In this catalog, we have provided a summary of all the skills you will learn and many common questions. Mission Statement At the Institution of Advanced Styles, we are dedicated to helping those passionate about advancing into a career of Cosmetology. T.I.O.A.S’s mission is to prepare each student who attends to meet requirements to take the Florida state exam for a Cosmetology license. During the scheduled evening program, the 1595 square foot salon floor is now your studying platform. At T.I.O.A.S you will have your own study desk and all the necessary equipment to complete the program, including but not limited to, shampoo bowls, dryers, nail station, waxing and facial area. (Smoking is permitted outside) Admissions It’s highly recommended that you visit our location and meet with our staff to determine if this program is right for you. We are looking for serious, dedicated students that want the education and training to help build their careers or their own businesses in the hair industry. Our goal is to help you reach and complete your goals to receive your diploma within 16 months. First step is to schedule an appointment to come meet the instructor, complete all necessary documents, and find out if you meet all requirements and if this program is right for you. Financial Aid Application Information All students are entitled to fill out the Free Application for Federal Student Aid (FAFSA). We make admissions decisions based on eligibility that are outlined below. 2 The Institution of Advanced Styles Admissions Requirements T.I.O.A.S begins new classes annually and quarterly. You may begin the application process at any time. Classes are limited to 8 students. Acceptance is based on first come, first serve order. If you drop your class in the middle of a program you will be placed in the next available student opening. Wait time will vary depending on registered students. Once you have scheduled your introduction tour, you can expect to need the following: Submit documentation showing that you are at least 16 years of age (birth certificate, Driver’s license, State ID, passport) Submit documentation demonstrating award of a high school diploma, equivalent educational attainment (high school diploma or transcript, GED certificate) –OR- Pass Ability to Benefit entrance exam provided independently by Wonderlic with a 76% or higher. http://www.wonderlic.com/assessments/skills/basic-skills-test-ability-to-benefit Phone - 1.877.605.9496 (must provide certificate of completion with passing grade) Sign and complete Enrollment Agreement and pay the enrollment processing fee ($100) Vaccinations Policy T.I.O.A.S will comply with federal, state, and local laws regarding student vaccination requirements. More information about vaccinations can be obtained from your state public health department or your doctor. Applying as a Transfer Student T.I.O.A.S holds high standards and we do not recruit students admitted to, or currently attending other schools offering similar programs. However, we do accept applications from students who need to complete their hours and/or services to qualify to take their state board exams to become licensed in cosmetology. We do accept transfers of hours and services. You must provide all documents proving your hours, courses, test scores and practical services completed in the cosmetology course and they must be validated before completing the enrollment process. All documentation must be received, reviewed and accepted before your enrollment can be completed. TRANSFERRING YOUR CREDITS TO AN INSTITUTION IS BASED ON THEIR POLICIES OF ACCEPTANCE. Quizzes and Testing T.I.O.A.S testing includes quizzes, check- offs, and final exams. During a “check-off” you will be evaluated in your performance of the services, based on whether you complete the key components of the service in a timely manner, in accordance with the curriculum, and in compliance with sanitation and sterilization rules. Transferred student credits and hours are accepted. All transfer students will still have to take all the written tests and check-offs throughout the entire course. This is to assure during the previous program you were attending, you were thoroughly provided the proper skills and curriculum at our standard. If you pass our tests, there will be no further requirement for the chapter being tested on, unless there are incomplete services and/or hours. If you score lower than a 76% C (standard grading scale) additional services, and/or study packets or check –offs may be required. Additionally, we reserve the right to deny any transfer credits from your prior program if those services and hours were completed more than 4 years prior to the date of enrollment. In the event that you withdraw or are terminated from T.I.O.A.S, all services and hours will be documented, copied, and given to the student. Acceptance into other programs and credits will be 3 The Institution of Advanced Styles based on the other programs standards and policies. T.I.O.A.S uses The Milady standard Cosmetology Text book as guide lines for studying and testing. If you have previously attended an esthetician or nail-technician/manicuring program, you may receive full credit for services and hours upon completed the mandatory study packets and tests with passing grades. Your esthetician or nail technician/manicuring