Under current federal legislation Employers who do not ensure that their management and supervisory staff provide a full measure of procedural fairness when counselling, disciplining or terminating an employee could find it very costly if their actions are challenged at Fair Work

Australia.

The reason for this is that in an unfair dismissal claim the Industrial Relations Tribunal will focus on the process the employer followed in disciplining or terminating the employee in order to ensure the process was fair. The reason for the Employer’s action, while being addressed by the Tribunal, does not in any way mitigate the need for the Employer to provide the required procedural fairness. In addition, where an employee makes an Adverse Action claim against an Employer the onus of proof is reversed and it is up to the Employer to prove that they did not take Adverse Action against the employee.

Providing a comprehensive overview, this informative and interactive half day program will familiarise you with your legal obligations as an Employer, providing useful information on how to conduct a disciplinary interview, while also allowing you to share your knowledge and gain from the experiences of others.
