All capitalized terms used in these instructions and the Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar, unless otherwise stated, have the meanings ascribed to them in the LRP I RFP. INSTRUCTIONS APPLICABLE TO ALL PRESCRIBED FORMS: a. The first page of a Prescribed Form must be marked with the name of the Large Renewable Project that is the subject of the Proposal. The Registered Proponent should use the name given to the Large Renewable Project in the Prescribed Form – Registration Form. b. This instruction page is not required to be submitted with the Proposal. c. Information provided in each Prescribed Form should be consistent with the information provided in the Proposal. d. Where the Prescribed Form has multiple pages, the pages of the Prescribed Form should be kept together in the Proposal in sequential order. e. Where a blank field for a section/page reference is provided in a Prescribed Form, enter the section/page reference of the Proposal where the substantiating evidence for that particular item can be found. f. Apart from the completion of any blanks, drop down lists, check boxes or similar uncompleted information in a Prescribed Form, no amendments may be made to the wording of a Prescribed Form. g. Each Prescribed Form must be completed in its entirety. Fields marked <if applicable> must be completed if applicable to the Proposal. If not applicable, they should be marked "not applicable". h. If the signature of the Registered Proponent is required for a Prescribed Form, the Prescribed Form must be signed by a person with authority to bind the Registered Proponent. i. With the exception of this instruction page, instructions within a Prescribed Form will be enclosed in brackets. INSTRUCTIONS SPECIFIC TO THE PRESCRIBED FORM – AGRICULTURAL LAND USE CONFIRMATION FOR NON-ROOFTOP SOLAR: j. An original ink signature must be provided on the Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar included with the hard copy Proposal marked "Original Copy". For clarity, other than the Original Copy, any additional hard copies of this Prescribed Form must be signed but need not be originals (photocopies may be provided as well). k. A Registered Proponent must submit this Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar which has been reviewed and signed by a Land Use Planner. l. This Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar is not required to be submitted for a Large Renewable Project whose Site is located entirely on lands that are within the meaning of paragraphs (a), (b) or (c) of the definition of First Nation Lands. For the purposes of the Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar the following terms have the meanings ascribed to them herein: “Approved Official Plan” means the current official plan approved under Section 17 of the Planning Act, RSO 1990, c P.13. “Canada Land Inventory or CLI” means an interpretive system for assessing the effects of climate and soil characteristics on the limitations of land for growing common field crops. Information about the Canada Land Inventory and its classification system is available on the Ministry of Agriculture, Food and Rural Affairs webpage: http://www.omafra.gov.on.ca/english/landuse/classify.htm. Mapping to be used for the purpose of the LRP I RFP is accessible on the Ministry of Agriculture, Food and Rural Affairs’ webpage: http://www.omafra.gov.on.ca/english/landuse/feed-intariffprogram.htm. “CLI Class 1 Lands” means the lands designated as “Class 1” pursuant to the Canada Land Inventory. “CLI Class 2 Lands” means the lands designated as “Class 2” pursuant to the Canada Land Inventory. “CLI Class 3 Lands” means the lands designated as “Class 2” pursuant to the Canada Land Inventory. “CLI Organic Lands” means the lands designated as “organic soils” on the Ontario Ministry of Agriculture, Food and Rural Affairs’ webpage: http://www.omafra.gov.on.ca/english/landuse/feed-in-tariffprogram.htm. “Land Use Planner” means a Natural Person who is a member in good standing of the Canadian Institute of Planners and is a registered professional planner in Ontario. “Municipality” means any corporation that is a "local municipality" or an “upper-tier municipality” as defined in and for the purposes of the Municipal Act, 2001, SO 2001, c 25 or the City of Toronto Act, 2006, SO 2006, c 11, Sched A. “Planning Board” means a planning board established pursuant to the Planning Act, RSO 1990, c P.13. “Prime Agricultural Areas” means “Prime agricultural areas” as defined in the Provincial Policy Statement. 