There is material on record filed in support of the chargesheets in the above said case to
show the involvement of Indresh Kumar as set out below:
1) The close association of accused Sunil Joshi with accused Indresh Kumar is evidenced
by the statements of Bharatbhai Rateswar, Swami Asimanand, Vasudev Parmar,
Shivam Dhakar, Col. PS Purohit, etc. during the relevant period of criminal conspiracy
(2001 to 2007);
2) It is evidenced by the statements of Shivam Dhakad and Vasudev Parmar that
accused Sunil Joshi during the period of his abscondence from the Pyare Singh
Ninama and Dinesh Ninama murder cases used to visit Jammu (Himalaya Parivar) to
meet and obtain sheltering/ harbouring and other financial/ material support from
accused Indresh Kumar;
3) It is evidenced by the Disclosure and Discovery Memos drawn by CBI u/s 27 of the
Indian Evidence Act based on information disclosed by Swami Asimanandji in CBI
custody in Dangs District, Gujarat, on December 15, 2010, when he had pointed out
the place, where Indresh Kumar had met him alongwith Sunil Joshi and told him that
he will take care of the task of giving a suitable reply to the Muslims for carrying out
bomb blasts on temples, etc.;
4) It is evidenced by the confessional statement of Swamiji Asimanand that Indresh
Kumar was fully aware of the aggressive mindset and mental disposition of Sunil
Joshi and Swami Asimanand to give a suitable reply for the bomb blasts committed
by jihadis and had deliberately and specifically entrusted/ tasked Sunil Joshi with the
responsibility for giving such suitable replies and had assured him of necessary
manpower and resources in September 2005;
5) It is evidenced by the statement of Bharatbhai Rateshwar that accused Sunil Joshi
had told him in January 2007 in Dangs, when they had met during the Katha of
Ghanshyam Maharaj that when he was meeting several senior RSS leaders to return
to the RSS (following his name being mentioned in the FIR and chargesheet in
Ninama murder case), Indresh Kumar had told him that he (Indresh Kr) will provide
support to him (Sunil Joshi), who can do his work while he remains out of the RSS,
and further that Sunil Joshi had told him that he does his work always with the
knowledge and approval of Indresh Kumar;
6) It is evidenced by the statement of Shivam Dhakad that accused Indresh Kumar had
addressed a meeting of Sunil Joshi and some 7/ 8 others in Jaipur on October 1,
2005, wherein he had told them that while the RSS would neither concur with their
ideology nor support their work, they must join some other organisation and
continue to do their work, and which was promptly followed by Sunil Joshi forming
different teams and allotting tasks (Pragya Singh Thakur for propaganda and press
relations); (Ramji for bomb making); (Lokesh Sharma and Ramji for procuring pistols
and ammunition) (Himself for arranging finances), etc.
7) It is evidenced by the statement of Smt. Aruna Thakur that there was a booking in a
Gujarat Dharmashala on the relevant dates Oct 29, 2005 to Nov 2, 2005 in the name
of Manoj Singh (it needs to be recalled here that Manoj was the assumed cover
name used by Sunil Joshi during the period of his abscondence from Madhya
Pradesh Police because he was a wanted absconding accused in the Pyare Singh
Ninama and Dinesh Ninama murder cases);
8) It is evidenced by the statements of Bum Shankar Dubey, Rohit Kumar, Sonu Pandey,
etc. that in the winter of 2005, that is, shortly after Indresh Kumar had met Sunil
Joshi and 7/ 8 others in Jaipur, and a couple of months after Indresh Kumar had met
Sunil Joshi alongwith Swami Asimanand, accused Sunil Joshi in furtherance of
fulfilling a common objective, had visited Jamtara/ Mihijam alongwith Ramji and had
filed some fraudulent papers to obtain a Driving Licence under the cover name,
Manoj, and further, this was also the period, when Devendra Gupta, his junior
associate had commenced efforts to obtain the Voter Identity cards of Muslims, and
others for the purpose of buying SIM cards using fraudulent documentation under
different names for some secretive work (which eventually was proved to be the
terrorist bombing work in Mecca Masjid and Ajmer Sharif);
9) It is evidenced by the statement of Bharatbhai Rateshwar that in May 2006, Indresh
Kumar had met Sunil Joshi @ Manoj and given Rs. 50,000 while making a secretive
gesture of approval with his eyes, followed by a pat on the back for him, and (it is
relevant to mention here, that within seven-ten days of this meeting, accused Ramji
@ Omji had made a trip to Jamtara/ Mihijam/Dumka, etc. in Jharkhand/West
Bengal/Bihar for the purchase of incriminatory SIM cards and mobiles that were
subsequently used in the bomb blasts in Mecca Masjid on May 18, 2007 and Ajmer
Sharif on October 11, 2007);
10) It is in evidence (from the pocket book of accused Sunil Joshi), one of the Emergency
Numbers mentioned by him is that of Indresh Kumar, which again also shows that