license must remain active throughout your enrollment at The Institution of Advanced Style or your transferred credits will be revoked. Occupational Demands We are committed to equal opportunity, no student will be denied admission based on membership in a protected group. It is our guarantee to teach our students the skills necessary for success in the hair industry. In order for you to participate in the program and receive the full benefit of the education delivered, there are certain physical demands that you must be able to meet. Specifically, to perform the essential requirements of the cosmetology curriculum, you must have the physical ability, with or without a reasonable accommodation, to: •Handle breathing in emitting odors, products, chemicals, fragrances, and aromas. • Stand and walk for up to 8 hours consecutively, except during 15-minute or 30-minute breaks • Manually handle, and manipulate objects or tools within the beauty industry • Must be able to move your body, using repetitive motions, as needed to all services within the hair industry. • Moving your arms and hands together at once, and at separate times. Coordination is important. • Lift up to 25 lbs. • Must be able to work with skin, standard within the skincare industry (e.g., facial and body skin care with massage, facial and body waxing, and makeup application) • View detail, and see colors, dimensions, and tones accurately. • Manually be able to perform hair-related services standard within the cosmetology industry (e.g., shampoo with massage, comb, haircut, hairstyle, hair color and chemical texturing, braid, sculpt, blow dry, etc.) • Perform services of nail-related services standard within the cosmetology industry (e.g., files, buff, clip, clean, and apply polish to nails and/or attach artificial nail products) If you may require an academic adjustment in order to meet these occupational demands, please review the Academic Adjustments Based on Disability Section of this catalog. 2014 Program Tuition & Costs You will be responsible to pay the tuition, (either in full or quarterly) enrollment processing fee, and kit fee as stated on your enrollment agreement. All fees are due at the time required documents are submitted to complete enrollment. The kit includes all the equipment. All supplies are salon quality and belong to the student once kit is paid for. Any tool or equipment damaged or broken beyond usage shall be replaced at the cost of the person/persons responsible for the damage. All students are required to purchase the kit to participate in the program. In the case a student would like to supply their own tools, the amount can be deducted from your kit fee according to the amount budgeted for the item. Kits purchased from T.I.O.A.S will have the appropriate sales tax applied. Full-Time Fees Starts in 2013 4 The Institution of Advanced Styles Tuition $5,400.00 - (Quarterly payments based on total cost of program and accepted are due on the 1st of every third month) Enrollment Processing fee $100 Kit $1,400.00 Additionally, students may be subject to these potential additional fees: Replacement textbook $125 Replacement laws and rules book(s) $15 Late payment fee $25.00 if tuition payment not received by 7th of the month T.I.O.A.S reserves the right to suspend attendance, and refuse to continue education until these fees are paid in full. We accept payments in cash, cashier’s check, Visa, MasterCard, or Discover. Refund and Cancellation Policy Should a student’s enrollment be terminated or cancelled for any reason, all refunds will be made according to the following refund schedule: 1. Cancellation can be made in person, by electronic mail, by Certified Mail or by termination. 2. All monies will be refunded if the school does not accept the applicant or if the student cancels within three (3) business days after signing the enrollment agreement and making initial payment. 3. Cancellation after the third (3rd) Business Day, but before the first class, results in a refund of all monies paid, with the exception of the registration fee (not to exceed $150.00). 4. Cancellation after attendance has begun, but prior to 40% completion of the program, will result in a Pro Rata refund computed on the number of hours completed to the total program hours. 5. Cancellation after completing 40% of the program will result in no refund. 6. Termination Date: In calculating the refund due to a student, the last date of actual attendance by the student is used in the calculation unless earlier written notice is received. 7. Refunds will be made within 30 days of termination of students’ enrollment or receipt of Cancellation Notice from student. BUYER’S RIGHT TO CANCEL A Student (in the case of a Student under legal age, his/ her parents or legal guardian) has the right to cancel his/ her Agreement in writing, before midnight of the sixth business day, after signing the Agreement to receive a refund of monies paid to date. The date the tuition and other fees were collected will determine the cancellation date according to the date the enrollment was completed. This policy applies regardless of whether or not the Student has actually started the program. Refunds of all monies paid will be refunded within 30 days. The Cosmetology program is 1200 hours. 