Summary of changes within latest variation of the Public Sector Mapping
Agreement
PSMA Framework Agreement:
- replaced references from Department for Communities and Local
Government (CLG) to Department for Business, Innovation and Skills (BIS),
to reflect transfer of agreement to BIS
- defined Consumer Price Index (CPI), replaced references to RPIX to CPI, and
made a consequential amendment to Schedule 3
- tightened up the definition of Excluded Bodies, to reflect discussions between
BIS and Ordnance Survey over a number of months
- amended name of GI Group to GI Customer Group, and added reference (in
Schedule 5) to the Group’s specific responsibilities
- added new clause 11.5 to provide that Ordnance Survey will consult with BIS
prior to suspending or terminating a Local Authority’s Member Licence, where
the Local Authority is in breach of its obligations under the Data Co-operation
Agreement with GeoPlace
- amended publication frequency and months of publication of 1:25k and 1:50k
products, amended months of publication of OS VectorMap Local, [and
amended formats of a number of OpenData datasets,] each to bring the
contract up to date with current practice (Schedule 1)
- updated footnote 1 to part 1 of Schedule 1, to state the actual date on which
legacy addressing products will be withdrawn i.e. 31st October 2014
- added reference to OS Terrain 50 as a new OpenData dataset (Schedule 1)
- revised KPI regarding Website availability (in Schedule 1) to allow for more
maintenance time during evening hours in the working week
- amended the OS OpenData Licence (in Schedule 2, Part A) to bring it up-todate with the latest version
- amended clause 11 of the Standard Form Contractor Licence (Schedule 9),
relating to indemnities, further to feedback from a number of Members and
Contractors
- replaced the previous version of the Public Sector End User Licence
(Schedule 10) with revised, simplified version
PSMA Member Licence
- replaced references from Department for Communities and Local
Government (CLG) to Department for Business, Innovation and Skills (BIS),
to reflect transfer of agreement to BIS
- amended various End User related definitions and provisions, in
consequence of the revised End User Licensing position, referred to below
- tightened up the definition of Excluded Bodies
- amended definition of Topographic Dataset to include reference to two new
products, and to delete reference to a withdrawn product
- amended references to “LLP Local Authority Data Supply Agreement” to
“Data Co-operation Agreement” (see clause 4.4.1), to reflect the correct name
- amended clause 4.4.3 to reflect intended amendment to GeoPlace’s Data Cooperation Agreement with Local Authorities
- clarified the records to be retained by Members (clause 7.2); this clarificatory
amendment was made in the context of the End User Licensing changes
- amended the definition of Competing Activity (in paragraph 2 of Appendix 1)
to make limbs a) and b) consistent with limb c)
- new definition (in paragraph 2 of Appendix 1) of WFS, in light of the new
INSPIRE End User Licensing provisions, referred to below
- removed prohibition on use of Licensed Data within a WMS in the context of
public viewing rights (see paragraph 4.2.8 of Appendix 1)

expanded Data Sharing rights to encompass Educational Bodies (paragraph
5 of Appendix 1, and related definitions in paragraph 2)
amendment of standard Public Sector End User Licensing provisions, to
reflect simplified Public Sector End User Licence referred to above
(paragraph 7 of Appendix 1)
consolidated provisions relating to INSPIRE End User Licensing and
INSPIRE WMS End User Licensing (the latter previously under paragraph 11
of Appendix 1) into one paragraph (paragraph 8), and introduced a revised
INSPIRE End User Licence to cover all INSPIRE licensing (save for licensing
to EU institutions). This follows feedback from the PSMA community.
new INSPIRE Relevant Body licensing provisions (new paragraph 11 of
Appendix 1) to allow for the licensing of data by PSMA Members to EU
institutions
updated paragraph 12.2.1 b) to include reference to OS VectorMap Local
clarified rights of public libraries (see paragraph 14 of Appendix 1)
amendments to Appendix 2 to reflect withdrawal of legacy addressing
products and expanded data sharing rights, both as referred to above
revised Multiple Residence fees in Part C of Appendix 3, and further minor
amendments to Royal Mail terms to reflect revised terms
