RESOLUTION NO. 2015 A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF HALLANDALE BEACH, FLORIDA,
AUTHORIZING THE CITY OF HALLANDALE BEACH TO
JOIN AN AMICUS CURIAE BRIEF TO BE FILED ON
BEHALF OF MAYORS FOR THE FREEDOM TO MARRY,
THE U.S. CONFERENCE OF MAYORS, AND OTHER
INDIVIDUAL MAYORS AND CITIES; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, same sex marriages are recognized in thirty six (36) states, most
recently including Florida and are banned in fourteen (14) states; and

WHEREAS, while United States v. Windsor and Hollingsworth v. Perry are historic
19
rulings for same sex couples, they did not resolve the question of whether same sex
20
couples have a constitutional right to marry or whether states have the right to ban the
21
practice; and

WHEREAS, the Supreme Court has agreed to hear four cases arising from four
24
states seeking marriage rights for same sex couples: DeBoer v. Snyder (Michigan),
25
Bourke v. Beshear (Kentucky), Obergefell v. Hodges (Ohio), and Tanco v. Haslam
26
(Tennessee); and

WHEREAS, the Supreme Court will consider two questions: 1) Does the
29
Fourteenth Amendment require a state to license a marriage between two people of the
30
same sex? And 2) Does the Fourteenth Amendment require a state to recognize a
31
marriage between two people of the same sex when their marriage was lawfully licensed
32
and performed out of state?; and

WHEREAS, the City Attorney’s Office of Los Angeles is drafting an amicus brief,
35
which will be filed on behalf of the Mayors for the Freedom to Marry, the U.S. Conference
36
of Mayors, and other individual mayors and cities. The brief will explain the harm caused
37
by marriage discrimination, including: harm to citizens’ health and welfare, impact on the
38
efficiency and effectiveness of local governments as employers, and costs to businesses,
39
including tourist revenue; and

WHEREAS, the Mayor and City Commission believe that the discrimination
42
against same-sex marriage is harmful to our citizens’ health and welfare, is detrimental to
43
the efficiency and effectiveness of our local government as employer, and costs the City
44
hard-earned tourism revenue; and

WHEREAS, the City of Hallandale Beach has previously adopted a domestic
47
partners policy and other policies setting forth it’s intolerance for discrimination relating to
48
same-sex partnerships; and

WHEREAS, the City of Hallandale Beach has previously signed on to an amicus
51
curiae brief along with other Florida cities seeking marriage equality in the Florida courts;

and

WHEREAS, the Mayor and City Commission support the efforts of Mayors for the
55
Freedom to Marry, the U.S. Conference of Mayors and others who have already signed
56
on to join the brief.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF HALLANDALE BEACH, FLORIDA:
SECTION 1. Recitals Adopted. That each of the above recitals are hereby
adopted, confirmed, and incorporated herein.

SECTION 2. Support of amicus curiae brief and authorization to be listed

as a party filing said brief. The Mayor and City Commission hereby state their full
66
support for the amicus curiae brief to be filed on behalf of numerous Mayors for the
67
Freedom to Marry, the U.S. Conference of Mayors and other cities calling for marriage
68
equality and hereby authorize the Mayors for the Freedom to Marry, the U.S. Conference
69
of Mayors and other cities to add the name of the City of Hallandale Beach to the list of
70
parties filing said brief.

SECTION 3. Directions to the City Clerk. The City Clerk is hereby directed to
send a certified copy of this resolution to the Los Angeles City Attorney’s Office.

SECTION 4. This Resolution shall take effect immediately upon its passage and
adoption.