60 minute clock hour with at least 50 minutes of instruction. The normal time to graduate is approximately 16 months in the full-time program. Our program has operating hours of 5pm-9pm Monday through Friday. Make-up hours can be credited during after or off hours. The institution will be closed for all major holidays and hours will not be credited. If there is a case of religion and students need specific days of absence, hours and services must be completed at a later time. If a student has completed his/her services, and only needs credited hours, they will still attend regularly, and assist on the salon floor. Students can challenge the board at 1000 clock hours if services are completed. 5 The Institution of Advanced Styles If a student must leave in the middle of the day, only the hours attended will be credited. During our evening program, students will study their chapters, prepare to test and use the knowledge to practice on mannequins or guests. No student shall accept money for any practical service performed on guests. However, the salon reserves the right to accept monies to compensate for products provided. Students are required to work on mannequins until they meet all state-hour requirements before they are permitted to perform services on guests, or live models. This program is only taught in English, however the state board exam and continuing education is offered in Spanish by third parties. Program Description Our students will start each day with theory and textbook work. Each student will study each chapter consecutively according to the Milady Standard Cosmetology Text Book. Tests will be given on each chapter as they are completed. No student will be able to move on to the next chapter if they do not pass the chapter test with a 76% or higher on a standard grading scale. Once each student passes the written test, they must pass the practical test, known as the check-off. During a check-off, each student will be expected to perform the specific service of study on live models or mannequins while being overlooked by the instructor. Students may not ask for help, or use their text book during the check-off. Timing will be determined based on the service. Students will be checked off only if service is completed to the standard of T.I.O.A.S and according to the Milady Standard Text book of cosmetology. Students must maintain a written log of their daily hours and services to be signed daily by the instructor. After each service performed on either mannequin or live model, it must be approved and signed at the time of completion by the instructor to obtain credit. Program Educational Objectives • To prepare students to pass the Florida state cosmetology licensing exam to gain licensing. • Teaching skills, professional behaviors needed for advanced entry-level work in a professional salon or related occupation. We will also teach how to build a strong client base and longevity in the hair industry. Areas of Study-Program Outline Our students will be ready to perform all areas of study upon completion their program. Our course codes are listed below and consist of an abbreviation of program name in order of study referencing the chapters and area starting from the beginning of the programs text book to the end. Grade Percentage A 93% - 100% B 85% - 92% C 75% - 84% D 65% - 74% F 64% and below All check-offs are required to complete a chapter. Text books are closed during demonstrations. Each demonstration is timed to show fluency. Your last service is your demonstration. If you do not pass the check- offs, you cannot complete your services. Chapter tests are given and must be passed before you qualify to check-off. We only allow 8 students at this time. This assures direct mentoring to each individual student to help them personally meet all their needs and requirements to complete the program. Students are updated on their progress daily. Program Completion & Graduation Final Exams Once you have completed all chapter tests, there will be a final exam based on the entire course. This will help you prepare for you state exam. You must pass the final exam with an 80% or higher to move on to test for the state board of cosmetology. The exam will be scheduled once all requirements for the program have been met. If there is an unpaid tuition balance, you will not qualify to take the final exam preventing completion of the program. If a student does not complete their hours, services, tests or exams, by their goal date, (18 months from enrollment date), they must pay additional tuition at a quarterly rate. Graduation Once you satisfy all of the requirements for completing the program, you will be awarded a diploma. You will then need to contact the Department of Business and Professional Regulation and schedule to 8 The Institution of Advanced Styles take you state board exam for licensing. There is a graduation ceremony for family and friends held on site once student passes the final exam. State Licensure Below states the Florida requirements for licensure as a cosmetologist: Must complete 1200 clock hours in an approved Cosmetology Program Must be 16 years of age Must have a high school diploma or G.E.D Must pass written theory and written clinical examination. If both parts of the test are not taken and passed within 2years, you will be required to retest both parts of the test. Must have completed HIV/AIDS –(In accordance with Florida