LAB CASE NUMBER # 28-99912 Page 1 of 3 OFFICE OF THE DISTRICT ATTORNEY DR. ROSE LEIGH VINES CHIEF DEPUTY HORNET COUNTY ALEXANDER GONZALES DISTRICT ATTORNEY DR. RUTH E. BALLARD CRIME LABORATORY DIRECTOR Date: 5/10/2010 HORNET COUNTY SHERIFF’S DEPARTMENT 13 Sting Street Hornet’s Nest, CA. 95819 SUSPECT: R. Spear VICTIM: J.B. Walker ATTENTION: Detective Ronald Donaldson, Hornet County Sheriff’s Department EVIDENCE EXAMINED: This document reports the results of DNA testing on the listed items. Please see the report dated 3/10/2010 for the results of serological analyses performed on Items 22-1A and 27-1C. Original items submitted to the laboratory: 22-1A One tape-sealed envelope labeled “Fired 9 mm cartridge case from crime scene” 27-1C One tape-sealed bag labeled “Black sock found in suspect’s bedroom” Items analyzed in this report: Item Number 22-1A-1 27-1C-1 38 Description One tube labeled “28-999122-22-1A-1” (Extract from serological test for blood on Item 22-1A) One tube labeled “28-999122-1C-1” (Extract from serological test for blood on Item 27-1C) One tape-sealed envelope labeled “Reference buccal swab from suspect R. Spear.” EXAMINATION AND RESULTS: Item 22-1A-1 contained approximately 0.2 mL of frozen extract remaining from a serological test for human blood performed on Item 22-1A by analyst Doug Mason. DNA was extracted from the cells in the entire serological extract, with a total yield of 4 ng of human DNA. One ng of the DNA extract was used for nuclear DNA typing. The remaining DNA extract, labeled “22-1A-1 DNA,” remains for future DNA analyses, if needed. Item 27-1C-1 contained approximately 0.2 mL of frozen extract remaining from a serological test for human blood performed on Item 22-1C by analyst Doug Mason. DNA was extracted from the cells in the LAB CASE NUMBER # 28-99912 Page 2 of 3 entire serological extract, with a total yield of 22 ng of human DNA. One ng of the DNA extract was used for nuclear DNA typing. The remaining DNA extract, labeled “27-1C-1 DNA,” remains for future DNA analyses, if needed. Item 38 was a buccal swab taken from suspect R. Spear for reference purposes. One half of the swab was consumed to generate a DNA extract, with a total yield of 42 ng of human DNA. One ng of the DNA extract was used for nuclear DNA typing. The remaining extract, labeled “38-DNA,” remains for future DNA analyses, if needed. The remaining half of the original swab was also saved. Nuclear DNA typing was performed using the Identifiler PCR kit, which amplifies the gender marker amelogenin (AMEL) and fifteen short tandem repeat (STR) loci. The results are in the following table: Item Description 22-1A Swab of stain on fired 9 mm cartridge case 27-1C Stain from black sock 38 Suspect Spear reference D8S1179 D21S11 D7S820 CSF1PO D3S1358 THO1 D13S317 D16S539 D2S1338 D19S433 vWA TPOX D18S51 Amel D5S818 FGA 12,13 29, 33.2 12,13 10,11 15,15 8,10 8,12 11,13 17,21 12.2, 16 16,17 10,11 12,14 XX 11,12 24,27 13,13 29,30 8,12 11,12 15,16 7,10 8,8 11,13 17,18 15,16 17,18 9,11 12,12 XY 10,11 21,24 12,13 29, 33.2 12,13 10,11 15,15 8,10 8,12 11,13 17,21 12.2, 16 16,17 10,11 12,14 XY 11,12 24,27 The DNA profile obtained from Item 22-1A indicates that the DNA is from a female and that Suspect R. Spear is eliminated as its source. The DNA profile obtained from Item 27-1C is the same as that of suspect R. Spear. This profile is expected to occur, in a randomly selected individual, in approximately 1 in 7.7 septillion African Americans, 1 in 640 sextillion Caucasians, and 1 in 360 sextillion Hispanics. DISPOSITION OF EVIDENCE Items 22-1A-1 DNA, 27-1C-1 DNA, and 38-DNA are being stored in a box in the laboratory’s long-term evidence freezer. The box is labeled “LCN # 28-99912 DNA extracts.” The remaining half of the evidence swab from Item 38 was returned to its original evidence envelope. The envelope was then sealed and placed in the evidence kit for LCN #28-99912. The kit was sealed and is currently being stored in the laboratory’s walk-in property room at 4 deg C. LAB CASE NUMBER # 28-99912 Page 3 of 3 All of the items in evidence kit 28-99912 have been examined and the kit is ready for pick-up at your earliest convenience. The DNA extracts will remain at the Hornet County Crime Laboratory for long-term frozen storage.
