To ban the sale of the hides, skins, or other parts from any species protected under the
Endangered Species Act of 1973.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
act may be cited as the “Endangered Species Protection Act of 2013”.
Sec. 2. (a) It is unlawful in the District of Columbia to transport, possess for resale, or sell

any endangered species of wildlife, the hides, skins, or other parts thereof, or any article made in
15
whole or in part from the skin, hide, or other parts of any species of wildlife designated as an
16
endangered species under the Federal Endangered Species Act of 1973, approved December 28,
17
1973 (87 Stat. 884; U.S.C. § 16-1531 et seq.) and subsequent amendments, or under the Marine
18
Mammal Protection Act of 1972, approved October 21, 1972 (86 Stat. 1027; U.S.C. § 16-1361et
19
seq.), or which is listed in the Federal Register by the Secretary of the Interior pursuant to the
20
above acts. The violation of any federal regulations adopted pursuant to the above acts shall also
21
be deemed a violation of this section and shall be prosecuted by the appropriate officials.

(b) Any person who violates any provision of this section is guilty of a misdemeanor and
23
shall be subject to a fine of not less than one thousand dollars ($1,000) and not to exceed five
24
thousand dollars ($5,000) or imprisonment not to exceed six months, or both that fine and
25
imprisonment, for each violation.

(c) The importation, transportation, possession, or sale of any species of wildlife
2
otherwise prohibited pursuant to this section for zoological, educational, or scientific purposes,
3
and for the propagation of such wildlife in captivity for preservation purposes except as
4
otherwise prohibited by law.

(d) The Mayor, pursuant to Title I of the District of Columbia Administrative
6
Procedure Act, approved October 21, 1968 (82 Stat. 1204; D.C. Official Code § 2-501 et
7
seq.), shall issue rules to implement the provisions of this act. The proposed rules shall be
8
submitted to the Council for a 45-day period of review, excluding Saturdays, Sundays, legal
9
holidays, and days of Council recess. If the Council does not approve or disapprove the proposed
10
rules, in whole or in part, by resolution within the 45-day review period, the proposed rules shall
11
be deemed approved.

Sec. 3. Fiscal impact statement.

The Council adopts the fiscal impact statement in the committee report as the fiscal
14
impact statement required by section 602(c)(3) of the District of Columbia Home Rule Act,
15
approved December 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(3)).

Sec. 4. Effective date.

This act shall take effect following approval by the Mayor (or in the event of veto by the
18
Mayor, action by the Council to override the veto), a 30-day period of Congressional review as
19
provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December
20
24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of
21
Columbia Register.
