DECREE
of 20 April 2004,
laying down the requirements for fuels for operation of on-road vehicles and the manner of fuel quality
supervision and monitoring
The Ministry of Industry and Trade in accordance with Section 91 (2) of Act No. 56/2001 Coll.
on conditions of operation of on-road vehicles and amending Act No. 168/1999 Coll., Coll. , on compulsory
motor vehicle liability insurance and amending some related Acts (Motor Vehicle Liability Insurance
Act), as amended by Act No. 307/1999 Coll. , (hereinafter the "Act"), stipulates the following provisions
to implement Section 77 (2) to (5) of the Act:
Section 1
Scope of regulation
This Decree in accordance with the law of the European Communities 1) lays down the requirements
for the quality of fuels for operation of on-road vehicles and the manner of fuel quality supervision
and monitoring.
Section 2
Definitions
For the purposes of this Decree:
a) motor petrol means
1. mineral oils intended for the operation of internal combustion positive-ignition engines for the
propulsion of vehicles and falling within CN codes 2) 2710 11 41, 2710 11 45 and 2710 11 49,
2. mineral oils with a content of bio-ethyl-alcohol (bioethanol) up to a maximum of 5 volume per cent
intended for the operation of internal combustion positive-ignition engines for the propulsion of
vehicles and falling within CN codes 2) 2710 11 41, 2710 11 45 and 2710 11 49,
3. mineral oils with a content of bio-ethyl-tert-butyl-ether up to a maximum of 15 volume per cent
intended for the operation of internal combustion positive-ignition engines for the propulsion of
vehicles and falling within CN codes 2) 2710 11 41, 2710 11 45 and 2710 11 49,
4.
mineral
oils
containing
at
the
same
time
bioethyl-alcohol
(bioethanol)
and
bio-ethyl-tert-butyl-ether, in such a manner that the overall oxygen content does not exceed 2.7 weight
per cent, intended for the operation of internal combustion positive-ignition engines for the propulsion
of vehicles and falling within CN codes 2) 2710 11 41, 2710 11 45 and 2710 11 49,
5. mineral oils set out in points 1 to 4 with a content of additional oxygenates, in such a manner
that the overall oxygen content does not exceed 2.7 weight per cent, intended for the operation of
internal combustion positive-ignition engines for the propulsion of vehicles and falling within CN
codes 2) 2710 11 41, 2710 11 45 and 2710 11 49,
b) diesel fuel
1. gas oils intended for the operation of compression-ignition engines for the propulsion of vehicles
and falling within CN code 2) 2710 19 41,
2. medium oils intended for the operation of compression-ignition engines for the propulsion of vehicles
and falling within CN code 2) 2710 19 29,
3. gas oils with a maximum content of 5 volume per cent of fatty acid methyl esters intended for the
operation of compression-ignition engines for the propulsion of vehicles and falling within CN code
2) 2710 19 41,
4. medium oils with a maximum content of 5 volume per cent of fatty acid methyl esters intended for
the operation of compression-ignition engines for the propulsion of vehicles and falling within CN
codes 2) 2710 19 29,
c) biofuels
1. bio-ethyl-alcohol (bioethanol} – ethyl-alcohol produced from biomass 3) or biologically renewable
portion of waste intended as an additive to motor petrol the quality of which is compliant with the
relevant Czech technical standard and falling within CN code 2) 2207 20 00; this is a renewable energy
source,
2. bio-ethyl-tertbutyl-ether – ethyl-tertbutyl-ether produced on the basis of bio-ethyl-alcohol
(bioethanol), used as an additive to motor petrol and falling within CN code 2) 2909 19 00. The share
of bio-ethyl-tertbutyl-ether which is considered to be biofuel, is 47 volume per cent; this is
a renewable energy source,
3. biodiesel – fatty acid methyl esters produced from vegetable or animal oil having the properties
of diesel fuel, intended for the operation of compression-ignition engines for the propulsion of
vehicles and falling within CN code 2) 3824 90 99, for instance rapeseed oil methyl ester; this is
a renewable energy source,
d) mixed (blended) fuel - diesel fuel with a content higher than 30 weight per cent of rapeseed oil
methyl ester intended for the operation of compression-ignition engines for the propulsion of vehicles
and falling within CN code 2) 3824 90 99,
e) liquefied petroleum gases – the gases intended for the operation of internal combustion
positive-ignition engines for the propulsion of vehicles and falling within CN codes 2) 2711 12 19,
2711 12 97, 2711 13 91 and 2711 13 97,
f) compressed natural gas – the gas intended for the operation of internal combustion positive-ignition
engines for the propulsion of vehicles and falling within CN code 2) 2711 21 00,
g) petroleum components – selected petroleum products used for the production of fuels for
compression-ignition engines,
h) motor petrol with very low sulphur content [letter a)] which has maximum sulphur content of
mg/kg,

i) diesel fuel with very low sulphur content – diesel fuel [letter b)], with a maximum sulphur content
of 10 mg/kg.
