DFW ICS, is a tax-exempt 501(c) (3) organization sponsoring a fundraising raffle (“Raffle”) in accordance with the laws of the State of Texas. The Raffle shall be known as the 2015 DFWICS Car Raffle (“Raffle”).

All proceeds of the Raffle, less prizes and expenses, will benefit DFW ICS and will be used in furtherance of charitable purposes. The rules and regulations of the Raffle are set forth below. By purchasing a raffle ticket (“Ticket”), the purchaser agrees to be bound by these rules and regulations. The interpretation and application of the rules and regulations by DFW ICS and its legal counsel shall be final.

DFW ICS is a non-profit, cultural organization and has a strong commitment to the community in organizing annual Diwali Mela, entertainment programs, medical clinics, recognition and rewards to the teachers, and support of other non -profit organizations .

TICKET PRICE & SALES: The purchase price of a single raffle ticket is $10 each. . The odds of winning the prize, as hereinafter defined, will depend on the final number of tickets sold. Credit cards accepted are

Discover, Visa, MasterCard and American Express.. Ticket purchases are not refundable. The participant must follow all instructions on the entry form to complete the ticket entries and must meet all eligibility requirements listed in this Official Rules document to be qualified for the Raffle. Each raffle ticket purchased shall constitute as an "entry" into the raffle, and the person to whom the raffle ticket is registered shall be the "Entrant." Although more than one name may be provided on the ticket registration form, the ticket shall be registered to the first name listed, who shall constitute the sole Entrant for that ticket. The winning Entrant shall be the "winner" of the prize. Payment to or delivery of any prize will be made to the Entrant. The winner must complete IRS forms before the prize is tendered. It is the sole responsibility of the Entrant to allocate a winning prize to other participants in case of a multiple-entry registration, and the winning Entrant shall hold harmless DFWICS in case of conflicting claims or disputes among multiple claimants.

Per IRS rules, amounts paid for raffle tickets are not gifts to the charitable organization and do not qualify as deductible charitable contributions.

QUANTITY OF TICKETS: The maximum number of tickets offered for sale is 5000. Requests for ticket purchases (and therefore payments received) after all tickets are sold or following the drawing, will be retained in our office.

ELIGIBILITY: Purchasers of raffle tickets must be legal residents of the United States and 18 years of age or older on, or before, October 31, 2015. The winner must complete IRS forms to receive winning prize.

If Credit card payment for a raffle ticket is dishonored prior to the drawing, the entry ticket will be declared invalid, until a replacement is received. . All federal, state and local laws and regulations apply.

Void where prohibited by law. DFWICS Diwali Mela organizers and Board members are not eligible to receive the prize.

RANDOM DRAWING: Completed tickets sale stubs must be in the possession of DFWICS by 9.30 p.m.

(midnight) Central Standard Time on October 31, 2015, unless otherwise personally delivered to an authorized representative of DFWICS before the time of the drawing. The raffle will take place on,

October 31, 2015, with a random drawing during DFWICS’s 10 th annual Diwali Celebration: Diwali entrance ticket is sold separately and event ticket is required for attendance. Please see website for detailed information on this event. If not sold out prior to the event, tickets will be available for purchase until 9.30 PM of the drawing. Purchase of a raffle ticket does not entitle the purchaser entrance to the event. The Draw will take place on the main stage at 10 PM. The winner, must be present to collect the items before 11.30 p.m at the main stage or information booth.

PRIZES: The winner will have a choice of a 2015 Nissan Versa or any upgrade car of their choice at the

Grubbs Nissan and pay the difference directly to the dealer. All federal, state and local income, sales and/or excise taxes, fees, assessments and like charges associated with the prize, including license, title and registration fees, are the responsibility of the holder of the winning ticket. Winner must complete a

W-9 form before receiving prize.

In addition to the grand prize, 2 Round trip tickets to India, Gold necklace values approximately $1000 will be awarded. . The prizes will be awarded regardless of the number of tickets sold.

The winner is responsible for the separate payment of all taxes, fees and charges, including, but not limited to Federal, State, and Local taxes, title and registration fees. Per current IRS requirements, the winner is responsible for payment of 28% withholding via form W-2G at time of acceptance. Selected unit only; prize cannot be exchanged for cash. If the winner elects not to accept the vehicle, no substitution or exchange for cash or other goods will be provided. Odometer reading at time of award will reflect miles driven during the raffle event, not to exceed 100 miles. DFWICS is not responsible for the vehicle’s quality nor shall it have any responsibility once the vehicle has been conveyed or delivered to the winner. The stated value of the prize is based on the advertised MSRP and not the actual purchase price paid by DFWICS; all applicable discounts, rebates, and incentives associated with the purchase of the prize vehicle are claimed by and payable to DFWICS.

