The above puppy is sold for the total price of $_____________. A deposit of $250.00 is
required to reserve a puppy.
SPAY/NEUTER AGREEMENT: This puppy is sold with this written spay or neuter
agreement stating that you agree to have the puppy spayed or neutered at or
before 6 months of age. Breeding this dog without our written permission nullifies
this guarantee and contract. A certificate of spay or neuter must be provided to us
by the time the puppy is 7 months of age or this 24 month extended health
guarantee is void.
2 YEAR GENETIC HEALTH GUARANTEE: Every effort has been made to produce dogs in
good health and temperament. The Breeder guarantees the dog up to the age of 24
months against the disabling effects of the following genetic defects:
Hip dysplasia- If a concern regarding serious life-altering hip dysplasia that significantly
compromises the dog’s life as a companion dog arises; the Buyer must provide the
Breeder with documentation (test results) from PennHip stating that there is
radiographic evidence of DJD or documentation (test results) from OFA, stating
that there is radiographic evidence of dysplastic changes to the hip joints. X-ray
results from an accredited specialist and the diagnosis from your veterinarian and
OFA or PennHip testing must be done on the puppy on or before the puppy
reaches 24 months of age. The puppy must be sedated for the radiographic
testing.
Congenital eye disease- the buyer must supply to the breeder, documentation showing a
congenital disease of the eye, which could cause blindness in one or both eyes
and/or requiring surgery or ongoing medication, as diagnosed by a Veterinary
Ophthalmologist on or before the dog reaches 24 months of age.
Congenital cardiac disease- the buyer must supply to the breeder, documentation and test
results showing that the dog has congenital cardiac disease that severely
compromises the dog’s life as a companion dog, unrelated to parasitic heart
damage form a Veterinarian with training specific to canine heart disease or a
Veterinary Cardiologist on or before 2 years of age.
If the puppy should die from a suspected congenital defect within 24 months of age, a
necropsy must be performed at the Buyers expense, by a state licensed
Veterinarian. If the necropsy determines that a congenital defect is the cause of
death, we will provide another puppy of equal value to or refund the purchase price
of the puppy to, the Buyer. In the unfortunate event that the dog develops any of
the aforementioned defects, and upon written diagnosis by a Veterinarian, and
reports from the appropriate specialist of which our Veterinarian concurs with, the
Buyer shall be entitled to a replacement puppy from another litter as soon as one
becomes available. Selection of the puppy will be made by the breeder. If the Buyer
chooses a replacement puppy, the original puppy need not be returned to the
breeder. The original puppy must be spayed or neutered at the buyers expense and
the certificate must be sent to us prior to receiving a replacement puppy. The
following conditions apply:
Expenses pertaining to testing and exams to confirm a diagnosis are the responsibility of
the Buyer unless they pertain to Article 35-D of the general business law in NYS,
The Sale of Dogs and Cats. The Breeder does not assume any responsibility for
injury to the dog or expenses for the puppy once it is in your possession.
The Breeder has the right to have the dog and/or the dog’s records examined by a
veterinarian of their choice, to confirm a diagnosis, at the Breeder’s expense. All
other veterinary and transportation expenses are the Buyers obligation. The hip
dysplasia guarantee shall be null and void if the dog is determined to have
suffered injury or neglect, has been 20% or more overweight, or has been exposed
to intense exercise before the age of 18 months. Puppies have a muscular/skeletal
system that is growing until 18-24 months. Exercise must not be excessive during
that time due to the growth of their muscles, bones, growth plates, etc. In cases
where this is participated in, this contract has been breached.
OUR HEALTH GUARANTEE: Breeder will abide by the laws of the state of New York (Puppy
Lemon Law) Article 35-D of the general business laws relating to Sale of Dogs and
Cats from the State of New York of New York Department of Agriculture and
Markets. We highly recommend that you take your new puppy to see your
veterinarian within the first 3 to 5 days from the date of purchase. Your vet needs
to see the puppy in the condition that it was in when you first received it because
some conditions can develop due to the stress of the move and it is very important
for your vet to have a good “initial baseline” on your puppy's health. The NYS law
does of course supersede our desire for you to take it sooner - but it would be in
the puppy’s best interest for you to do so.
Breeder guarantees that the dog is healthy at the time of sale and has received all
appropriate shots and wormings. The Breeder will supply a health record showing
the vaccinations and wormings that the dog has received while under the
Breeder's care. If the Buyer decides not to keep the puppy, for any other reason,
unrelated to a serious, life altering illness in the puppy , the Buyer will forfeit any
money paid for the puppy. Once the puppies are born and your choice of gender is
confirmed, your deposit is non-refundable for any reason at any other time. The
Breeder is not responsible for any expenses or Veterinary charges once the puppy
is in your possession unless they pertain to Article 35-D of the General Business
Law in NYS, The Sale of Dogs and Cats Notice. This health guarantee is granted to
the original Buyer only and is not transferable to anyone else.
The buyer promises to keep the dog in good condition, provide yearly examinations,
vaccinations, worming and any other usual procedures necessary to assure
further good health of the dog. If the buyer cannot keep the puppy, the Breeder will
aid in the puppy's placement into another home. Buyer agrees to send us a photo
of the puppy at one year of age. Photos may be used for advertising purposes.
Buyer hereby releases the Breeder and their estate form any and all liabilities, and/or
damages by fault of this dog after the time of sale. These damages include, but are
not limited to, destruction of property and /or physical damage to any person or
group of people.