Section 3
Biofuels, renewable source of energy
Biofuels may be available in the market as:
a) pure biofuels in compliance with the relevant quality standards,
b) biofuels blended with petroleum (crude oil) components in compliance with the relevant quality
standards, or
c) liquids derived from biofuels, for instance bio-ethyl-tertbutyl-ether.
Section 4
Fuel quality
(1) The required quality is met, if motor petrol is compliant with the relevant Czech technical
standard4) and meets the quality parameters set out in Annex No. 1 to this Decree.
(2) No later than 1 January 2005 motor petrol and motor petrol with very low sulphur content
in the market must meet, apart from the requirements stipulated by the relevant Czech technical standard,
4) also quality parameters set out in Annex No. 3 to this Decree. A from 1 January 2009 no motor petrol
may contain higher sulphur content than 10 mg/kg.
(3) The required quality is met, if diesel fuel is compliant with the relevant Czech technical
standard5) and meets the quality parameters set out in Annex No. 2 to this Decree.
(4) No later than 1 January 2005 diesel fuel and diesel fuel with very low sulphur content in
the market must meet, apart from the requirements stipulated by the relevant Czech technical standard,
5) also quality parameters set out in Annex No. 4 to this Decree. As from 1 January 2009 no motor petrol
may contain higher sulphur content than 10 mg/kg.
(5) Diesel fuel for artic winter conditions in the market need not meet, with respect to the
cetane number, the requirements under Annexes No. 2 and 4 to this Decree, but shall meet the
requirements of the relevant Czech technical standard. 5)
(6) The required quality is met, if bio-ethyl-alcohol (bioethanol) intended for use as an
additive to motor petrol meets the relevant Czech technical standard. 6) Separate use of
bio-ethyl-alcohol (bioethanol) is possible, if this biofuel is prescribed by the engine manufacturer.
(7) The required quality is met, if biodiesel is compliant with the relevant Czech technical
standard. 7) The use of biodiesel is only possible, if this fuel is prescribed by the engine manufacturer.
(8) The required quality is met, if the mixed diesel fuel is compliant with the relevant Czech
standard. 8) The use of mixed biodiesel is only possible, if this fuel is prescribed by the engine
manufacturer.
(9) The required quality is met, if the liquefied petroleum gases (hereinafter "LPG")are
compliant with the relevant Czech technical standard. 9)
(10) The required quality is met, if the compressed natural gas (hereinafter "CNG") is compliant
with the relevant Czech technical standard. 10)
Section 5
Manner of monitoring fuel quality parameters
(1) The monitoring of fuel quality parameters is performed by way of analyses of the samples
taken. Sample taking (sampling) is performed at all delivery (petrol pump), storage and sales points,
and it may be performed also directly from the users of fuels, subject to their consent.
(2) Sample taking and comparison of testing results for individual fuels must be compliant with
the relevant Czech technical standard. 11)
(3) A record of each sample taking shall be made which must contain:
a) registration number of the record registered by the Czech Commercial Inspection (hereinafter "the
Inspection Authority"),
b) identification of the controlled person:
1. if this is a natural person, first name/names and family name, or trade name, permanent residence,
or the principal place of business, identification number (if assigned),
2. if this is a legal entity, trade name, registered office and identification number (if assigned),
c) date, time and place of actual sample taking,
d) identification of the petrol pump or storage tank, from which the sample has been taken,
e) type of fuel with specifications compliant with the relevant Czech technical standards, 12)
f) number of the seal, identification of the sample and specification of its quantity,
g) name, number of the service identity card and the signature of an inspection official charged with
control tasks (hereinafter the "inspector") and in the case that samples are taken by the invited
competent person, name and signature of such person,
h) names of other invited persons whose presence was requested and who were involved in the sampling
procedure and their signatures.
(4) A record is made in two counterparts which must be signed by the inspector, the controlled
person, the invited authorized competent person taking the sample and other invited person. One copy
of the report shall be retained by the inspection authority. The second copy shall receive the controlled
person.
(5) The frequency of taking samples of a minimum number of fuels for the relevant year for the
assessment of their quality is set out in Annex No. 5 to this Decree.
(6) Fuel quality monitoring is performed solely by means of testing analytical methods
determined by the relevant Czech technical standards.
