KALISPELL PUBLIC SCHOOLS 233 FIRST AVENUE EAST KALISPELL, MT 59901 406-751-3434 www.sd5.k12.mt.us Kalispell Toyota/Kalispell Public Schools Charitable Truck Raffle –ANNOUNCEMENT April 12, 2015 2015 Tundra Fundraising Opportunity Kalispell Public Schools recently received a 2015 Tundra from Kalispell Toyota, as a donation in support of the School District’s K-12 student enrichment, extracurricular activities and extracurricular athletic programs. It is a goal of the District to reduce the number of fundraisers by augmenting our fundraising efforts with this raffle. What Happens Next and how do I participate? 12,000 raffle tickets have been printed and pre-numbered. Each ticket will contain the name, address and phone number of the purchaser/donor Each ticket will be sold for $10. (Raffle ticket sales may not and will not be conducted over the internet) School employees are eligible to participate in the raffle. Employees of any Montana Toyota dealership or nonU.S. citizens ARE NOT eligible to participate. Winner must present the winning ticket to validate the drawing. (see drawing rules) Winner must pay withholding tax to payer, Kalispell Public Schools, in the amount equal to 25% ( or the amount specified in IRS rules) of the fair market value of the 2015 Toyota Tundra Truck prior to receiving the truck. Proceeds will be used to support the School District’s K-12 student enrichment, extracurricular activities and extracurricular athletic programs, students with financial hardship needs and future fundraising opportunities. No portion of the proceeds will be used to cover the administrative costs of conducting the raffle. Initially, 80% of the proceeds will be returned to the school or student fundraising group that sells the tickets. All school sites and participants wishing to participate must complete the – “Agreement to Participate Form”. All tickets will be centrally controlled and issued. The District Business Office will oversee the program. Each site will be responsible for maintaining a daily, weekly, and monthly sales report which will be submitted to the District office weekly. Deposits will be made at the very minimum once per week to the respective school sites activity account to the credit of the “Kalispell Toyota Tundra Fundraiser Account”. A specific account will be established at each site which will separate funds from any other accounts currently in place. Receipts will be issued to each individual responsible for the tickets. It is the goal of the District to replace the need for some of the multiple fundraisers by utilizing this raffle. This fundraiser has the potential to bring $100,000 in funds to support our students. MCA 23-5-413(2)(c) The sale of tickets may not be conducted over the internet. MCA 23-5-413(3)(b) All raffle announcements or advertisements conducted over the internet must include notice of the sales restriction, the name of the organization offering the raffle and all raffle terms. MCA 23-5-413(c) Winners must be determined by a random selection process. MCA 23-5-112(35) The following random selection processes are authorized for use in determining a winner of a raffle (a) A drawing from a drum or other receptacle containing raffle ticket stubs or other suitable indicators of the ticket purchaser’s identity that have been thoroughly mixed before the drawing; and (b) Selection by any other process if: (i) the process is reasonably assured of being random and is not connected to an event that has its own intrinsic significance (e.g. a sports event, game of chance or contest); and (ii) the indicator of the raffle ticket purchaser’s identity reasonably assures the random selection of a winner. A.R.M. 23.16.2602 (1) The raffle must be publicly identified as a charitable raffle. A.R.M. 23.16.2602(2). For a period of 12 months from the date of the raffle drawing, the School District must maintain the following: (a) A record of the total proceeds collected (b) A detailed description of the prize(s) awarded (c) A description of the selection process used to determine the winner (d) A record reflecting the source of the prize(s), including any money paid to purchase prizes; (e) A record of any administrative costs paid with raffle proceeds (f) A description of how the raffle was publically identified as a charitable raffle, where applicable (g) The name and address of the person(s) awarded raffle prize(s); and (h) A detailed record of the distribution of the charitable raffle proceeds A.R.M. 23.16.2602(3) All raffle terms, including the date of the raffle drawing, must be available to the public prior to the sale of any raffle ticket.
