IMPROPER USE OF FLAMMABLE MATERIALS NEAR ELECTRICAL
SOURCES AND FAILURE TO THROUGHLY EXTINGUISH SMOKING

NOTICE ORDERED BY THE MAYOR OF THE CITY OF GALVESTON
WHEREAS, due to Hurricane __________ which has created widespread and severe damage in
the City of Galveston, the City must take continued action to save lives, prevent injuries, protect
property, public health, the environment and public safety; and
WHEREAS, the Mayor of the City of Galveston has determined that extraordinary measures to
alleviate the suffering of people and to protect or rehabilitate property; and,
WHEREAS, in view of the potential public health and safety hazards represented by members of
the public using fires to dispose of debris by open incineration of debris, open flames and
improper use of flammable; and,
WHEREAS, due to the debris and dangerous conditions caused by Hurricane Ike, it is necessary
to PROHIBIT OPEN INCINERATION, OPEN FLAMES, THE USE OF FLAMMABLE
MATERIALS NEAR GENERATORS AND OTHER ELECTRICAL SOURCES AND THE
IMCOMPLETE EXTINGUISHING OF SMOKING MATERIALS PRIOR TO DISCARD,
UNTIL FURTHER NOTICE, DUE TO HEALTH AND SAFETY CONCERNS AND THE
GENERAL WELFARE OF THE PUBLIC;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR OF THE CITY OF
GALVESTON, TEXAS:
SECTION 1. It shall be unlawful for any person, to burn or incinerate debris, use open
flames, use flammable materials or smoke near generators or other electrical sources, or
improperly extinguish smoking materials before discard, effective September 21, 2008 until
FURTHER NOTICE.
SECTION 2. This Order may be altered, changed, or lifted, by order of the Mayor, or
her designee, at any time; however, said Order shall remain in effect until such order is made.
SECTION 3. Any person who shall violate any provision of this Order may be subject
to arrest and shall be deemed guilty of a misdemeanor and upon conviction shall be fined in a
penal sum not to exceed $2,000.00.
SECTION 4. This declaration shall take effect at 5:00 p.m. until further notice by the
Mayor.