Affidavit & Release: As a condition of being awarded the vehicle, the winner designee shall be required to execute and deliver to DFWICS a signed affidavit of eligibility, acceptance of these Official Rules, release of liability, and satisfy IRS the 28% W-2G withholding requirement.

DFWICS assumes no responsibility for the Winner's tax and/or legal obligations, including the payment of income taxes, and suggests the Winner consult his/her tax and/or legal advisor. The Winner must provide DFWICS with all necessary information required for tax purposes prior to delivery of the Prize.

Failure to do so within ten (10) days of such request shall result in an automatic forfeiture of the

Winner’s Prize.

In addition, all costs incurred subsequent to transfer, such as gasoline, oil and maintenance not specifically covered under the vehicle warranty, etc. are the Winner's sole responsibility.

The Prize is awarded “AS IS” with no warranty or guarantee except as specifically provided by the vehicle manufacturer.

DFWICS specifically disclaims all expressed or implied warranties, including without limitation warranties of merchant ability and fitness for a particular purpose regarding the Nissan Versa

The Winner must claim the Prize by 11.30 pm on Oct 31, 2015 of notification otherwise such Prize will be forfeited. In the event that a Winner does not claim the Prize or is determined to be ineligible to receive the Prize, no other Prize will be awarded or substituted to the Winner.

In case the Winner is deemed ineligible or forfeits the Prize, a new Winner will be chosen at random from the remaining raffle tickets.

If the Winner is eligible to receive the Prize and elects to receive the Prize, the Winner agrees to take delivery and title of the Prize at Grubbs Nissan, Bedford, TX within ten(10) days of being notified he or she is the Winner, or assumes responsibility for costs associated with transporting the Prize to the

Winner’s location of choice.

An appointment must be made with Grubbs Nissan, Bedford, TX to make arrangements for receipt of the car.

Dispute Resolution: DFWICS shall resolve all disputes in its sole and absolute discretion. DFWICS reserves the right, exercisable upon its sole discretion, to disqualify any individual found to have:

Violated the Official Rules;

Interfered with the entry process or the operation of the Raffle;

Altered or attempted to alter the random outcome of the Raffle;

Violated any law or regulation by participating in the Raffle; or

Fraudulently completed the entry form or provided other false information to DFWICS

All entrants must retain their raffle ticket stubs. In the event of any dispute or controversy concerning the winner of the drawing, entrants will be required to produce the raffle ticket stubs.

WAIVER/LIMITATIONS OF LIABILITY: Entrants release DFWICS, and its respective board, committee members, officers, volunteers, employees and representative agents from any and all liability with respect to participation in the promotion and possession of the prize. Any liability of DFWICS shall be limited to the ticket price paid. In the case of a dispute, DFWICS’s decision shall be final.

Entrant agrees to allow DFWICS to use his/her name and image without any compensation for any promotional activity related to this or any future raffle. Any and all addresses and contact information of the purchaser will not be released to the public. By entering the Raffle, the Winner agrees that his/her name and/or likeness may be disclosed to and used by the news media, Grubbs Nissan/DFWICS for promotional purposes without additional compensation. In addition, each participant releases the corporate entities of DFWICS, Grubbs Nissan of Bedford and their respective parent or affiliated companies, directors, officers, employees, volunteers and agents from any and all liability for injuries, losses or damages of any kind caused by participating in the Raffle or winning the Prize, or resulting from acceptance, possession, use or misuse of the Prize. The Winner of the Prize and/or their family, heirs, associates or other interested parties agree to indemnify and hold harmless the corporate entities of DFW ICS/Grubbs Nissan and their respective parent or affiliated companies, directors, officers, employees, volunteers and agents from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the Winner’s acceptance or use of the Prize.

A Raffle participant’s sole and exclusive remedy for DFWICS’s breach shall be limited to the return of the purchase price paid for his/ her Ticket(s). In no event shall the corporate entities of DFWICS, Grubbs

Nissan and their respective directors, officers, employees, volunteers and agents be liable to any party for any loss or injuries to earnings, profits or goodwill, for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages by counsel. All parties agree to resolve any disputes through

State approved arbitration and waive the jury trail in any courts

By purchasing a Ticket and choosing to participate in the Raffle, each Raffle participant acknowledges and agrees that DFWICS has the right, in its sole discretion, to elect not to proceed with the Raffle for any reason whatsoever or for no reason, and in such event, a participant's remedy shall be to receive a refund of the full price paid by such participant for each Raffle ticket purchased, without interest.

The name and logo of DFWICS /Grubbs Nissan are registered trademarks, and no other person or entity is authorized to copy or otherwise use them without the express written consent of DFWICS and Grubbs