they were very close, which further, when seen in their contextual conjunction with
Call Data Records and other relevant facts, confirms their conspiratorial contact;
11) It is also further evidenced by the statement of Vinay Pandey that accused Sunil
Joshi had sent Dhan Singh and Rajendar Pehlwan @ Samandar to Jammu for some
training (and it is relevant to note here that apart from Himalaya Parivar, an outfit
that owes its inspiration and allegiance to Indresh Kumar, Sunil Joshi had no other
contact there), and the abscondence of the said Rajender Pehlwan and Dhan Singh
ever since they had come to know that Vinay Pandey had been taken by Rajasthan
ATS for questioning also shows a very strong suspicion that the protracted
abscondence of these two was/ and is being driven, by a strong guilty conscience
that their training maybe connected with terrorist activities like that in which Sunil
Joshi, Ramji, etc. were involved in;
12) It is also further evidenced from the statements of Ashok Beri and Dr Ashok
Varshnay that after they had brought it to his (IK’s) notice about the extra-judicial
confession made to them by Devendra Gupta, that Indresh Kumar had played a
facilitatory role in harbouring/ sheltering him, and had also arranged for him to be
reinstated in the RSS as a Vibhag Pracharak in Muzaffarpur, after about a year;
13) It is also further evidenced by the statement of Shivam Dhakad that during the
period of the abscondence of Sunil Joshi from the Ninama murder case, his sole
source of finances were what were provided to him by accused Indresh Kumar and
Swamiji Asimanandji;
14) It is also further evidenced from the CDRs (available only during the period June 1,
2007 to December 29, 2007) that Indresh Kumar and Sunil Joshi were in contact with
each other, and the call patterns indicate towards the irresistible inference that
these were in connection with the criminal conspiracy (by way of illustration: a)
immediately after receiving a call from Indresh Kumar, Sunil Joshi makes a call to
Devendra Gupta and immediately thereafter to the bomb planter Sureshbhai Nair);
b) eight days before the Ajmer Bomb Blast, Sunil Joshi calls the bomb planter, and
then calls Indresh Kumar, Swamiji Asimanand, etc.
15) It is also further evidenced by the confessional statement of Swamiji Asimanand that
accused Sunil Joshi had told him after he had coordinated the commission of the
bomb blast in Ajmer Sharif that Indresh Kumar had given him two persons to do this
work;
16) It is also further evidenced by the statements of Atul Modi, Shailaja Joshi, Anand Raj
Kataria, etc. that after Sunil Joshi was expelled from the RSS, he had no source of
income (this helps to strengthen the evidence from other witnesses that Indresh
Kumar was the person providing financial and material succour to Sunil Joshi);
17) It is also further evidenced from the statements of Col. PS Purohit, Bharatbhai
Rateshwar, etc. that accused Indresh Kumar was the philosopher-guide/ patron of
accused Sunil Joshi, Pragya Singh Thakur, etc.
18) It is evidenced by the statements of Shivam Dhakad, Vasudev Parmar, etc. that
accused Ashok @ Amit was brought from Jammu by accused Sunil Joshi (this when
juxtaposed with the disclosure made by accused Devendra Gupta shows that he was
provided under the patronage of Indresh Kumar)
19) It is also further evidenced by the confessional statement of Swamiji Asimanandji
and corroborated by Col. PS Purohit and Dr. RP Singh that Indresh Kumar has ISI
connections and was taking money from them;
That additionally, there are further reasonable grounds to believe that he was part
of the criminal conspiracy in the instant case, as borne out by the statements of
other arrested accused persons/ suspects, which, while not of evidentiary value,
have justificatory value for the purpose of arrest and custodial interrogation of
other hitherto un-arrested accused:
1) Accused Lokesh Sharma has disclosed that accused Indresh Kumar was the patron/
philosopher-guide of accused Sunil Joshi in this line of activities, and further, that
accused Sunil Joshi was the pointsman between Indresh Kumar and the others like
Ramji, etc.in the module, something which is in accord with the design of the
terrorist module as can be seen in the confessional statement of Swami Asimanand;
2) Accused Devendra Gupta has also disclosed that once in 2006, when accused Amit
was absconding from the Mumbai ATS for his role in the Malegaon-II bombing, that
he was from Jammu, which is the stronghold of Indresh Kumar ;
3) Raj @ Harshadbhai Solanki has disclosed during his interrogation by Rajasthan ATS
that when accused Sunil Joshi had introduced him to Indresh Kumar, sometime in
2007, the latter had patted him on the back; and
4) Pragya Singh Thakur has also disclosed that accused Sunil Joshi was very close to
Indresh Kumar, who was his patron/ philosopher-guide from the RSS.
