Cooled Transported Semen Breeding Contract

This agreement is made and entered into this ____ day of _____________ 20___, in the state of Oklahoma between JW
Performance Horses hereinafter referred to as “Stallion Owner” and _______________________ hereinafter referred to as “Mare
Owner”.
Mare Owner agrees to breed above stated mare by Cooled Transported Semen to Streakin Pac Bar standing at Pride Farms for the
2014 Breeding Season March 1st through July 1st – No Exceptions.
The Stallion Fee is $1,000 which includes a non-refundable booking fee of $250 and is due with this contract to reserve breeding.
Remaining balance of stud fee is due prior to ordering semen. Shipped semen fee is $250 per shipment and must be paid for in
advance before semen will be shipped.
Mare Owner is responsible for the return of the shipping container. Stallion owner is not responsible for non-delivery or late
delivery by FedEx or airlines. Counter-to-Counter airport shipments are available at an additional charge. Please contact for current
pricing. FedEx deliveries can be made on Saturdays in some locations or can be arranged to pick-up at a local FedEx counter in your
area.
Collection days are every Monday, Wednesday and Friday. Priority is given to Mare Owners who are booked earlier with at least 24
hour notice. Semen must be ordered by 8pm Central time the day before the semen needs to be sent. We cannot guarantee a
shipment on orders placed beyond that deadline. Cancellation of the shipment must be made no later than 10am central time on
the day the shipment was to be sent. To order semen please call 605-350-7899 and leave a voicemail if no answer. We will call you
back to confirm that we got your order.
Mare Owner represents that the above mentioned mare is in sound breeding condition. A copy of said mare’s registration papers
must accompany this agreement. The owner of the horse as shown on the registration papers will be the recorded owner on the
stallion breeding report.
This agreement contains a “LIVE FOAL GUARANTEE” A live foal is a newborn foal which stand sand nurses without assistance. Mare
Owner must contact Stallion Owner within 24 hours if the mare did not produce a live foal. Mare owner must use appropriate
diligence and ciare in conducting the breeding or Stallion Owner has the right to revoke the re-breeding privileges. Re-breeding will
be honored for the following season only using any mare the Mare Owner chooses and a $100 re-breeding fee will apply as well as
shipped semen fees.
Mare Owner will use his or her best reasonable efforts to settle mare. If the mare does not settle however, Mare Owner will not
hold Stallion Owner liable for any loss or damage. Semen is evaluated for quality prior to shipment.
Should stallion die, become unfit for service, or be sold by owner prior to mare settling, this agreement shall become null and void
and all parties will be relieved from further obligations. Breeding fees less the booking fee will be refunded if stallion fee has been
paid in full.

1. The stallion fee of $__500_, plus shipped semen fees of $200.00 which must be paid in advance, or prior to shipping.
Additional shipments will also be paid in advance at the cost of $200.00 per shipment, and require the semen container
to be returned to the farm. To reserve a booking, the amount of $400(applied towards the breeding fee) is payable and
must be returned with this contract. Booking fee is non-refundable.
2. Priority in semen transport will be given to those who book earliest and who give 24 hour notice. Cancellation must be
made by 10am, on the shipping day.
3. Overnight shipping charges- FED –EX & semen container fee are paid for by the farm and included in shipment fee.
Please send the container back to the farm. THE FARM IS NOT RESPONSIBLE FOR NON-DELIVERY or LSTE DELIVERIES by
FED EX or airlines. We do offer counter-to-counter airport shipment for an additional charge, contact the farm for
pricing. FED EX does deliver on Saturdays to certain locations or you may pick up at the FED EX counter in your area.
4. A Live Foal Guarantee will apply(a live foal is a foal that will stand and suck) It is highly recommended that your mare
be vaccinated for Rhino at the scheduled times of pregnancy. Return breeding under the live foal guarantee will be
honored the following breeding season only, using any mart the client chooses. A $100.00 rebreed fee will apply.
5. Live Foal Guarantee by stallion owner will be void and stallion will be released from all liability if stallion dies or
becomes unfit for service. It is further understood that should the stallion die, be sold by owner, or become unfit for
service prior to settling the mare, this contract shall become null and void and your breeding fee less the booking fee will
be returned if it has been paid in full.
6. JW Performance Horses shall not be liable as a result of damage to the semen or as a result of a mare failing to settle.
All semen is evaluated for quality prior to shipment.
7. This contract shall be binding upon the parties hereto, upon execution here of and the same may not be altered or
amended, except by written consent of the parties hereto.
8. A copy of the registration papers on your mare must accompany this signed and returned contract. Owner recorded
on the registration certificate will be the recorded owner on the stallion breeding report.
9. The parties acknowledge that this agreement is made, and shall be considered to be entirely performed within the
State of Oklahoma and shall be construed and enforced under the laws of the State of Oklahoma.