120 Adelaide Street West, Suite 1600 Toronto, Ontario M5H 1T1 T 416-967-7474 F 416-967-1947 www.ieso.ca Prescribed Form – Agricultural Land Use Confirmation for NonRooftop Solar Page 2 of 5 Mar 2015 IESORP/f-LRPIRFP-007r2 “Provincial Policy Statement” means the 2014 provincial policy statement issued by the Minister of Municipal Affairs and Housing under section 3 of the Planning Act, RSO 1990, c P.13 and approved by the Lieutenant Governor in Council via Order in Council No.107/2014, as amended or replaced from time to time. “Specialty Crop Areas” has the meaning given to it in the Provincial Policy Statement. Mapping to be used for the purpose of the LRP I RFP is accessible on the Ministry of Agriculture, Food and Rural Affairs’ webpage: http://www.omafra.gov.on.ca/english/landuse/feed-in-tariffprogram.htm. THE UNDERSIGNED CONFIRMS to the IESO on behalf of the Registered Proponent and acknowledges that the IESO is relying on the confirmation that hereinafter follows: 1. The Site is located, in whole or in part, within the boundaries of the Approved Official Plan of a Municipality or a Planning Board that has completed the Prime Agricultural Area designation process for its Approved Official Plan. <insert description of this portion of the Site, e.g. PIN(s), legal description, and/or Grid Cells, etc.> 4. a. the Large Renewable Project did not have its Site located within any Prime Agricultural Areas as set out in the Municipality’s or Planning Board’s Approved Official Plan at the time this Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar was completed; and b. the Large Renewable Project did not have its Site located in whole or in part on any Specialty Crop Areas at the time this Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar was completed. c. If the Large Renewable Project is located in one or more Municipalities in which Specialty Crop Areas are located, a current map showing the Specialty Crop Areas has been provided as Exhibit A indicating the outline of the proposed Site, the outline of the Property or Properties on which the Registered Proponent has Access Rights, and the location of the Specialty Crop Areas in the relevant Municipality or Municipalities. The Site is located, in whole or in part, within the boundaries of the Approved Official Plan of a Municipality or a Planning Board that has NOT completed the Prime Agricultural Area designation process for its Approved Official Plan or any part of the Site is located outside of the boundaries covered by a Municipality’s or Planning Board’s Approved Official Plan. For this portion of the Site (i.e. not covered under 3. above): <insert description of this portion of the Site, e.g. PIN(s), legal description, and/or Grid Cells, etc.> a. the Large Renewable Project did not have its Site located in whole or in part within Specialty Crop Areas at the time this Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar was completed; 120 Adelaide Street West, Suite 1600 Toronto, Ontario M5H 1T1 T 416-967-7474 F 416-967-1947 www.ieso.ca Prescribed Form – Agricultural Land Use Confirmation for NonRooftop Solar Page 3 of 5 Mar 2015 IESORP/f-LRPIRFP-007r2 b. the Large Renewable Project did not have its Site located on one or more Properties that are comprised in whole or in part of CLI Organic Lands at the time this Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar was completed; c. the Large Renewable Project did not have its Site located on one or more Properties that are comprised in whole or in part of CLI Class 1 Lands, CLI Class 2 Lands or CLI Class 3 Lands, at the time this Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar was completed; and d. notwithstanding the restrictions contained in 4 b. and c. above, in the case where the current map from the Canada Land Inventory indicates that one or more Properties on which the Site is located are comprised in part of CLI Organic Lands, CLI Class 1 Lands, CLI Class 2 Lands or CLI Class 3 Lands and lands that are not CLI Organic Lands, CLI Class 1 Lands, CLI Class 2 Lands or CLI Class 3 Lands at the time this Prescribed Form – Agricultural Land Use Confirmation for Non-Rooftop Solar was completed, the Large Renewable Project does not have its Site located on the portion of such Property or Properties that is classified as CLI Organic Lands, CLI Class 1 Lands, CLI Class 2 Lands, CLI Class 3 Lands. e. If the Large Renewable Project is located in one or more Municipalities in which Specialty Crop Areas are located, a current map showing the Specialty Crop Areas has been provided as Exhibit A indicating the outline of the proposed Site, the outline of the Property or Properties on which the Registered Proponent has Access Rights, and the location of the Specialty Crop Areas in the relevant Municipality or Municipalities. f. Provided as Exhibit B to this Prescribed Form is a current map from the Canada Land Inventory (where one exists) showing the CLI map quadrant number(s), Site and Property or Properties on which the Large Renewable Project is located, whether in whole or in part. Where the higher detail CLI map is not available for the Project location, the lower detail CLI map (referred to as the “index” map) must be provided in which case only the quadrant number(s) must be shown and not the Site and Property or Properties on which the Project is located.
