This chapter sets forth policies and procedures which implement statutory provisions requiring disclosure of potential or actual relationships between Career Service employees of the State of Florida and individuals, partnerships, corporations, and other entities subject to regulation by or doing business with an employee's agency. As used in this Chapter, the following definitions shall apply: (1) Agency Head -- The Department Head as defined in Chapter 20, Florida Statutes, or a designee of the Department Head who has been delegated the authority, in writing, for administration of one or more provisions of this Chapter. (2) Application -- A verbal or written communication whereby an employee holds himself out as available for employment or for a contractual relationship for remuneration. (3) Employee -- Any Career Service employee of an agency. (4) Entity -- Any individual, partnership, association, corporation (for profit or not-for-profit), utility, or other organization, whether public or private, doing business with or subject to regulation by an employee's agency. 1 This rule was statutorily repealed effective January 1, 2002. (5) Financial Interest -- Any arrangement whereby an employee acquires an ownership or equity interest, or the right to acquire an ownership or equity interest, in an entity. (6) Gift -- Real property or tangible or intangible personal property, or a beneficial interest in real property or tangible or intangible personal property, of material value to the recipient. (7) Regulatory Responsibility -- Duties or responsibilities assigned to an employee by management in an agency which involve: (a) The direct responsibility for determinations of whether or not an entity is in compliance with federal, state or local statutes or regulations, or for determinations or recommendations as to whether any license, authority to do business, or other certificate of authority issuable by the employee's agency should be issued to an entity, revoked, canceled or suspended; or (b) Direct responsibility for the approval of purchases by an agency from an entity; or (c) Custody, supervision, care or treatment of prisoners, inmates, patients, clients or other persons committed to a state institution. (1) Each employee exercising regulatory responsibility shall, within five working days of making application with an entity disclose to the agency head in writing that such application has been made. (2) Each employee exercising regulatory responsibility who receives an offer of employment or for a contractual relationship for remuneration from an entity shall disclose such offer in writing to the agency head within five working days of receipt of such offer. (3) Any employee who receives a gift from an entity the value of which is $25 or more shall disclose such gift in writing to the agency head within five working days of receipt of the gift; provided, however, that no employee 2 This rule was statutorily repealed effective January 1, 2002. It is provided for informational purposes only. shall accept any gift based upon an understanding that the official acts or judgment of the employee will be influenced thereby. (4) Any employee exercising regulatory responsibility who has or who obtains a financial interest in an entity shall disclose such fact to the agency head within five working days of the acquisition of such interest.
