Exemptions) Regulations 2014

The Governor in Council makes the following Regulations:

1 Objective

The objective of these Regulations is to exempt certain transport bodies from the requirement to be accredited under the Rail Safety National Law

(Victoria).

2 Authorising provision

These Regulations are made under section 52 of the Rail Safety National Law Application Act

2013 .

3 Commencement

These Regulations come into operation on 19 May

2014.

4 Definitions

In these Regulations—

Public Transport Development Authority has the same meaning as in the Transport

Integration Act 2010 .

5 Transport bodies exempt from accreditation

The following transport bodies are exempt from the requirement to be accredited under Division 4 of Part 3 of the Rail Safety National Law

(Victoria) until the third anniversary of the commencement of these Regulations—

(a) the Public Transport Development

Authority;

(b) the Secretary to the Department of Transport,

Planning and Local Infrastructure.

6 Emergency response rolling stock operators exempt

A rolling stock operator who only operates rolling stock that is an emergency response vehicle is exempt from the requirement to be accredited under Division 4 of Part 3 of the Rail Safety

National Law (Victoria) until the third anniversary of the commencement of these Regulations in respect of the following rolling stock operations—

(a) use of the rolling stock in an emergency or rescue operation;

(b) use of the rolling stock for training for emergency or rescue operations;

(c) testing of the rolling stock.