(7) The monitoring procedure focuses in particular on the following criteria:
a) for motor petrol:
1. Research octane number,
2. Motor octane number,
3. Density at 15 deg.C,
4. Vapour pressure calculated using the Dry Vapour Pressure Equivalent – only in the summer and winter
period(between 1 May and 30 September; and between 1 November and 31 March, respectively),
5. Distillation:
- percentage evaporated at 70 deg.C,
- percentage evaporated at 100 deg.C,
- percentage evaporated at 150 deg.C,
- final boiling point,
6. hydrocarbon composition:
- olefines,
- aromatics,
- benzene,
7. oxygen content,
8. oxygenates content:
- methanol (methylalcohol),
- ethanol (ethylalcohol),
- iso-propyl alcohol,
- tert-butyl alcohol,
- iso-butyl alcohol,
- ethers containing 5 or more carbon atoms per molecule,
- thereof: ethyl tert-butyl ether,
- other oxygenates,
9. sulphur content ,
10. lead content ,
11. potassium content (only in the case of petrol with the research octane number of at least 91 and
with an additive against excessive wear of valve seats added by the manufacturer),
b) in the case of diesel fuel:
1. cetane number,
2. cetane index,
3. density at 15 deg.C,
4. Distillation:
- percentage evaporated at 250 deg.C,
- percentage evaporated at 350 deg.C,
- 95 % (V/V) recovered at maximum temperature . . .deg.C,
5. polycyclic aromatic hydrocarbons,
6. sulphur content,
7. filterability – in the transitional and winter period only (between 1 October and 14 April),
8. paraffin cloud point – in winter period only (between 16 November and 28 – 29 February),
9. flash point,
10. ester content,
c) in the case of biodiesel:
1. ester content,
2. density at 15 deg.C,
3. cetane number – each fifth sample taken,
4. filterability – in the transitional and winter period only (between 1 October and 14 April),
5. acid number,
6. corrosive effect on copper,
7. sulphur content ,
8. water content ,
9. sulphated ash content,
10. phosphorus content ,
11. free and bound glycerol content,
12. alkaline metals content (sodium and potassium),
13. flash point,
d) for mixed diesel fuel,
1. cetane number,
2. cetane index,
3. density at 15 deg.C,
4. Distillation:
- percentage evaporated at
250 deg.C,
- percentage evaporated at
350 deg.C,
- 95 % (V/V) recovered at maximum temperature . . . . deg.C,
5. sulphur content ,
6. filterability – in the transitional and winter period only (between 1 October and 14 April),

e) for LPG:
1. Motor octane number – calculated from the composition determined by means of chromatography analysis,
2. sulphur content ,
3. diene content,
4. corrosive effect on copper,
5. hydrogen sulfide determination ,
f) for CNG:
1. methane content.
§ 6
Additive dosage
For vehicles with engines designed for the use of leaded motor petrol, an additive is used which
is the potassium salt of the alkylated sulpho-succinic acid. The additive shall be dosed in such a
manner that the potassium concentration per litre of petrol should be between 5 mg and 26 mg of potassium.
§ 7
Fuel quality monitoring
(1) The results of monitoring fuel quality parameters set out in Section 4 (1) to (9) for the
previous calendar month shall be sent by the Inspection Authority to the Ministry of Industry and Trade
always on the fifteenth day of the following month in the form of monitoring summaries. A specimen
monitoring summary is presented in Annex No. 6 to this Decree.
(2) Supporting data for the preparation of the annual monitoring summary of fuel quality set
out in Section 4 (1) to (9) for the previous calendar year shall be sent by the Inspection Authority
to the Ministry of Industry and Trade always no later than 31 March of the relevant calendar year.
These supporting data must be prepared separately for each type of fuel based on its specification.
For motor petrol the specification is based on the research octane number and maximum admissible sulphur
content. For diesel fuel, biodiesel, mixed diesel fuel and LPG the specification is based on the maximum
admissible sulphur content. Specimen supporting data for the preparation of the annual monitoring
summary are set out in Annexes No. 7 to 11 to this Decree.
(3) A contact state authority with respect to EU authorities for regular reporting on the quality
of motor petrol and diesel fuel in the Czech Republic is the Ministry of Industry and Trade which always
as at 30 June sends to the European Commission information on the result of quality monitoring of the
above fuels.
Section 8
Repealing clause
The following shall be repealed:
1. Decree No. 227/2001 Coll. laying down the requirements for fuels for the operation of on-road
vehicles and the manner of supervision and monitoring their quality.
2. Decree No. 48/2003 Coll. , amending Decree No. 227/2001 Coll., laying down the requirements
for fuels for the operation of on-road vehicles and the manner of fuel quality supervision and
monitoring.
Section 9
Effective date
(1) This Decree becomes effective on the day of entry into force of the Treaty of Accession
of the Czech Republic to the European Union.
(2) Section 4 (1) and (3) and Annexes No. 1 and 2 shall expire on 31 December 2004.

data in relation to methods of test“ have been applied and in fixing
a minimum value a minimum difference of 2R above zero has been taken into
account (R = reproducibility). The results of individual measurements
shall be interpreted on the basis of the criteria described in ČSN EN ISO 4259
(ISO 4259:1995).
(3) Unleaded petrol Normal may be marketed with a minimum motor octane number (MON) of 81 and a minimum
research octane number (RON) of 91.
(4) The summer period shall begin no later than 1 May and shall not end before 30 September.
Note: For Member States with artic or severe winter conditions, the summer
period shall begin no later than 1 June and shall not end before 31 August.
(5) Unleaded petrol Normal may be marketed with a maximum olefin content of 21% V/V).
(6) Other mono-alcohols and ethers with a final boiling point no higher than that
stated in ČSN EN 228 (EN 228:1999).
