On planning for use of frequency modulation broadcast channel to 2020
Pursuant to Law on radio frequency channel dated November 23 rd
2009;
Pursuant to Decree No 187/200/NĐ-CP dated December 25 th
2007 of the Government regulating functions, tasks, rights and organizational structure of Ministry of Information and Communication modified according to Decree No 50/2011/NĐ-CP dated June 24 th 2011 of the Government;
Pursuant to Decision No 22/2009/QĐ-TTg dated February 16 th 2009 of Prime Minister on approval of
“Planning for radio and television wave transmission and broadcasting to 2020”;
Pursuant to Decision No 125/2009/QĐ-TTg dated October 23 rd
2009 of Prime Minister on approval of
“Planning for national radio frequency spectrum”;
According to proposal of Director of the Authority of radio frequency management,
Minister of Information and Communication enacted Circular on Planning for use of frequency modulation broadcast channel to 2020
Article 1: Scope of adjustment
Content of this Circular consists of planning and using of frequency modulation broadcast channel to
2020; disposing and determining conditions for use of frequency channel for FM broadcast with 87 – 108
MHz frequency band and defining conditions for use of frequency for wireless radio station, FM radio station.
Article 2: Objectives of planning
Target of “Planning for use of FM broadcast channel to 2020” is to arrange use and determine conditions for use of frequency channels of Radio the voice of Vietnam, radio station, Radio television of provinces and cities directly under the central government in direction of stability and limitation of harmful interference among radios and ensure use of radio spectrum
Article 3: Principles for allotment of radio frequency channel
1.
Pay attention to use in Vietnam to ensure transference from actual circumstance to planning with low cost
2.
Allot frequency channel rationally and effectively to meet demands on emission of program channel of Radio the voice of Vietnam serving politic, foreign, defense and security task of Party and State; limit overlapping emission between FM radio station use the same program channel of
Radio the voice of Vietnam
3.
Radio station, radio television of provinces and cities directly under the central government is allotted with 01 FM frequency channel. However, in particular Hanoi and Ho Chi Minh city possess 03 channels
Article 4: Regulation on allocation of channel and allotment of FM broadcast channel
1.
Allocation of frequency channel for FM broadcast is stipulated in Appendix I promulgated with this Circular
2.
Allotment of detailed frequency channel to broadcast program channels of Radio the voice of
Vietnam and radio station, radio television of provinces and cities directly under the central government is regulated in Appendix II and III enacted with this Circular
Article 5: Regulation on assignment and use of radio frequency
1.
Basing on Appendix II and III enacted with this Circular and demands on use, broadcasting parameters is assigned and regulated particularly in permit for use of radio frequency
2.
FM coverage area is calculated according to minimum field strength specified in section 1; signal-to-interference protection ratio stipulated in section 2, appendix IV attached with this
Circular;
3.
Radio station, Radio television in provinces and cities directly under the central government are broadcasted FM and protected from harmful interference mainly in scale of administrative boundaries of these areas. In particular, Hanoi and Ho Chi Minh city are allowed to cover wave to territory of neighbor provinces and cities but not to cause harmful interference to other FM broadcast system allotted frequency channel according to regulation in Appendix II and III promulgated with this Circular
4.
FM radio station is required to use appropriate directional antenna to broadcast effectively and avoid leading to harmful interference to other stations and radiocommunication systems
5.
FM radio station in boundary areas is required to use appropriate directional antenna to ensure coverage area respecting agreement on boundary frequency combination between Vietnam and neighbor countries
6.
Test station, radio with specialized program channel, playback station broadcasting in the trough and remote areas, and district FM radio station are allocated frequency channel in accordance with each particular case on the basis of without harmful interference to other stations allotted frequency channel pursuant to regulations in Appendix II and III promulgated with this Circular
Article 6: Addition of frequency channel to special circumstance
On the basis of Planning of national radio frequency spectrum, operating license and capacity for supply of frequency in each area, Authority of radio frequency management considered additional assignment of frequency channel in each detailed circumstance to satisfy demands on additional development of FM radio channel for Radio the voice of Vietnam and radio station, radio television in provinces and cities directly under the central government
Article 7: Transitional provision
1.
FM broadcast station of Radio the voice of Vietnam, radio stations, radio television in provinces and cities directly under the central government operates differently from allotment of frequency
channel stipulated in Appendix II and III enacted with this Circular as well as are not protected from harmful interference and is prohibited to cause harmful interference to FM broadcast stations in planning; in case of resulting in harmful interference, it is necessary to apply promptly technical method to remove this phenomenon; in the event of without settlement of harmful interference, it is required to transfer immediately complying with planning or stop using

