We approve the Regulations on Wildlife Trade (appended). 2. We repeal Order No. 517 “On Approval of Import, Export, Transportation and Trade Arrangements for Wild Animals, Their Parts and Derivatives” of the Minister of Environment of 22 October 2001 (Official Gazette, 2001, No. 91-3201). 3. “Fauna” shall be the guiding keyword in the information computer system of the Ministry of Environment. GENERAL PROVISIONS 1. The Regulations on Wildlife Trade (hereinafter referred to as Regulations) regulate purchase, sale, exchange, import into the Republic of Lithuania, export from it or transit through the territory of the Republic of Lithuania (hereinafter referred to as import (export), trade) of wild animals living in the wild, kept in captive, whether dead or alive (hereinafter referred to as animals), their easily identifiable parts or derivatives of wild animals (hunting and fishing trophies, eggs, caviar, raw and dressed furskins, stuffed animals, other zoological collectors’ items, goods, products and preparations included in the list of Annex 1 to the Regulations (hereinafter referred to as animals, their parts and derivatives) as well as authorization and control procedures regarding import (export) of, trade in these objects. Wildlife trade also includes any swaps or exchange of animals, their parts and derivatives, also holding of them in captivity and their display for the purpose of obtaining income therefrom. Requirements of the Regulations are mandatory for all natural and legal persons in the Republic of Lithuania. 2. The Regulations shall not be applicable when regulating: 2.1. commercial fisheries for salmon in the Baltic Sea regulated by the Law on Fisheries (Official Gazette, 2000, No. 56-1648); 2.2. use of resources of edible snails – collection, purchase, sale, processing and export. This activity is regulated under the Procedure for the Use of Resources of Edible Snails approved by Order No. 85 of the Minister of Environment of the Republic of Lithuania of 1 March 2002 (Official Gazette, 1999, No. 1-34; 2002, No. 27-977); 2.3. import (export) of dead animals, their parts and derivatives if they are personal or household effects constituting or meant to constitute a part of personal movable property. This exception shall not be applicable unless otherwise provided by international agreements or conventions in force in the Republic of Lithuania; 2.4. use of fossil (whether fossil or currently already extinct on the Earth) animals, their parts and derivatives. 3. Documents confirming the legal purchase of animals, their parts and derivatives in the Republic of Lithuania are: 3.1. a permit to hunt game or a counterfoil of this permit – for game which is subject to a permit under the Regulation on Hunting in the Republic of Lithuania approved by Order No. 258 of the Minister of Environment of the Republic of Lithuania of 27 June 2000 (Official Gazette, 2000, No. 53-1540); 3.2. fishing permits (limits) or extracts from these fishing logbooks – for fish and crustaceans; 3.3. certificates or acts confirming breeding in captivity issued by a corresponding unit of the Regional Environmental Protection Department of the Ministry of Environment - for animals bred in captivity; 3.4. a permit for wild animals to be taken from natural habitats issued by the Ministry of Environment, if such a permit to take them is required by requirements of the Law on Wildlife (Official Gazette, 1997, No. 108-2726; 2001, No. 110-3988), Law on the Protected Fauna, Flora and Fungi Species and Communities (Official Gazette, 1997, No. 108-2727, 2001, No. 110-3987) or other legal acts; 3.5. purchase and sale documents specifying exact features and quantity of purchased animals, their parts and derivatives; 3.6. other documents laid down by laws. 4. The procedure for holding of wild animals in captivity and their display for the purpose of obtaining income therefrom is established by the Procedure for the Issue of Permits to Establish Zoos and for the Management and Control of Zoos approved by Order No. 298 of the Minister of Environment of the Republic of Lithuania of 4 June 2002 (Official Gazette, 2002, No. 62-2540), the Regulations on Captivity of Wild Animals approved by Order No. 519/449 of the Minister of Environment of the Republic of Lithuania and the Director of the State Food and Veterinary Service of the Republic of Lithuania of 2 October 2002 (Official Gazette, 2002, No. 100-4456), the Procedure for Taking Wild Animals from Habitats for Zoological Collections and Registration of These Collections approved by Order No. 250/224 of the Minister of Environment of the Republic of Lithuania and the Director of the State Food and Veterinary Service of the Republic of Lithuania of 16 May 2002 (Official Gazette, 2002, No. 60-2478) and other legal acts. 5. When importing (exporting) animals, their parts and derivatives as well as when trading them, it shall be necessary to follow requirements laid down by the Regulations on Transport of Animals approved by Order No. 4-165 of the Director of the State Food and Veterinary Service of the Republic of Lithuania of 21 June 1999 (Official Gazette, 1999, No.58-1911) and other legal acts. II. DOMESTIC TRADE IN ANIMALS, THEIR PARTS AND DERIVATIVES 6. It shall be prohibited to trade in animals, their parts and derivatives without permits if the species are: 6.1. listed among protected fauna, flora, fungi species in the Red Book of Lithuania approved by Order No. 306 of the Minister of Environment of the Republic of Lithuania of 20 July 2000 (Official Gazette, 2000, No. 66-1998); 6.2. mentioned in Annexes 1-3 to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (hereinafter referred to as CITES Convention) (Official Gazette, 2001, No. 50-1741); 6.3. capable of a detrimental environmental, economic effect, of causing or transmitting diseases. 