Administrative Rule 61G5-18.011, each applicant for licensure or registration as a Cosmetologist shall complete a board-approved educational course on Human Immunodeficiency Virus (HIV) and Acquired Deficiency Syndrome (AIDS) and must submit proof in the form of a certificate of completion from the provider of the course with their application). We start each quarter on the 1st day of every 3rd month. Below is a regulated schedule. (Not including transferred students) January 1st – March 31st April 1st – June 30th July 1st- September 31st October 1st - December st 31 Transfer students can begin at the beginning of any quarter. Time & Attendance Policies Regular attendance is important to your success in the cosmetology program. T.I.O.A.S time policies and tools are designed to teach you the habits and skills that will help you complete your program and, more significantly, prepare you for success after graduation. The actions that will allow you to effectively manage your time are straight forward: • Clock your time, keep records of your hours • Be on time, make it a priority • Take your daily breaks, eat healthy • Attend regularly / manage your leaves from school Clocking Time In order to receive credit for all time attended, you must record your own time and have it signed off daily by your instructor. Each student and instructor will have their own log book to be signed daily. After each service completed, you must log your service, show your instructor and have it signed in your log book as completed. Students sign the instructor’s book to assure consistency and to avoid confliction at the end of the program. T.I.O.A.S will not tolerate consistent absences or tardiness. It is imperative to attend daily to achieve full understanding, gain the proper practical skills, and complete the program. When a student without notice exceeds 14 absents in a quarter, or a total of 84 hours has been exceeded, a formal revocation of the enrollment will occur immediately. On the 15th day or 85th hour. Students will receive a letter of suspension and no services or hours will be credited further until the suspension is lifted. Students will then have 30 regular calendar days to collect their personal items/kits, then will be placed behind other students waiting to enroll. Should there be an exception due to an uncontrollable circumstance, illness, disability, tragedy etc… arrangements will be made to make up all work, tests, hours, and check-offs missed. Proof of a death in the family or medical records may be requested and must be provided to be excused or have monies refunded. When a student is tardy, he or she only receives the hours they have attended. If the time is not exactly on the hour, it will be rounded to the lowest half hour. The official withdrawal or termination date for a student on an approved leave of absence, begins the day the absence begins. . 10 The Institution of Advanced Styles T.I.O.A.S grants two scholarships annually. We choose students randomly depending on order they apply, how many apply and if they qualify to complete the course. ***Each student has 84 hrs. Of personal hours, which is approx. 21 days, for the entire program. After these hours are used, students may be required additional enrollment fees and possible termination of the program. Please schedule vacations around our program calendar*** Administrative Leave Administrative leave may be taken in the event that an absence from school is required for military duty or jury duty. If you are called for jury duty, at your request the student services department will provide a letter notifying the court that you are enrolled with T.I.O.A.S, and stating that an absence for jury duty would have a negative impact on your training. If you wish to attend jury duty or if appeals to be released from duty are denied, you must provide the student services department with documentation from the court certifying the day(s) required for jury duty. These hours will not count against your personal excused absence hours. If you are called to military duty, you must likewise contact your instructor to provide T.I.O.A.S with documentation from the applicable military branch certifying the day(s) required for military duty. Student Withdrawals In the event that you withdraw from the program, your student record and log book will note the withdrawal and the reason for withdrawal, if known. Student Behavioral Expectations T.I.O.A.S expects its students to uphold high standards of integrity, professionalism, and honesty. Students who cheat on tests, seek unearned clock-hour credit, clock other students’ time, steal services, retail items, or equipment from our facility, or steal equipment or other items from other students, or stylists, may be terminated, prosecuted, or both. Drug and Alcohol-Free School Policy We support the public law that requires schools to provide a drug-free campus and workplace. The use and abuse of alcohol and other drugs can lead to physical and psychological health risks. These risks depend upon the type of drug used and the intensity of the use. Students are prohibited from the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance or alcohol anywhere on T.I.O.A.S property including grounds, parking areas, anywhere within the buildings or while participating in school-related activities. Students are