District FM broadcast station, FM playback station which are in operation and cause harmful interference to other stations allotted frequency channel in accordance with regulation in
Appendix II and III issued with this Circular must apply promptly necessary technical measures to discard this unwanted phenomenon; in case of without removal of harmful interference, it is required to transfer to another appropriate frequency channel
3.
For wireless radio station: a) It is prohibited to invest newly, grant new license to wireless radio stations with frequency band of (87 - 108) MHz; b) License granted to wireless radio stations in frequency band of (87 – 108) MHz will be extended the validity with condition of without leading to harmful interference to FM broadcast stations,
FM playback stations and other radiocommunication systems; c) When causing harmful interference to FM radio stations, FM playback station and other radiocommunication systems, wireless radio station operating in frequency band of (87-108)
MHz must apply promptly technical measures to remove harmful interference, in case of without removal of harmful interference, it is necessary to stop operating immediately d) Wireless radio station will be issued new operating license in frequency band of (54 - 68) MHz
Article 8: Organization of implementation
1.
Authority of radio frequency management (Ministry of Information and Communication) has a liability to: a) Disseminate and guide implementation of this Circular; b) Basing on planning, actual circumstance and plans for use of public frequency band of other services to assign frequency, issue license for use of frequency and radio according to regulations of law c) Lead and co-operate with Department of Information and Communication of provinces and cities directly under the central government to inspect, check, supervise performance of this Circular.
2.
Radio The voice of Vietnam, radio station, radio television in provinces and cities directly under the central government, FM broadcast station under management of People’s committee of districts, communes (wards) and relevant departments, units must develop plans which are suitable with this Circular
3.
People’s committee of provinces and cities directly under the central government supplies concrete guidance to Department of Information and Communication in co-ordination with Radio station, radio television, district People’s committee and other relevant local units to execute this
Circular
Article 9: Execution term
1.
This Circular comes into effect as from March 15 th 2013
2.
The Chief of the Secretariat, Director of the Authority of radio frequency management, Head of departments and units in Ministry of Information and Communication, Radio the voice of
Vietnam, radio station, radio television in provinces and cities directly under the central government take responsibility for executing this Circular
3.
During performance process, if any trouble arises, it is required to report to Ministry of
Information and Communication to consider and take solutions

VOV2: Culture – Science – Education;
VOV3: Music – Information – entertainment;
VOV4: Ethnic minority language programming
VOV5: Foreign broadcast;
VOV1-4: Broadcast of VOV4 program, the remainder time for broadcast of VOV1 program;
VOV2-4: Broadcast of VOV4 program, the remainder time for broadcast of VOV2 program;
VOV3-4: Broadcast of VOV4 program, the remainder time for broadcast of VOV3 program;

Referential power is a value which is used to evaluate interference capacity among FM broadcast station. To provinces possessing large area or specific characteristics in terrain, and in location of transmitter is allowed to propose to use a transmitter with bigger power, but without excess of
200% of referential power. The Authority of radio frequency management is in charge of determining broadcast power and regulate use of rational directional antenna to avoid causing harmful interference to areas of FM radio stations of other provinces and cities directly under the central government. Broadcast power and direction of antenna are specified particularly in permit for use of frequency and radio