7. In order to trade in animals, their parts and derivatives specified in Paragraph 6 of the Regulations, it shall be necessary to get a permit in a form prescribed by Annex 4 to the Regulations. In case of trading in such animals, their parts and derivatives imported into the Republic of Lithuania, a permit to import equates to a permit to trade in them (a permit shall bear a corresponding seal of the customs office certifying that animals, their parts and derivatives have been imported), with the exception of cases when under requirements of CITES Convention a permit to import these animals, their parts and derivatives into the Republic of Lithuania can only be issued in cases when they are imported for non-commercial purposes. Permits to trade in animals, their parts and derivatives shall be kept in a place of trade in them. In case of multiple places of trade, places of trade shall have copies of the permit, and the permit shall specify all places of trade. 8. It shall be permitted to trade in species of animals, their parts and derivatives mentioned in Paragraph 6.1 of the Regulations and issue permits only to legal persons that have bred these animals in captivity and are complying with requirements of the Law on the Care, Keeping and Use of Animals (Official Gazette, 1997, No. 108-2728) for keeping and transport of these animals. 9. Natural or legal persons possessing documents certifying their purchase provided for in Paragraph 3 of the Regulations can enjoy free domestic trade in animals, their parts and derivatives which are not specified in in Paragraph 6 of the Regulations. III. IMPORT (EXPORT) OF ANIMALS, THEIR PARTS AND DERIVATIVES 10. When importing (exporting) animals, their parts and derivatives specified in Paragraph 6.2 of the Regulations, it shall be necessary to produce a one-time CITES Convention permit (hereinafter referred to as CITES permit) for import, export or re-export in a form prescribed by Annex 2 to the Regulations. 11. When importing (exporting) animals, their parts and derivatives which are not specified in Paragraph 6.2 of the Regulations, it shall be necessary to produce a permit in a form prescribed by Annex 3 to the Regulations. 12. A separate permit shall be produced for each consignment of animals, their parts and derivatives being imported (exported). 13. It shall be permitted to import (re-import, submit for release for free circulation or customs procedures for temporary import) into the Republic of Lithuania and (or) export (submit for outright exportation or temporary export customs procedures or re-export customs-approved treatment or use applied for) from it animals, their parts and derivatives only having produced permits specified in Paragraphs 10 and 11 of the Regulations. 14. When transiting animals, their parts and derivatives through the territory of Lithuania from one customs office in a state border crossing point to another customs office in a state border crossing point, permits specified in this section are not produced. IV. PRODUCTION OF DOCUMENTS FOR PERMITS TO IMPORT (EXPORT) ANIMALS, THEIR PARTS AND DERIVATIVES AND TO TRADE IN THEM 15. Permits prescribed by Paragraphs 7, 10 and 11 of the Regulations are issued by: 15.1. The Ministry of Environment – a CITES permit to import (export) animals, their parts and derivatives in a form prescribed by Annex 2 to the Regulations, filled in Lithuanian and English, also a permit in a form prescribed by Annex 3 to the Regulations if other animals, their parts and derivatives are to be imported (exported) together with animals, their parts and derivatives specified in Paragraph 6 of the Regulations or if a person intending to import (export) animals, their parts and derivatives is willing to do it; 15.2. Regional Environmental Protection Departments (according to the place of residence of an applicant or according to a place of trade) – a permit to import (export) animals, their parts and derivatives in a form prescribed by Annex 3 to the Regulations, also a permit to trade in animals, their parts and derivatives in a form prescribed by Annex 4 to the Regulations. 16. Natural and legal persons applying for a permit to import (export) animals, their parts and derivatives shall have to produce the following documents to authorities specified in Paragraph 15: 16.1. an application specifying name and surname, personal code of a natural person importing (exporting) (for a legal person - name, company code), address, Lithuanian and (or) scientific (Latin) names for animals species being imported (exported), their quantity, sex (for animal parts and derivatives names of derivatives, Lithuanian and (or) scientific (Latin) names for animal species they are produced from), country of origin, means and conditions of transportation, purpose of import (export), date or period (in case of temporary import (export); 16.2. original documents and their copies certifying the legal purchase. 17. In cases laid down by CITES Convention, when producing documents for a CITES permit to import into the Republic of Lithuania or export from it animals, their parts and derivatives, it shall be necessary to produce an analogous permit to import (export) these animals, their parts and derivatives issued by competent authorities of a foreign country from which these animals, their parts and derivatives are being exported or into which they are being imported. 