Breath Analysis Instrument
I, Joanne Foley, Commander, Professional Development Command, in pursuance of
regulation 59 of the Traffic Regulations, being of the opinion that each member of the
Police Force whose name appears in the attached Schedule is: (a)
trained in the use of a prescribed breath analysis instrument known as
the Drager Alcotest 7110; and
(b)
capable of using that prescribed breath analysis instrument correctly,
Authorise those members of the Police Force to use that prescribed breath analysis

Transport of Dangerous Goods by Road and Rail
(National Uniform Legislation) Act
Appointment of Officers
I, Douglas Purdom Phillips, the Competent Authority:
(a) under section 23(1) of the Transport of Dangerous Goods by Road and Rail (National
uniform Legislation) Act and with reference to section 44(1) of the Interpretation Act,
terminate all appointments of authorised officers in force immediately before the date
of this instrument; and
(b) under section 23(1) of the Transport of Dangerous Goods by Road and Rail (National
uniform Legislation) Act, appoint the people named in the Schedule to be authorised
officers and exercise the powers under:
a) sections 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 44, 45, 46, 47, 48, 49, 50, 54, 55,
56, 57, 58, 59, 62, 63, 64, 65, 86, 88, 90, 93, 95, 96 and 99 of the Transport of
Dangerous Goods by Road and Rail (National uniform Legislation) Act; and
b) regulation 232 of the Transport of Dangerous Goods by Road and Rail
(National uniform Legislation) Regulations.
The power to amend a notice pursuant to sections 88 and 96 is restricted to minor
amendments:
(i)
for clarification; or
(ii)
to correct errors or references; or
(iii) to reflect changes of address or other circumstances.

Legal Profession Act 2006
1. The Law Society Northern Territory pursuant to section 375(2) of the Legal
Profession Act 2006 (the Act) and in accordance with the conditions set out in
paragraph 3 of this instrument exempts local legal practitioners holding or seeking
to hold barrister practising certificates under the Act to (practising only in the
manner of a barrister), from compliance with the section 376 of the Act.
2. Pursuant to section 375 (2) of the Act, the period of exemption will be from 4.00pm
on 30 June 2015 to 4.00pm on 30 June 2015, unless the instrument is earlier
terminated by the Law Society Northern Territory.
3. The exemption is subject to the following conditions:
a) The barristers that are covered by this exemption must maintain professional
indemnity insurance with respect to their legal practice, which contains terms
and conditions accepted by the Law Society Northern Territory (accepted
alternative policy).
b) The barristers that are covered by this exemption must provide to the Law
Society Northern Territory a copy of the terms of the accepted alternative policy
and provide satisfactory evidence to the Law Society Northern Territory that they
are covered by the accepted alternative policy.

Legal Profession Act 2006

compliance with the section 376 of the Act and Regulations.
2. Pursuant to section 375 of the Act, the period of exemption shall be from 4.00pm on
30 June 2014 to 4.00pm on 30 June 2015, unless the instrument is earlier
terminated by the Law Society Northern Territory.
3. This exemption is subject to the following conditions:
(a) The legal practitioners covered by this exemption must maintain professional
indemnity insurance with respect to their practice (the alternative professional
indemnity insurance), that contains at least, the minimum terms and conditions and
that provides the same or a higher level of insurance cover than that provided by,
the scheme entered into by the Law Society Northern Territory pursuant to section
378 of the Act. The alternative professional indemnity insurance shall include
provisions for ongoing run-off cover for claims arising from activities of retiring /
retired practitioners and practitioners who leave the practice or who have previously
left the practice for any reason. The run off cover is limited to activities of the
practitioners whilst acting within their role as an employee or partner of Clayton Utz
and in connection with the legal practice of Clayton Utz.
(b) The legal practitioners that are covered by this exemption must provide the Law
Society Northern Territory with a copy of the terms of the alternative professional
indemnity insurance and provide evidence to the Law Society Northern Territory
that they are covered by this alternative professional indemnity insurance. Such
confirmation must specifically confirm by the statement the run-off provisions are
provided in accordance with the above and it is the responsibility of Clayton Utz to
confirm the extent of such coverage.

Society Northern Territory with written confirmation that legal practice in the
Northern Territory is covered by the policy.

Authorised Operators of Prescribed
Breath Analysis Instrument
I, Joanne Foley, Commander, Professional Development Command, in pursuance of
regulation 59 of the Traffic Regulations, being of the opinion that each member of the
Police Force whose name appears in the attached Schedule is: (a)
trained in the use of a prescribed breath analysis instrument known as
the Drager Alcotest 7110; and
(b)
capable of using that prescribed breath analysis instrument correctly,
Authorise those members of the Police Force to use that prescribed breath analysis
instrument for the purpose of the Traffic Act.
