MINUTES NEWBURY MUNICIPAL COUNCIL Monday. August 12th, 2013 6:00 p.m. MEMBERS PRESENT: Reeve Diane Brewer, Councillors, Amos Fennell, Kelly Moore, Chris Degraw and Marie Falk MEMBERS ABSENT: OTHERS PRESENT: STAFF PRESENT: Betty D. Gordon, Clerk-Treasurer STAFF ABSENT: CALL TO ORDER Reeve Diane Brewer called the meeting to order at 6:00 p.m. 1. DECLARATION OF PECUNIARY INTEREST: Kelly Moore declared a pecuniary interest in the matter regarding 29 York St. listed under Sewer. 2. DELEGATIONS: (a) 6:00 p.m. Water/Sewer/Drainage WATER: SWM and Newbury water agreement. No further correspondence at this time. Tri-County Management Committee – revised agreement. Cost for anti-tampering hydrant device $195 per unit - $180 if we purchase 36. Council decided not to order any devices at this time but would keep the pricing information for future reference. Water and Sewer connection forms. Water meter repair and exchange update. Kelly had directed a resident to repair his meter wire but to date it has not been done. Kelly will speak with him again. A complaint from a resident who claims he had no water when the hydro was out on August 2nd. Kelly advised Council that there is no connection with a resident having no water when the hydro is out. DRAINAGE: Council asked that Jake take a look at the Government 5/6 Drain to see if the drains are plugged. His time sheet indicates that he did not look at the drain. Amos said he would take a look at the drains. (b) 7:00 p.m. - - 3. Fire Chief Chad Trethewey and Deputy Fire Chief Mark Nowicki were absent. July’s training records. Ralph will provide the records. Surplus equipment list. Not completed. Draft Fire burning by-law. Not finalized yet. County Fire Dispatch Agreement. Council will advise the County they agree. Roster list. Chad has not finalized the list yet. Bunker gear inventory list with expiry dates. The list is half done. Air bottle inventory list with expiry dates. Not done yet. Sale of old fire truck. Council suggested Sunrise Auction. Internet at firehall – is it being used. No Chad needs to have someone look at it. Fire alarm sheets and hydrant use sheets. Chad will fax them over. Clarification on ownership of brush pile at the back of the park – it is in the park or owned by Newbury resident? Council and Chief believe it belongs to a resident. Chad will speak with him about the pile. Also with the Legion who have a similar pile. Fire burning complaint dated July 23rd, 2013. COUNCIL MINUTES: Council minutes of the regular Council meeting held on July 8th, 2013 and the Special Meeting held on June 26th. BUSINESS ARISING FROM THE MINUTES: 1. A letter was sent to King Hydroseeding Inc. regarding one of their drivers hooking onto a Newbury hydrant on O’Mara St. No response to date. 2. A discussion regarding employee WSIB was missed being discussed on the July agenda. August 12th, 2013 3. 5. Newbury Municipal Council 3 A letter was sent to the owner on Broadway St. regarding the condition of the trees and the comments from an Entegrus employee. CORRESPONDENCE: INFORMATION ITEMS 6. 1. Middlesex-London Health Unit splash pad inspection report – no action required. (previously cc. Council) 2. Municipal World magazine – August 2013. 3. Ministry of Rural Affairs letter that provides an update regarding the 2013 Ontario Budget commitment to provide $100 million to help small, rural and northern municipalities address roads, bridges and other critical infrastructure. 4. Middlesex Plowmen’s Association inviting Council to its 73rd Annual Middlesex County Plowing Match to be held on Monday, September 2nd, 2013 on the farm of Rein Minnema, Hwy 80, Glencoe. 5. Copy of a letter that was addressed to Mayor Bernie Wiehle from the Ministry of Transportation for the government’s commitment to support transit and that West Eglin (being the host for the joint service) is eligible to receive an allocation of $30,048 for the year. 6. Email from the Ministry of Natural Resources advising that they will begin its annual wildlife rabies control operations for 2013 on August 18th. 7. Thank you card from Beattie Have/Quad County for Newbury’s support for its annual golf tournament. ACTION REQUIRED ITEMS: No items for this agenda. 7. (a) NEW & UNFINISHED BUSINESS: 1. 2013 Christmas meal and gathering. Council agreed to the same location as last year either on Nov. 29th or Dec. 6th. 2. 2013 – 2014 snow removal contract. Council directed the Clerk to contact AXcavating to see if their prices are changing from last year. August 12th, 2013 Newbury Municipal Council 4 3. Garbage issue at the park. The Clerk could not confirm whether or not the new system that was put in place 2 weeks ago was helping with the issue. Council suggested the Clerk get prices on bins with lids for the park. 4. The Legion has advised the Park and Youth Committee that they cannot hold any more dances at the legion due to the vandalism that has occurred in the past. The Committee was going to meet with the Legion to see if they could resolve the situation. 5. Clarification on the high school graduation award. (cc. Council) Council discussed the Glencoe District High School Commencement Award and agreed that the award should go to the student with the highest average that he or she received after graduating from a full year of schooling. 9. (b) OTHER BUSINESS: 1. Each Council member was given the opportunity to bring new business to the table. Marie asked if anyone knew when Mike Winia Jr. was going to provide the trees for the park and carve the tree stump. The Clerk will call him again. Kelly asked if another flyer could go reminding residents of what they can (have to) and cannot recycle. Amos said that a tree located on the property at 22928 Hagerty Road should be inspected by Jim Coutts, Newbury’s Property Standards Officer. The neighbour has concerns about the tree’s condition. A Newbury resident submitted a drawing wherein they were asking direction on whether or not they could plant flowers around hydrants and landscape around a municipal drain. Council advised that they are pleased when residents take pride in their properties and landscape however they would prefer that they not landscape around the fire hydrant because the plants could get damaged when the hydrant is being used. Council also advised that they cannot landscape on the Village road allowance. Council also commented that the drain in their yard is a municipal drain that needs to be accessible and that they could not interfere with the drain and that they would not be allowed to put a bridge over the drain unless it was done through a drainage report. 2. GORDON August 12th, 2013 Newbury Municipal Council 6 IN camera notes re: Charlie Colhoun hooking up to sewer, requesting a building permit and the properties use agreement: The clerk advised Council that she had spoken with Wayne Meagher, County Lawyer, about Charlie, the building permit and the agreement. Wayne advised me that if he is requesting a building permit that would not qualify being discussed in an in camera meeting and that the CBO should know if a permit could be given if the building issue is allowed for the zoning on the property. As far as the agreement – Wayne is still working on that and will have something soon. As far as Charlie hooking onto to the sewer without the proper papers etc. Wayne asked if it had been inspected and if whoever inspected the connection was satisfied with the workmanship and if the inspector was satisfied then Council could decide if they still wanted to fine him so he would know that he has done wrong and would deter him in the future for any future work done without prior approval (if required). Wayne also said that you could fine him for all the admin time put in towards this issue. Council decided that he was to be billed $50 for the permit and that the appropriate forms be given to Charlie who must complete them fully within 14 days and if he does not return them within 14 days then he could be charged the $5000 fine.
