Minutes of Proceedings at the Full Council Meeting held in the Council
Chamber, County Hall, Friday 25th July, 2014.
PRESENT:

1. To consider the Chief Executive’s Report, prepared in accordance with Section 12
(4) of the Planning and Development Act 2000 ( as amended) on submissions
received in respect of the Draft County Development Plan, and Chief Executive’s
Supplementary Reports and to consider Motions thereon ( as listed hereunder)
proposing amendments to the Draft Plan in accordance with Section 12 (6) of the
Planning and development Act 2000 (as amended) and to determine the proposed
amendments to the County Development Plan.
Draft Supplementary Proposed Change No. 3.2 was agreed .
Draft Supplementary Proposed Change No. 3.6 was agreed.
Draft Supplementary Proposed Change No. 4.3 was agreed.
Proposed Change No. 9.11 was agreed.
Proposed Change No. 10.13 was agreed.

Proposed Change No 12.25 was agreed.
Proposed Change No. 12.26 was agreed.
Proposed Change No. 12.27 was agreed.
Cllr K. Murphy proposed to change the wording in relation to the review of the
development contribution scheme from “intend to” to “it will”. The Chief Executive
said that it will be recorded in the Minutes that the Development Contribution Scheme
will be reviewed at SPC level.
This proposal was agreed.
Cllr D. O’Donnabhain made reference to Chapter 10 and requested the insertion of
“terms of reference of review will go to the Municipal District Committee in the next
couple of months”.
It was agreed to leave the wording as it is but that the issue would be recorded in the
Minutes of the meeting.
Cllr S. McGrath referred to Chapter 10 on page 171 of the draft Plan, TM52; he is not
satisfied with the wording here. He suggested to include the following text in
paragraph (c):
“having regard for the need for a significant improvement to the road network” and
“taking account of residential, amenity, tourism and recreational activities”
This proposal was agreed.
Cllr D’Alton raised her concern about the redevelopment of Cork Harbour and in
particular the Natura Impact Report obligations by the Council. She asks that the
assets of the Harbour would be respected and that the Council would support both
residents and the developer.
Cllr D’Alton suggested 4 text additions
1. Protecting the environmental resources of Cork Harbour; additional paragraph to be
included in Chapter 10;
2. text included in CS41, Chapter 3
3. her proposals for generating electricity in section 9.3.16
4. E.A. capacity of Cork Harbour
The Senior Planner responded by saying:
1. Protecting the environmental resources Cork Harbour; Proposed Change No. 2.5 on
page 29 of the Members Amendments documents dated 30/6/14 deals with this issue.
2. Proposed Change 2.4 on pages 27 to 29 deals with this issue
3. ED37 on page 144 of the draft Plan flags the issue of the need to protect natura
sites; Cork County Council are of the opinion that the law allows a Local Authority to
deal with the issue in this manner.

Cllr D’Alton said that the natura report mentioned is in general; her specific request is
with regard to Cork Harbour. The Senior Planner said that there is more than one
strategic employment area in Cork Harbour; Cork County Council are of the view that
no change is necessary.
Cllr Cullinane is in agreement with Cllr D’Alton; can text be inserted that will be in
line with legislation.
The Chief Executive said that 3.7 adequately reflects the Natura Impact Report.
The Senior Planner said that 4.8.12 on page 73 of the draft Plan gives an overall
approach to coastal zone management and makes reference to the Harbour Study.
Cllr D’Alton agrees that it is well described but that it should be included that the
Cork Harbour Study will be concluded. The Senior Planner said that it is not a
statutory requirement to put in a time scale.
Members were in agreement that a compromise should be reached.
The Executive suggested to forward the Harbour Study to Development Committee
and then to SPC level.
Cllr D’Alton said that it still won’t be mentioned in the CDP and she suggested could
“including Cork Harbour” it be inserted at the end of paragraph (a) in RC1 8.2 on
page 74 of the draft Plan.
It was agreed that a vote should be taken at this point.

Ryan, Michael Hegarty, O’Keeffe, O’Flynn, Doyle, G.Murphy, Mary Hegarty.
Motion carried.
It was agreed that “including Cork Harbour” would be inserted at the end of
paragraph (a) in RC1 8.2 on page 74 of the draft Plan.
Statutory Resolutions:
1. To consider the Chief Executive’s Report, prepared in accordance with Section 12
(4) of the Planning and Development Act 2000 ( as amended) on submissions
received in respect of the Draft County Development Plan, and Chief Executive’s
Supplementary Reports and to consider Motions thereon ( as listed hereunder)
proposing amendments to the Draft Plan in accordance with Section 12 (6) of the
Planning and development Act 2000 (as amended) and to determine the proposed
amendments to the County Development Plan.

2. To publish statutory notices under Section 20 (i) of the Planning & development
Act, 2000, in relation to Amendments to the Council’s 10 no Electoral Area Local
Area Plans 2011 proposing changes to the Residential Zoning Objectives to give
effect to the proposed changes to the Housing Density Objectives in the Cork County
Development Plan 2015.
