Town of Waterville Council Minutes May 7, 2014 Regular meeting was called to order by Mayor Royal J. DeVaney at 6:30 p.m. A moment of silence was observed followed by The Pledge of Allegiance. All Councilmembers were present, with the exception of Councilmember Munson. Minutes of the April 21, 2014 regular Council meeting were approved on a motion by Smith and seconded by Huber. Unanimous vote. April 2014 Payroll for $21,576.04 (Wts. #6225 – 6236) and Accounts Payable for $36,637.85 (Wts. #15883 – 15907) were approved for payment on a motion by Smith, and seconded by Huber. Unanimously approved. LETTERS OF APPLICATION FOR COUNCIL POSITION NO. 3 Council reviewed letters of application for Council Position No. 3 from Jill Thompson and Greg Day. Executive Session Mayor DeVaney excused the public from Council Chambers for an executive session at 6:35 p.m., and announced that regular session would reconvene at 6:50 p.m. Mayor DeVaney reopened regular session at 6:49 p.m. Council requested additional time in executive session. Mayor DeVaney announced that Council would retire to executive session at 6:52 p.m. and regular session would reopen at 7:00 p.m. Council returned to Council Chambers at 6:55 p.m. Mayor DeVaney reopened regular session. Councilmember Huber made a motion to nominate Jill Thompson for Council Position No. 3, with a second from Smith. Unanimous vote. Swearing-in Ceremony Town Attorney Steve Smith administered the oath of office to newly appointed Councilmember Jill Thompson. POLICING REPORT / HUMANE SOCIETY REPORT No reports. Document1 -1- CODE ENFORCEMENT – HUGH THEILER Ron and Theresa Gault attended the Council meeting to request that the Council waive system development and water connection fees of $4,200.00 to their property at 500 S. Central Avenue, due to extenuating circumstances. Town Attorney Steve Smith informed the Gaults that the fees were established by ordinance and could not be waived. The request was denied, with no further action. PUBLIC HEARINGS, ORDINANCES, & RESOLUTIONS Ordinance 2014 – 746: Authorizing the Use of ATV’s within Corporate Limits of Waterville Smith made a motion to adopt Ordinance 2014 – 746 authorizing the use of ATV’s within the city limits of Waterville. Thompson seconded. Roll Call: Huber – Aye. Smith – Aye. Driver - Aye. Thompson - Aye. Unanimous vote. Resolution 2014 – 04: Setting a Hearing Date for the Vacation of Fourth Street from Monroe Street to Roosevelt Street Smith made a motion to adopt Resolution 2014 – 04 which sets a public hearing for Monday, June 16, 2014 at Town Hall, 6:30 p.m. to hear public comment on the vacation of Fourth Street from Monroe Street to Roosevelt Street. Thompson seconded. Unanimous vote. Set a Public Hearing to Hear Proposals on Updating Requirements and Regulations for Business Licenses for Monday, May 19, 2014, Town Hall, 104 East Locust Street, 6:30 p.m. Council discussed the possibility of declaring a six month moratorium on allowing marijuana sales or growing operations within city limits until the Town has decided how to proceed with this issue. Huber made a motion to have Town Attorney Steve Smith draft an ordinance adopting a moratorium on the establishment of recreational marijuana facilities within the city limits of Waterville and set a public hearing to hear comment on the issue for May 19, 2014, at Town Hall, 6:30 p.m. Thompson seconded. Unanimous vote. SURPLUS EQUIPMENT – BID AWARD Driver made a motion to accept Joe Sprauer’s bid of $500.00 for the purchase of a 1972 Ford water truck from the Town. Huber seconded. Unanimous vote. Document1 -2- Smith made a motion to accept Joe Sprauer’s bid of $3,000.00 for the purchase of the 1967 Galion road grader from the Town, with a second from Driver. Unanimous vote. USED CAR LOT UPDATE Code Compliance Officer Hugh Theiler reported that clean-up of the used car lot on the corner of Chelan Avenue and Ash Street has stalled at this point. Theiler added that the tenant has two weeks to meet the deadline agreed upon and stated in a letter mailed last month. COMMITTEE REPORTS Link Transit Board Representative Joyce Huber informed Council that the May meeting had been cancelled. MAYOR’S REPORT . ……Mayor DeVaney reported that the Spring Clean-Up Day held Saturday, May 3rd was well attended. Four containers were filled, and nine bins of hazardous wastes collected. He thanked all that participated, with special commendation to the volunteers who worked during the event. ……A yard waste container is now available behind Town Hall. Please inquire at Town Hall to check out a key, and a schedule of fees. ……Bid opening for the TIB Third Street Reconstruction Project is scheduled for Monday, May 12, 2014, 5:00 p.m., at Town Hall. The bid award for the project will follow at the May 19th Council meeting at Town Hall, 6:30 p.m. The meeting was adjourned at 8:04 p.m. on a motion from Smith and a second from Huber.
