PUBLIC HEARING TO ADOPT LAND USE ORDINANCE PROPOSED CHANGES

Proposed changes to the Land Use Ordinances were presented. Changes were proposed and reviewed by the
Planning and Zoning Commission and the Town board. Town board is in favor of the changes that were proposed in red. Anything prior to the proposed changes will be grandfathered in.
Bill Jeppsen is concerned he cannot do any construction/developing until property is dedicated. Bill wants 100 percent liability release from trucks on the road. If another party damages the roads in his subdivision due to improper use they are responsible not Bill. If roads are built to code then there should be no damage. Bill says there should be a period of time for asphalt to set. Jan said Bill should put into his contract that if any contractors damage the roads on his subdivision the contractors are liable. Bill wants the Town to put in writing that it is the Town’s responsibility. The Town thinks this should be a contract between Bill and the
Builder. All the infrastructure needs to be done before lots are sold. Bill says if there is no digging until April
1 st and then building doesn’t get done until September, then another year will pass before Billie puts on seal coat. Harper says Bill can start digging before April 1 st as long as it is on Bill’s property before it is dedicated to the town. Once owners has building permit, they can start building and hook onto meter. Bill wants Town’s attorney to make sure we are doing things right.
The town’s people are going to be liable for another water tank. Town is going to pay for the cost upfront.
Margo acknowledged Brett Bennett for his planning knowledge and accomplishments since 2004. Planning and Zoning did a lot of research regarding the proposed changes.
Tina Lerohl was concerned about the proposed change to terminate issuing kennel permits. She was told no one can have no more than 3 pets over the age of 4 months per household.
Terry Nielsen’s cows will be grandfathered in and long as he keeps his cows and does not stop and then start.

Building Permits:
Travis Cochran presented proof of his land deed in Phase 5.
Jason Rawlings presented proof of his land deed in Phase 2.
Kevin Ball presented proof of his land deed in Phase 5.
Phil motioned to approve all building permit applications. Margo seconded. All in favor.
Audit presentation - Fiscal year ending June 30, 2014
Matt Regan presented a draft financial statement. State requires the audit. The financial statements need to be certified and then put on the website.
Town of Mantua is not using Capital Projects Funds. We can move money from the general fund to Capital Projects
Fund as a “savings” for future projects. The money can be used for construction or acquisition of assets such as buildings, equipment or roads. Should be part of the budget process. Need to open budget to move money. Money can be moved back to the general fund if money gets low.
All of the Town’s money in Bank of Utah is not insured. FDIC only insures up to $250,000.
Money is at PTIF because interest (used to be) higher. No insurance on money in PTIF.
We have to spend impact fees within 6 years after it is received. If the impact fees are not spent, the money gets returned to the developer or owner

Jan made motion to accept licenses except Steve Lauder with Steve’s Trees until he provides proof of liability insurance.
Phil seconded. All agreed.
Land Use Ordinance:
Change verbiage to say Bill can proceed with construction – within a year’s time – sealer can be put in after completion of road. If we will not accept the road – 100 percent of development needs to be complete before sale of land. Add verbiage to building permit about road damage. Do we want it in our building permit that whomever does road damage is responsible?
Phil motioned to approve the changes of the land use ordinance as written with exception of the change of the verbiage on the 100 percent completion of new subdivision roads with the exception of the seal coat. Jan seconded. All in favor.
Approved.
Planning and Zoning:
Reviewed water agreement with the church. Want to change what they have already proposed. Chris with Hansen &
Associates Engineering is in agreement. We don’t need their tank. We are responsible for what comes through chlorination. Contract will be ready by next council meeting.
Water Tank – Harper spoke with Chris about his concerns. Chris explained we are putting in tank for fire suppression. If we relied on north end we do not have enough pressure. Valves won’t support south end of the Town. Discussed where to put the tank. Possibly putting tank on the north side of town because of the flow of the valve. If put on the south end of town, build it large enough that we could condemn the north tank. Would like to set it in the mountain.
What does Steve Jeppsen want for his property? We need to find out what the fair price for the property is. Bob Nelson sold land to his sister for $1,000 an acre. Everything new will benefit south end of town. We got in a predicament when we bought the pump house property. Steve Howard wants another option. Maybe approach the forest service. Harper said they won’t do it. We need to separate the tanks. Don’t want it close together because if a line breaks or natural damage, it will take both out.
Need to use Impact fees – Lori to present report on how much needs to be used now and a time frame. Use money for purchase of the property. Put tank on the other side of the mountain. If we got the land now could we start digging the transition line. Impact fees will be used to purchase the land and pipe. Steve wants to try for a Grant. 750,000 gallon tank
Fax Machine:
Purchase of a new fax machine/copier/printer was discussed. Old fax machine/copier/printer is slow and cannot purchase toner cartridges anymore because it is outdated. Steve presented three different types of machines.
Brother
Epson 8200 medium printer, legal size, scanning $129
HP 5220 $249 – faster
It was decided the office would go ahead and order a new machine.
Law Enforcement: Need a new laptop with the capacity and ability to download camera film. Current desktop does not work well. Current computer will not do it and cannot hookup to Wi-Fi. Cost for new laptop is about $500. Steve will purchase one.
Fire Department:
Unanimously voted not to do raffle. Town will do it and proceeds will help pay for the fireworks.
Maintenance: Discussed the purchase of a generator for the pump houses in case of power outages. Maybe use impact fees to pay for the generator. There is a heater installed in the pump house.
Court: No print out for January court.
Planning and Zoning:
Gardner Jeppsen accepted open position for Planning and Zoning. Kirsti Loertscher decided not to it.
Celebrations: Jan and Harper in charge of Little Valley Days. Looking for volunteers.
Need to address insurance issues with dunking machine. Need to find someone to run it. League of Cities wants list of activities.
Calendars: Karen will do calendar fundraiser. This year all monies will be received by the town and expenses paid by the town.
Fourth of July Breakfast: Will not be doing this year. Notice will be put in the newsletter.
Cemetery: Sold a $1400 plot to someone outside of Mantua. Another one to sell this week. 160 existing lots. Harper suggested no burials to the left as you drove up. Make a cremation area. Memorial area. What price?

Council Comments:
Approval to get Grover’s Excavation paid. File small claims against Pathway Directional Building. Do we need a security bond. Send another bill certified, return receipt requested. Add late fees. Our repair, we are responsible. Threat 10 days of date of the letter or legal action.
Margo discussed the business permit for Chris Hickman. She received a phone call from Marlin Barrett regarding trucks coming onto the private road. Was not of the understanding the trucks coming in were semi-trucks. Jan suggested a big sign be posted saying there is a weight limit sign or no big trucks. Mantua has ordinance that states trucks are allow to deliver. Town asked about parking. Harper told Jeff it is a private drive. If you want restrictions, it should have been stated when property was sold. Law states as long as their destination is Mantua, trucks are allowed in town. Repairs of the road will have to be paid by all private property owners.
Capital project funds – save funds for cemetery - Use impact fees. Concerned about monies with PTIF funds.
Concerned about savings with no insurance. Will verify and discuss moving the money.
Condition of Indian Trail beyond Steve Howard’s home is not in good condition. Brigham needs to maintain it. Phil is going to go to Brigham City to discuss the issue. Torn down fences and barbed wire was used to pull people out.
Harper suggested seasonal closure. Road is a town road. Police will write a ticket if someone disobeys the signs. Get a barrier – cones. Sign should say: “Seasonal road closure – Land owners only.”
