CITY OF BLUE RIDGE MANOR MEETING MINUTES
APRIL 22, 2013
NEXT MEETING DATE: May 29, 2013
The regular monthly meeting of the City of Blue Ridge Manor was held on April 22, 2013 at the
Middletown Fire Department, Division 2. The meeting came to order at 7:00pm, Mayor Mike
Ober presiding.

Approval of March Minutes
Having distributed the March minutes to the Commission prior to the March 25th meeting,
Mayor Ober asked if there were any corrections or omissions. Porter Lady moved that the
February minutes be approved as read. Julie Colucci seconded the motion. Motion carried.
Treasurer’s Report
Bob Carter gave an overview of the March Balance Sheet, and the March End of the Month
Report. He also gave an update of the 2012 delinquent property taxes. As of this date, there is
still six that remain outstanding. It was discovered that five of these delinquents had new
addresses and one unit was sold indicating that the buyer may be liable. Stan Chauvin will send
out an additional final letter to these six. The total balance due for these six accounts is
$2,200.00.
Stan also gave the second reading of the amended 2A Ordinance, Series 2012 of the City Budget.
He indicated that the Insurance bond listed as $8,000 has increased to $10,969.70. The Holiday
item figure has been increased from $2,500 to $7,900.00.

OLD BUSINESS
Update on Metcalfe’s Attempted Agreement
Mr. Steve Porter, attorney, addressed the Commission on behalf of his client, Mr. Metcalfe and
his concerns. Some of these concerns include the back road to the park that needs clarification,
“suggested” proper signage, parking lot and potential uncontrolled public access to the park. It
was also discussed that the chain be put back to maintain access control along with increased
park security. Enforcing park rules for keeping the park closed during specific hours (10pm –
7am) with exception of any major event that the City conducts, was also one of the concerns.
Discussion followed on the pros and cons concerning these issues.
Stan Chauvin stated that with these issues raised, Mayor Ober and the commission would go into
a closed meeting to discuss them further. Mr. Porter asked if the closed session would be held
that evening. Stan stated that it would and he would relate to Mr. Porter the City’s proposal from
the closed meeting so Mr. Porter could discuss it further with his client.
Frank Rassiga intervened with his concern of the drainage issue on his property that he feels still
exists from the parking lot construction. Mayor Ober re-assured him that he and the commission
are continuing to work with the engineers to eliminate the proposed drainage issue and will
continue to do so until an agreeable solution is met to everyone’s satisfaction.
Mr. Rassiga then offered his house for consideration for the City to purchase as a City Hall.
Mayor Ober thanked him for his offer and will take this into consideration. Judge Conliffe
reminded the commission of the City residents’ concerns if the City purchased a private
residence for a City Hall. City residents should be kept informed of this. Mayor Ober described
the history and purpose of such a purchase. Most small cities do have a City Hall in order to
maintain one central location for all City records and equipment owned by the City. Our City’s
records and equipment do not have this capability and the Mayor stated that the commission
would make known to the City residents through proper publication, before any actual purchase
was made.
Art Sims asked what type of property would the City be interested in that would fit the needs of
the City. Mayor Ober stated that it would be property close to the park in order to maintain and
care for the park maintenance as well as storage space for records and park equipment.
House in Violation Update
Mayor Ober reported that the City attorney sent a letter to the resident informing him that he was
in violation of proper care and maintenance of his property. Mayor Ober also reported of his
failed attempts to visit with the owner, personally. Stan Chauvin will continue to pursue a
follow-up before the next monthly meeting.

Movies in Park (during picnic)
Mayor Ober will continue to pursue a one-time option to show movies in the park at the Summer
picnic. He is waiting for Mr. Worth to respond to the City’s request.
Grant Money for Sidewalk Project Update
Mayor Ober plans to meet with a contractor to get an estimate for the sidewalk grant with
matching funds. He will submit the estimate with the grant request form provided by
councilman Jerry Miller’s office. Roger Lanning offered the name of Willard Bryant of Bryant
Construction who is also associated with the Derby City Concrete Construction Company as a
possible consideration for the Sidewalk Grant construction work. It was duly noted.
“Welcome to the Neighborhood” Bag
Mayor Ober reviewed with the commission the new resident’s bag and its contents. Roger
Lanning inquired if the Condo Associations directory could be added to it. Mayor Ober stated he
would like to use some discretion with this but will definitely include them as a part of the
overall picture. Mayor asked for a show of hands that were in favor of the New Residents Bag.
All were in favor to move forward with it.
Easement Update – (Dwight Spurior Conversation)
Stan Chauvin will follow up with Dwight Spurior of the Water Company regarding the access to
the water line on Fred Nicoulin’s property for park use.
City House Zoning research Update
Stan Chauvin is still continuing his research on any possible zoning issues for purchasing a
private residence as a potential City Hall. He will keep the commission advised of his findings.
NEW BUSINESS
First Reading of Residential Storage container/Dumpster Ordinance
Stan Chauvin gave the first reading of the City Ordinance for Dumpster/Pods issue.
Purchase of park vehicle and allocation of funds
A gator type vehicle with a truck bed with optional blades was suggested by the Mayor to
consider for purchase in order to continue proper maintenance of the Park and the City grounds.
The commission decided to research this for affordable prices so Porter can give Stan Chauvin
some “specs” to include in the new budget reading at the next meeting.
City’s Properties for Sale Options
Stan Chauvin will give an update on this at next month’s meeting.

COMMISSIONERS REPORTS
Department of Public Safety – Julie Colucci
Julie Colucci reported that the installation of the City signs is complete. She is also discussing
additional signs at Shelby Point, and street numbers on the street signs. She has also received a
very favorable response from the residents of Shelby Point regarding the lighting at the front
entrance.
Public Property and Finance – Hans Klose
Hans Klose had nothing to report at this time.
Department of Community Affairs & Public Records – Carla Kreitman
Carla reported that the Spring issue of the City Newsletter was at the printers and should be
delivered soon. The flyers announcing the Blood Drive have been distributed. She also reported
that she has set up individual emails for each Commission on the City Website.
Department of Park and Recreation – Porter Lady
Porter reported that:
 All plants have been watered
 Repaired wire in the park that was frayed
 Planted six new trees
 Planted begonias & dusty millers
 Will have front entrance plantings in before Derby
 Sprayed Park to control weeds
 Working on a proper location for the Ron Walker Grove to be dedicated in his honor
Stan Chauvin stated that the Commission should now go in to a “closed session” to discuss the
parking lot issue that was addressed earlier by Mr. Metcalfe and his attorney Mr. Porter. There
was some objection to this by Mr. Porter. Stan quoted KRS Chapter 61 statute to reinforce this
option. Mayor Ober moved to go into closed session. Hans Klose seconded it. Motion carried.
Closed session came to order at 8:45pm. A motion was put before the Commission on all the
requests addressed by Mr. Metcalfe. Mayor Ober called for a vote. All in favor were three. All
opposed were two. Motion carried. After some discussion of how the City would provide a
reasonable solution to the park issue the closed session adjourned at 9:13pm.
There being no further business, the Mayor asked for a motion to adjourn. Julie Colucci so
moved. Porter Lady seconded it. Motion carried.
Meeting was adjourned at 9:14pm.
