OBJECTIVE Sandhills Community College (SCC) is seeking competitive pricing from Licensed NC General Contractors to erect, build, design, manage, inspect, coordinate, supervise, and complete a Pre-Engineered Metal Building with all foundations, mechanical, electrical, and plumbing requirements per attached Owner Plans. SCC reserves the right to reject any and all quotes. II. CODES All work shall comply with the following: A. The contractor is responsible to obtain information from all regulatory agencies in North Carolina and Moore County for any and all required permits. A copy of the required permits such as, but not limited to, the list below shall be submitted to the Owner within 24 hours of obtaining permits. 1. North Carolina State Building Code 2. Local Code: Town of Southern Pines 3. Southern Pines Fire Marshall 4. Department of Environment and Natural Resources (DENR) III. SCOPE OF WORK A. WORK INCLUDED: The Contractor shall furnish all necessary labor, materials, equipment, and services to furnish and erect a pre-engineered metal building as indicated on the drawings and described herein. B. Pre-Engineered Metal Building Base Building: 40’-0” x 120’-0” x 14’-0” 1. Building shall meet 2012 North Carolina State Building Code. 2. All primary and secondary steel shall receive one coat of red oxide primer paint. 3. Gutter and downspouts on both sidewalls. 4. Roof panels shall be 26 gauge. 5. Wall panels shall be 26 gauge. 6. Roof shall have R-30 Insulation, or greater. 7. Walls shall have R-19 Insulation, or greater. 8. (8) Interior 3’-0” x 7’-0” metal door frames with solid metal doors and hardware 9. (3) Exterior 3’-0” x 7’-0” metal door frames with solid metal doors and hardware 10. (4) 3’-0”x 5’-0” double hung vinyl clad windows 11. Lay-in grid T-8 2’x 4’ fluorescent lights IV. QUALIFICATIONS OF WORKMEN A. As a manufactured product, the design, detailing, fabrication, and erection of preengineered metal buildings shall be performed by, or under the direct supervision, of a Registered Professional Engineer who is a permanent full-time employee of the manufacturer of the pre-engineered metal building. B. Pre-engineered metal building shall be erected by the manufacturer or by a factory authorized and licensed erection subcontractor. C. All subcontractors shall be licensed by the State of North Carolina in their respective trades and possess valid, current, and appropriate liability insurance coverage. V. SUBMITTALS A. Performance Bond. Upon award of project, contractor must submit to the Owner, a surety performance bond for the full and total cost of the project. B. Submit a construction schedule and the sequence of work including the project completion date. Once approved, any change to the schedule must be approved in advance by the Owner. C. HUB (Historically Underutilized Business) participation. “As per the State of North Carolina (143-128.2.) Minority business participation goals. Sandhills Community College has established a ten (10) percent minimum participation goal for minority-owned businesses as defined under statute. Each proposal shall identify the minority businesses that it will use on the project and an affidavit listing the good faith efforts it has made pursuant to subsection (f) of the statute and the total dollar value of the work that will be performed by the minority businesses. A contractor that performs all of the work under a contract with its own workforce may submit an affidavit to that effect in lieu of the affidavit otherwise required under this subsection.” Statue (143-128.2.) is attached for contractor use and guidance. D. Prior to construction, submit the Architectural plans. E. Prior to construction, all Contractors and Sub-contractors must submit valid, current, and appropriate Certificates of Liability. 3 Sandhills Community College RFP & Scope of Work Palmer Trades Annex F. The manufacturer shall supply the Contractor with (3) copies of the pre-engineered shop drawings. Said drawings shall show the dimensions, complete erection drawings with the proper identification and assemblage of the building components, all relevant details, along with the calculations booklet sealed and signed by an engineer registered in North Carolina. Owner’s approval is required prior to any submittal to the code enforcement. G. Prior to ordering, the Owner must approve the manufacturer’s shop drawings, which shall include product data and samples on all building skin and roof systems, window systems, and doors. Three (3) copies shall be submitted. H. Structural foundation drawings and calculations shall include the foundation design, slab and reinforcement design, anchor bolt, base plates, along with all pertinent details. It shall be sealed and