYES: Olson, Norton, Rampulla, Bruns, Wheeler. NAYS:
None. Motion carried.
Wheeler moved to go out of closed session and enter into regular session at 3:09 P.M., seconded by Norton. Roll call vote:
AYES: Bruns, Olson, Norton, Wheeler, Rampulla. NAYS: None. Motion carried.
Discussion/Possible Action regarding condemnation of particular real estate to acquire necessary property in
connection with the Emmons Street/North Center Point Road/Robins Road Intersection Improvement Project
Wheeler presented RESOLUTION #14-243 authorizing the City Attorney to proceed with condemnation proceedings for
the property located at 89 N Center Point Road in connection with the Emmons Street/North Center Point Road/Robins
Road Intersection Improvement Project, seconded by Olson. Roll call vote: AYES: Norton, Bruns, Rampulla, Olson,
Wheeler. NAYS: None. RESOLUTION #14-243 adopted.
Discussion/Possible Action regarding possible purchase of particular real estate in connection with the Emmons
Street/North Center Point Road/Robins Road Intersection Improvement Project
Bruns presented RESOLUTION #14-244 authorizing the purchase of the property located at 85 N Center Point Road and
directing the Mayor to execute the Total Purchase Agreement with a total purchase price of $522, 250.00 and pay for
other related fees using Capital Projects Funds and Tax Increment Financing Capital Projects Funds, upon the completion
of closing documents and review of the abstract by the City Attorney, seconded by Norton. Roll call vote: AYES:
Rampulla, Olson, Wheeler, Bruns, Norton. NAYS: None. RESOLUTION #14-244 adopted.
Other Discussion
Mayor Theis asked council if they wanted to schedule another Capital Improvement Plan (CIP) work session date. Bruns
said he was dead set against the plan so there is no need for another work session. Norton talked about having two lists,
one is a wish list showing all the projects staff wants to complete and one list showing the projects that are actually being
completed. Olson said he did not have any burning issues with the CIP because the City would have to bond in order to
complete all the wish list items and we are not going to bond that high.