18. In order to get a permit to trade in animals, their parts and derivatives mentioned in Paragraph 6 of the Regulations, it shall be necessary for legal persons to produce the following documents to the Regional Environmental Protection Department: 18.1. an application specifying name, company code and address of a legal person, Lithuanian and (or) scientific (Latin) names for animals species to be sold or purchased (in case of animal parts and derivatives - name of a derivative, name of an animal species it is produced from), exact quantity of animals, their parts and derivatives to be sold or purchased, origin, intended conditions and place for holding of live animals, also records of markers provided for in Paragraph 24.3 of the Regulations; 18.2. original documents and their copies certifying the legal purchase and specified in Paragraph 3 of the Regulations. 19. Foreign natural and legal persons can also produce documents for permits specified in Paragraphs 10 and 11 of the Regulations by applying to diplomatic missions, consular posts or the Ministry of Foreign Affairs of the Republic of Lithuania. V. ISSUE OF PERMITS TO IMPORT (EXPORT) ANIMALS, THEIR PARTS AND DERIVATIVES AND TO TRADE IN THEM 20. Authorities specified in Paragraph 15 of the Regulations issue a permit to import (export) animals, their parts and derivatives or to trade in them or notify an applicant by means of a motivated letter about the refusal to issue a permit within 10 working days. 21. Permits in a form prescribed by Annexes 2 and 3 to the Regulations are issued in three copies: the first copy for a person importing (exporting) animals, their parts and derivatives; second – for the customs; third – for the issuing authority for control purposes. A permit in a form prescribed by Annex 4 to the Regulations is issued in two copies: the first copy for a person intending to trade in animals, their parts and derivatives; second – for the issuing authority for control purposes. Issued, surrendered and revoked permits are registered in the issuing authority in accordance with an established procedure. 22. The period of validity of a permit to import (export) animals, their parts and derivatives or to trade in them is subject to requirements of CITES Convention or documents specified in Paragraphs 16, 17 and 18 of the Regulations, though it shall not exceed 6 months for a permit to import (export) and 24 months for a permit to trade. In both cases, the period of validity is calculated from the date of issue of a permit. Having obtained permits specified in Paragraphs 7, 10 and 11 of the Regulations, persons cannot authorize other persons in their names or under a contract transfer the activity authorized by permits to other persons. 23. At the request of an applicant (if indicated in an application for a permit), an issued permit can be sent by registered mail. 24. Permits to import (export) and (or) to trade in animals, their parts and derivatives are not issued if: 24.1. not all documents provided for in Paragraphs 16, 17 and 18 of the Regulation have been produced or they are not duly completed; 24.2. animals taken from natural habitats, being kept, bred, transported and used in violation of requirements of the Law on Wildlife, the Law on the Care, Keeping and Use of Animals, the Regulations and other legal acts regulating the protection, use and care of wildlife; 24.3. species of animals, their parts and derivatives included in Annex 1 to CITES Convention do not have markers (a ring, microchip with an original number or any other markers) which could be hard to remove or counterfeit and would be possible to read. 25. A permit to import animals, their parts and derivatives is not issued if: 25.1. its issue would contradict the Procedure for the Suspension of Import of Some Species of Wild Fauna and Flora into the Republic of Lithuania approved by Order No. 508 of the Minister of Environment of the Republic of Lithuania of 4 October 2001 (Official Gazette, 2001, No. 90-3181); 25.2. animals, their parts and derivatives to be imported are mentioned in Paragraph 6.3 of the Regulations. 26. Permits to import (export) and (or) to trade in animals, their parts and derivatives and (or) documents certifying the illegal purchase are mandatory when holding, transporting, displaying, collecting these animals, their parts and derivatives, trading in them and using them for other purposes. 27. The issuing authority can revoke permits to import (export) and (or) to trade in animals, their parts and derivatives for violations of requirements laid down by the Regulations by notifying in writing the Ministry of Environment and in case of import or export – the Customs Department under the Ministry of Finance. An invalid permit shall be returned to the issuing authority. VI. CUSTOMS CLEARANCE FOR PERMITS 28. The customs controls and formalities regarding animals, their parts and derivatives being imported (exported) are performed in accordance with the procedure laid down by laws and other legal acts. 29. In cases specified in Paragraph 10 of the Regulations, it shall be necessary to produce a corresponding CITES permit to the customs office together with the customs declaration or other document for the customs clearance of import (export) of goods. 