NO. 3270 (a)

SCHOOL DISTRICT

DISPOSITION OF OBSOLETE AND/OR

UNUSABLE INSTRUCTIONAL MATERIALS

The Manteca Unified School District shall adhere to the following regulations, standards, and procedures regarding the disposition of obsolete and/or unusable textbooks and instructional materials.

Standards for Determination of Obsolescence and Usableness

1. District-adopted textbooks in any subject area shall be considered and declared obsolete for educational purposes whenever the District makes a new adoption for that subject area. Such obsolete textbooks may continue to be used in the classroom only if they are judged by the Superintendent to be in alignment with the content and instructional objectives of the current District curriculum.

2. District textbooks and instructional materials shall be considered unusable by the District for educational purposes when either (a) the materials are in conflict with current District instructional philosophy, goals, and teaching strategies and/or (b) the materials are damaged or worn beyond a reasonable point of continued use by students.

Disposal of Surplus or Undistributed Obsolete Instructional Materials

The District shall make a reasonable effort to dispose of surplus or undistributed obsolete instructional materials in any of the following ways:

1. By donation to any governing board, county free library or other state institutions.

2. By donation to any public agency or institution of any territory or possession of the United States, or the government of any country which formerly was a territory, or possession of the United States.

By donation to any nonprofit charitable organization.

By donation to children or adults in the State of California, or foreign countries for the purpose of increasing the general literacy of the people.

However, the District shall inform the recipients of the materials that they may not sell these items nor donate them to any organization that could profit financially from them.

5. By sale for a nominal price for use within the State of California to any organization which agrees to use such materials solely for educational purposes. “Nominal Price” in these regulations refers to shipping charges plus a handling fee. “Handling Fee” is defined as the cost incurred by the

District to prepare for the distribution of the materials – including the gathering and packaging.

6. By sale at the end of any school term to students of the District at prices which shall not exceed the actual value of the materials.

7. By sale on the secondhand market at whatever price is agreed upon.

In the event that the District is unable to dispose of the materials in any of the ways outlined in 1-7 above, the District may dispose of such materials in any of the following ways:

1. Mutilated so as not to be salable as instructional materials and sold for scrap or for use in the manufacture of paper pulp or other substances at the highest price that can be obtained.

2. Destroyed by any economical means, provided that no instructional material shall be destroyed until 30 days after the Board of Education has given notice to all persons who have filed a request for such notice.

“Destroyed” may include disposing of the materials in a local public dump.

Requirements of Recipients

Any organization, agency, or institution receiving obsolete instructional materials under the provisions of this policy must certify to the governing board that it agrees to use the

SCHOOL DISTRICT materials for educational purposes and agrees to make no charge of any kind to the persons to whom the organization gives or lends such materials. For example, in the case of donations of obsolete materials to a private school, the private school officials shall be required to certify in writing that they will not charge students for the donated materials or include a cost for them in the tuition payments.

Funds Received From Sale of Obsolete Instructional Materials

Any money received by the Manteca Unified School District from the sale of obsolete instructional materials pursuant to this policy shall be deposited in any such fund of the

District as the Board prescribes and shall be used for school district purposes.