signed by a design engineer registered in North Carolina. Three (3) copies shall be submitted. I. Drawings on all electrical systems including riser diagrams, light fixtures, electrical panel board, wiring, transformers, circuiting, grounding, exhaust fans, powered roof fans, and carbon monoxide exhaust systems shall be prepared and signed by a licensed electrical contractor. Three (3) copies shall be submitted. J. Drawings on all mechanical systems, HVAC system, load calculations and ventilation system shall be prepared and signed by a licensed mechanical contractor. Three (3) copies shall be submitted. K. Drawings on all plumbing systems, riser diagrams, pipe connections and sizes, materials, and fixtures color and specifications shall be prepared and signed by a licensed plumbing contractor. Connections to water and sewage to be included. Three (3) copies shall be submitted. L. Equipment schedule with all mechanical, plumbing, electrical, and door hardware details shall be included. Three (3) copies shall be submitted. VI. SITE PREPARATION A. Before project begins, Contractor must work with the SCC Facilities Maintenance Department and design a staging area for parking, tools, waste dumpster, and equipment. B. Prior to construction, Contractor will be responsible for locating of all utilities. A preconstruction meeting shall be held with the Owner once all utilities have been located to determine re-routing of utilities. VII. FOUNDATION AND CONCRETE SLAB A. Contractor shall employ engineering services to design the foundation and slab. B. Slab shall include apron for overhead door and side entrance door. C. All necessary removal of concrete curbing and asphalt shall be included. D. Handicap access and sidewalk connection to Palmer Trades at Front Entry. E. Compaction testing shall be conducted per local and state codes. F. Erosion and storm water control measures shall be followed as required by DENR. 4 Sandhills Community College RFP & Scope of Work Palmer Trades Annex VIII. WARRANTY A. Pre-engineered metal building shall be warranted in writing against defects in materials and workmanship for a period of one (1) year from date of final acceptance of project. B. Wall panel finish shall be warranted in writing from date of shipment against the following: 1. Chalking 2. Fading 3. Cracking, checking, blistering, peeling, flaking, chipping or loss of adhesive. C. Roof panels shall be warranted in writing against perforation due to corrosion for a minimum period of twenty (20) years from date of shipment. The total potential liability of this warranty shall be equal to the original installed value of the roof panels. D. Pre-engineered metal building roof shall be warranted in writing for weather tightness for a period of ten (10) years from date of shipment. The total potential liability of this warranty shall be twenty five percent (25%) of the original installed value of the work under this section. IX. MANUFACTURE OF EQUIPMENT A. HVAC equipment shall be Trane. B. T-Stat shall be 7-day programmable by Honeywell. C. Electrical panel and breakers shall be Square D. D. Door locks shall be Corbin Russwin. E. Door hardware shall be Von Duprin. F. Toilet and urinal flush valves shall be low flow in design by Sloan. G. Toilet and urinals shall be low flow in design by Kohler. H. Sinks shall be low flow energy efficient in design by Kohler. I. Faucets shall be by Delta. J. Fluorescent Hi Bay light bulbs shall be by Philips. 1. Bulb description TL5 28W/841 HE K. Emergency and Exit lights shall be LED by Atlas. L. Exterior wall pack lighting shall be fluorescent by Atlas. M. Occupancy/Vacancy Sensors shall be LightHawk by Hubbell. X. SAFETY A. Contractor must follow all OSHA Safety Guidelines. B. Contractor will be responsible for installing all necessary construction fencing to prevent access of all non-qualified persons during construction and securing at the close of the day. C. Contractor must follow all SCC safety guidelines for scheduling of work and reporting to campus when work day begins or ends. D. INSURANCE CONTRACTOR INSURANCE INFORMATION: COVERAGE: During the term of the contract, the Contractor, at its sole cost and expense, shall provide commercial insurance of such type and with such terms and limits as may be reasonably associated with the contract. As a minimum, the contractor shall provide and maintain the following coverage and limits: A. Worker's Compensation: The Contractor shall provide and maintain Worker's Compensation Insurance, as required by the laws of North Carolina, as well as Employer's Liability coverage with minimum limits of $150,000.00, covering all of Contractor's employees who are engaged in any work under the contract. If any work is sublet, the