30. When importing (exporting) animals, their parts and derivatives mentioned in Paragraph 6.2 of the Regulations, a customs officer of the customs office in a state border crossing point through which this consignment is being imported (exported), in addition to the customs declaration, fills in Box 13 of an original CITES permit produced and its copy meant for the customs office in which he indicates the actual number or quantity of animals, their parts and derivatives being imported (exported) specified in the permit and indicates the date of import (export). Unused sections of this box are struck out. Box entries are certified by the signature of the customs officer who made them, personal seal and seal of the customs office. Having performed these actions, one copy of a CITES permit to import, export or re-export is returned to a person importing (exporting) animals, their parts and derivatives, the second copy is faxed (to a number specified in a permit) to the issuing authority and remains in the customs office. When importing (exporting) other animals, their parts and derivatives mentioned in Paragraphs 6.1 and 6.3 of the Regulations, also live animals listed in Paragraph 1 of Annex 1 to the Regulations, a customs officer of the customs office in a state border crossing point through which this consignment is being imported (exported), in addition to the customs declaration, fills in the box reserved for customs of an original permit in a form prescribed by Annex 3 to the Regulations produced and its copy meant for the customs office in which he indicates the actual number or quantity of animals being imported (exported) specified in the permit and indicates the date of import (export). Box entries are certified by the signature of the customs officer who made them, personal seal and seal of the customs office. Having performed these actions, one copy of a permit to import, export or re-export animals is returned to a person importing (exporting) animals, the second copy remains in the customs office. 31. When transiting animals, their parts and derivatives mentioned in Paragraph 6.2 of the Regulations through the territory of the Republic of Lithuania, CITES permits issued by authorities of other countries in accordance with the procedure laid down by CITES Convention shall be produced. VII. CONTROL OF IMPORT (EXPORT) AND TRADE IN ANIMALS, THEIR PARTS AND DERIVATIVES 32. The control of import (export) and trade in animals, their parts and derivatives is performed by the Ministry of Environment, the State Environmental Protection Inspectorate, Regional Environmental Protection Departments, their district agencies, the Customs Department under the Ministry of Finance of the Republic of Lithuania and the State Food and Veterinary Service within their respective competences. 33. Animals, their parts and derivatives from wild animals can be imported into the state territory and exported from it only in accordance with the procedure laid down by the Regulations on Activities of Border Inspection Posts approved by Resolution No. 126 of the Government of the Republic of Lithuania of 2 February 2001 (Official Gazette, 2001, No. 12-346). VIII. SEIZURE AND CONFISCATION OF ANIMALS, THEIR PARTS AND DERIVATIVES 34. Animals, their parts and derivatives can be seized, returned into the country of export or confiscated in cases when they are being imported (exported) or they are traded in violation of requirements of these Regulations, besides: 34.1. an attempt is made to import, export, re-export or trade in animals, their parts and derivatives without a prescribed permit, having produced a falsified, invalid permit, a permit issued for other animals, their parts and derivatives or other document; 34.2. non-compliance with conditions specified in an issued permit; 34.3. obtaining a permit by providing misleading information; 34.4. transportation or holding of live animals without their proper preparation, which endangers their health or does not reduce the threat of their injury or torture; 34.5. violation of requirements of the Regulations on Transport of Animals and other legal acts. 35. Animals, their parts and derivatives being imported into the Republic of Lithuania or exported from it in violation of provisions of the Regulations are seized or confiscated in accordance with the procedure laid down by laws and other legal acts of the Republic of Lithuania. In case the customs office seizes a consignment of animals, their parts and derivatives being imported (exported), it immediately notifies the Ministry of Environment. In case of the seizure of live animals, the Ministry of Environment takes all measures required to organize the transportation of seized animals to special places adapted for holding (keeping) of them. The risk and expenses of such transportation of animals, their parts and derivatives lie on a person who had the intention to import (export) the seized consignment. 36. In case the consignee does not recognize it is the recipient of animals, their parts and derivatives (the consignee repudiates the goods), these goods shall be returned to the consignor (to the place they were brought from). 37. In case of any concerns with regard to animals, their parts and derivatives being imported (exported), customs officers can contact the Ministry of Environment and, pursuant to Resolution No. 261 “On Implementation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora” of the Government of the Republic of Lithuania of 20 February 2002 (Official Gazette, 2002, No. 20-767), - Botanical and Environmental institutes. IX. LAIBILITY FOR VIOLATIONS OF REGULATIONS 38. Having violated requirements of the Regulations, natural and legal persons importing into the Republic of Lithuania, exporting from it, transporting animals, their parts, derivatives or trading in them shall be liable in accordance with the procedure laid down by laws of the Republic of Lithuania. 39.
