EVERGLADES DAY PHOTO CONTEST October 17 through November 28, 2015 Official Rules ELIGIBILITY The Everglades Day Photo Contest (“Photo Contest”) is open to ages 18 years of age and older. Employees of Broward County Parks and Recreation Division ("Division") are not eligible to enter. SPONSOR The Photo Contest is sponsored by Broward County through the Division, located at 950 N.W. 38th St., Oakland Park, FL 33309 (“Sponsor”). ENTRY PERIOD The Photo Contest begins at noon EST on Saturday, October 17, 2015, and ends at noon on Saturday, November 28, 2015 (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Photo Contest. WHAT TO ENTER The mission of the Division is Recreation. Preservation. Education. Photographs should depict the Everglades in support of one of these three words: 1. Recreation; 2. Preservation; 3. Education. All entries must have a resolution between six million pixels (six megapixels) to 13 million pixels (13 megapixels). Larger files cannot be accepted. All photographs should accurately reflect the subject matter and the scene as it appeared while being photographed. Photographs that have been digitally altered beyond standard optimization (removal of dust, cropping, reasonable adjustments to exposure, color, and contrast, etc.) will be disqualified. Entries must be submitted electronically in a .jpeg or .jpg format. Multiple exposures that have been combined to produce a single high-dynamic-range image are acceptable. Previously published material for which non-exclusive rights were granted may be entered as long as you still maintain the right to grant the Division a royalty-free, non-exclusive right to use the photograph as described herein. You must be able to disclose when and where the photograph appeared previously to the Division upon request. If you choose to include people in your submission, you are responsible for obtaining the necessary releases from the individuals depicted, and must be able to provide copies of the signed releases to the Division, upon request. Please do not include the following: Photographs of pets, domestic animals, or captive animals. Photographs that violate or infringe upon another person’s rights including, but not limited to, any copyrights. Photographs that contain sexually explicit, nude, obscene, violent, or any objectionable or inappropriate content within the determination of the Division Director. Everglades Day Photo Contest Official Rules October 17-November 28, 2015 Photographs that depict the willful harassment of wildlife, damage to the environment by the photographer, or any individual or animal in danger. HOW TO ENTER All images must be submitted to EvergladesDayPhotoContest@Broward.org. Include your name, email, details about your image (when taken and where), and one of the three image categories – 1. Recreation. 2. Preservation. 3. Education. Entries must be received before noon, Saturday, November 28, 2015. You may enter an unlimited number of photographs, but you may not use an agency or automated system to enter. Sponsor reserves the right to reject any entry that does not comply with these Official Rules. By entering the contest, you indicate your unconditional agreement to, and acceptance of, these Official Rules and Sponsor’s decisions, which are final and binding. You cannot win a prize unless you comply with all requirements in these Official Rules. Entrants may be asked to supplement their submission (such as with a paragraph about their photograph or with a higher-resolution version of their photograph) any time after December 1, 2015. JUDGING Photographs will be judged on originality, technical excellence, composition, overall impact, artistic merit, and how well the subject matter depicts the category choice (1. Recreation; 2. Preservation; 3. Education). The judges will consist of representatives of the Division selected by the Division Director. 1. Categories: a. Recreation (1 winner): Illustrates how people can enjoy the Everglades while protecting its environmental significance. b. Preservation (1 winner): Illustrates the unique beauty of the Everglades, including flora and fauna, and the importance of its protection. c. Education (one winner): Illustrates how and what people can learn about the Everglades. d. People’s Choice (1 winner): Overall winner selected from among up to 10 Honorable Mentions based on the highest number of votes received during public voting to be held in January 2016 on the Division's Website at Broward.org/Parks. e. Honorable Mentions (up to 10 winners): Images that showcase and illustrate moments of life and its interaction with the Everglades. Up to 10 Honorable Mention winners will be notified of their status approximately 10 days prior to the voting, and all images will be posted on Broward.org/Parks and/or Facebook.com/BrowardCountyParks by January 2, 2016. At that time, the public can vote for one People’s Choice winner from the up to 10 Honorable Mentions. All potential winners will be revealed online by February 11, 2016. All judging decisions are final. Please do not contact the Division about the status of entries or judging. The Division will notify the winners via the contact information provided at the time of entry. 2 of 4 Everglades Day Photo Contest Official Rules October 17-November 28, 2015 PRIZES The Division will award the following prizes: Overall winner: A one-year Family Parks Passport valued at $60 A one-year Seasonal Aquatics/Water Park Pass (for up to six family members) valued at $228 Mention in Highlights and Nearby Nature, the Division’s award-winning monthly epublications Mention in media release distributed to local and national publications Photograph placement and announcement on the Division’s Photo Contest page Total Value: $288 Three Category winners will receive: Choice of a one-year Family Parks Passport valued at $60 or a seasonal Silver Aquatics Water Park Pass (for up to six family members) valued at $64 Mention in Highlights and Nearby Nature, the Division’s award-winning monthly epublications Mention in media release distributed to local and national publications Photograph placement and announcement on the Division’s Photo Contest page Total Value: Up to $64 The Honorable Mention winners will receive: A one-year Individual "Find It All Card" Parks Passport valued at $25 Mention on the Division’s Photo Contest page Total Value: $25 Prizes will be mailed only to an address in the U.S. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion. YOUR RIGHTS Thank you for helping to further the Division’s mission through your photography. You will retain all rights to any photograph you submit, including ownership, if applicable. If you submit a photograph to enter the Everglades Photo Contest, you agree to grant the Sponsor a royalty-free, nonexclusive right to: Display the photograph on the Photo Contest submission Website (Broward.org/Parks/ThingsToDo/EvergladesDay/PhotoContest). Display the photograph on Facebook.com/BrowardCountyParks). Allow third parties to share the photograph on the following social media platforms: Twitter, Facebook, and Pinterest. If your photograph is formally honored by the competition as a Winner or an Honorable Mention, you agree to grant 3 of 4 Everglades Day Photo Contest Official Rules October 17-November 28, 2015 the Sponsor a royalty-free, nonexclusive right, in perpetuity, to: Use the photograph on the Internet and in social media in support of our mission. Use the photograph in the Division’s internal and external communications materials including but not limited to Websites and Web publications, fact sheets, fundraising publications, advertising, multimedia, presentations, annual report, and the Division's magazines. Provide your photograph to other individuals and organizations for the Division's related use in news stories, newsletters, reports, slide shows, displays, Web pages, videos, membership premiums, and the like. Use, in connection with the Photo Contest, your name, city, and state in promotions and other publications. Retain a digital copy of your photograph that will be archived in the Division’s photograph library and accessible to the Division staff via the internal online photograph archive. The Division will endeavor to credit all photographs with the photographer’s name when the full name is available. RELEASE, INDEMNITY, AND WAVIER OF LIABILITY By entering the Photo Contest, you agree to release, waive, discharge, and covenant not to sue Sponsor and each of their respective officers, employees, agents, and volunteers (all for the purposes herein referred to as the "Releasees") from any liability or claims you might assert for damages sustained by you resulting directly or indirectly in connection with participation in the Photo Contest or receipt or use of any prize whether caused in whole or in part by the negligence of the Releasees including, but not limited to, (a) unauthorized human intervention in the Photo Contest; (b) technical errors; (c) printing errors; (d) late or undelivered mail; (e) errors in the administration of the Photo Contest; or (f) injury or damage to persons or property. You further agree to indemnify and hold harmless the Releasees from any and all liability, including all fees and costs, resulting from claims, causes of action, or losses sustained by third parties arising out of actions or alleged actions in connection with your participation in the Photo Contest.