Contractor shall require the subcontractor to provide the same coverage for any of his/her employees engaged in any work under the contract. B. Commercial General Liability: General Liability Coverage on a Comprehensive Broad Form on an occurrence basis in the minimum amount of $1,000,000.00 Combined Single Limit. (Defense cost shall be in excess of the limit of liability.) C. Automobile: Automobile Liability Insurance, to include liability coverage covering all owned, hired, and non-owned vehicles used in connection with the contract. The minimum combined single limit shall be $150,000.00 bodily injury and property damage; $150,000.00 uninsured/under insured motorist; and $1,000.00 medical payment. REQUIREMENTS: Providing and maintaining adequate insurance coverage is a material obligation of the Contractor and is of the essence of this contract. All such insurance shall meet all laws of the State of North Carolina. Such insurance coverage shall be obtained from companies that are authorized to provide such coverage and that are authorized by the Commissioner of Insurance to do business in North Carolina. The contractor shall at all times comply with the terms of such insurance policies, and all requirements of the insurer under any such insurance policies, except as they may conflict with existing North Carolina laws or this contract. The limits of coverage under each insurance policy maintained by the contractor shall not be interpreted as limiting the Contractor's liability and obligations under the contract. XII. NORTH CAROLINA GENERAL CONTRACT TERMS AND CONDITIONS 1. GOVERNING LAW: This contract is made under and shall be governed and construed in accordance with the laws of the State of North Carolina. 2. SITUS: The place of this contract, its situs and forum, shall be North Carolina, where all matters, whether sounding in contract or tort, relating to is validity, construction, interpretation and enforcement shall be determined. 3. INDEPENDENT CONTRACTOR: The Contractor shall be considered to be an independent contractor and as such shall be wholly responsible for the work to be performed and for the supervision of its employees. The Contractor represents that it has, or will secure at its own expense, all personnel required in performing the services under this agreement. Such employees shall not be employees of, or have any individual contractual relationship with the College. 4. ENTIRE AGREEMENT: This contract and any documents incorporated specifically by reference represent the entire agreement between the parties and supersede all prior oral or written statements or agreements. This Request for Proposal, any addenda thereto, and the contractor’s proposal are incorporated herein by reference as though set forth verbatim. All promises, requirements, terms, conditions, provisions, representations, guarantees, and warranties contained herein shall survive the contract expiration or termination date unless specifically provided otherwise herein, or unless superseded by applicable Federal or State statutes of limitation. 5. TAXES: G.S. 143-59.1 bars the Secretary of Administration from entering into contracts with vendors if the vendor or its affiliates meet one of the conditions of G. S. 105-164.8(b) and refuse to collect use tax on sales of tangible personal property to purchasers in North Carolina. Conditions under G. S. 105-164.8(b) include: (1) Maintenance of a retail establishment or office, (2) Presence of representatives in the State that solicit sales or transact business on behalf of the vendor and (3) Systematic exploitation of the market by media-assisted, media-facilitated, or media-solicited means. GENERAL INDEMNITY: The contractor shall hold and save the College, its officers, agents, and employees, harmless from liability of any kind, including all claims and losses accruing or resulting to any other person, firm, or corporation furnishing or supplying work, services, materials, or supplies in connection with the performance of this contract, and from any and all claims and losses accruing or resulting to any person, firm, or corporation that may be injured or damaged by the contractor in the performance of this contract and that are attributable to the negligence or intentionally tortious acts of the contractor provided that the contractor is notified in writing within 30 days that the College has knowledge of such claims. The contractor represents and warrants that it shall make no claim of any kind or nature against the State’s agents who are involved in the delivery or processing of contractor goods to the College. The representation and warranty in the preceding sentence shall survive the termination or expiration of this contract. 11
