Lower Loxley Care Home is a residential care home for elderly individuals who are unable to care for themselves at home any longer. It is a former stately home in a parkland setting. At the Lower Loxley Care Home there have been a few unfortunate incidents. Lower Loxley is a large residential care home for people who need help with day to day tasks, such as personal care as well as people who are classed as Elderly Mentally Infirm (EMI). The EMI unit is separate to the main residential care side as the service users will need more care and security to keep them safe. You have been asked to review the setting’s compliance with laws and regulations Your job is to create a REPORT to explain how each incident could have been prevented by compliance to policies & prcedures and health and safety leglslation See further guidance below Look back at the scenario above and then study these incidents: The incidents have been as follows: 1. The CQC (Care Quality Commission) were not happy that the setting did not have a clear risk assessment procedure in place, this would have prevented Mr Pargetter from trying to use the stairs on his own, resulting in a fractured hip for Mr Pargetter. 2. Jenny Aldridge, the staff nurse for the EMI unit, had to intervene when Mike (a care worker) tried to move a very large service user from his bed to a chair as someone else was using the hoist. 3. Also in the EMI unit, Mr Woolley was able to gain access to the medication trolley, and thinking that the medications were sweets, had helped himself to a large quantity of dangerous drugs before he was found. Sadly Mr Woolley died two days later in hospital. 4. Usha Gupta is the manager in the care home, she has been run off her feet recentlyNJM as MOCK Mock the home has understaffed, she has not been able to start her Registered Manager’s Award and has also let the training for the rest of the staff drop off. She forgot to get enhanced disclosures on some new members of staff. These haven’t had any induction training either. 5. A Food Inspector from the local authority made an unannounced visit and saw that there was a chicken in the fridge which was marked “Pet Food Only”, also they found Clarrie, a care worker, handling food and telling the cook that she had spent the day before in bed being sick. The instructions You are to: identify in each incident what was done incorrectly name which piece of legislation was not followed Give a summary of what the legislation states should happen. Then explain why good policies and procedures would have prevented each incident Then you should describe how health and safety legislation, policies and procedures promote the safety of individuals in a health or social care setting by choosing 3 pieces of legislation and describing how each will keep people safe in a health and safety setting. Also explain how the health & safety policy & procedure of a setting will encourage everyone to keep safe and secure. You may like to structure it as follows: Legislation/ Policy/ Procedure e.g. Data Protection Act (1998) How it promotes health, safety & security It ensures that people’s details are kept securely and that no one can get hold of their address or contact details unless they are authorised to.