also prohibited from being present on campus under the influence of alcohol or controlled substances. Students who violate this policy will be subject to disciplinary action up to and including termination of enrollment. If there is a reasonable suspicion that a student is under the influence of alcohol or a controlled substance while on the premises, the student will be required to clock out for the day and asked to leave. In any and all cases, T.I.O.A.S will abide by local, state, and federal sanctions regarding unlawful possession of drugs and the consumption of alcohol, including the full enforcement of applicable underage drinking laws. Any student who suspects that he or she or someone else may be at risk is invited to seek services that can be of help. T.I.O.A.S maintains drug and alcohol education information and a list of counseling and support services, including local services, which can be obtained from the instructor. 11 The Institution of Advanced Styles Title IV Implications of Illegal Drug Convictions Any students convicted of possessing or selling illegal drugs while receiving Title IV assistance will be ineligible for federal financial aid based on the chart below. If convicted of both possessing and selling illegal drugs and the periods of ineligibility are different, the longer penalty will apply. In addition, violations of federal, state, or local laws and ordinances concerning drugs and alcohol can lead to felony or misdemeanor convictions and legal sanctions, which include but are not limited to: fines, imprisonment, forfeiture of property, and loss of driving privileges. 1st offense 1 year from date of conviction 2 years from date of conviction 2nd offense 2 years from date of conviction indefinite period 3+ offenses indefinite period Violence Prevention Policy T.I.O.A.S does not tolerate threats by or against students, staff or guests. The Institution prohibits students from carrying, possessing, or using firearms and/or weapons while on school premises and while attending school-related events off premises. This policy applies to all students, including those with a valid permit to carry a firearm. Dress Code T.I.O.A.S requires students to come daily dressed in a professional manner. In addition, safety considerations and state regulations affect what we can reasonably permit you to wear. Accordingly, we have established guidelines for dress that apply to student whenever they are representing or attending our program, even when not clocked in or on a leave from school. Students are required to wear a solid black apron or barber jacket, clean and in good condition. Bottoms – (Black) Pants, capris, skirts, or dresses: • Cannot touch the floor • Skirts and dresses must be knee length or longer; slits no higher than the knee • Black leggings are allowed • No denim, sweatpants, scrubs, overalls or wind pants Tops- (any color): • Tops must be tucked in or over the hip; no midriffs or bare shoulders showing • No tank tops, camisoles, or sleeveless tops unless jacket is worn over. • No athletic or fleece sweatshirts Shoes: Black • Shoes should be clean, professional looking and protect the student’s feet • No sandals, Uggs, or open-toed shoes • Socks or hosiery are not required Accessories: Scarves, headbands and belts may be worn in any color. Student Compliance You are required to come to school in dress code and with the kit items required to perform the work scheduled for their session. You are also required to comply with all program practices and procedures regarding use of cell phones, other personal digital devices, and storage of personal belongings, and the like. Instructors will inform students of the practices and procedures that apply in our facility. Students in violation of these practices and procedures will be required to log out, leave the facility, and repeated violations may result in disciplinary action. 12 The Institution of Advanced Styles Photographs & Recordings You may not audio-record, video-record, or photograph a fellow student, an employee, or third party with whom you interact in the course and time of your enrollment without the knowledge and consent of that person. From time to time, T.I.O.A.S will take photographs, videos, and audio-recordings of program activities including its students, guests, and others for promotional or other purposes. If you wish not to be included in such photographs, videos, and audio-recordings, please notify your instructor for directions. Policy against Sex Discrimination & Sexual Harassment T.I.O.A.S Policy against Discrimination, Harassment, Bullying & Offensive Behavior prohibits sex discrimination and sexual harassment (including sexual assault). These terms are defined below, along with examples of types of conduct that may violate this policy. Sex Discrimination Sex discrimination means treating an individual or group less favorably than another based upon the sex or gender of that individual or group. For students, it involves conduct or statements that deny the student(s) an equal opportunity to fully benefit from our program and activities. For employees, it involves conduct or statements that deny the employee(s) an equal opportunity in employment. Sexual harassment is one form of sex discrimination. Sexual Harassment Sexual harassment is unwelcome conduct of a sexual nature. It includes unwelcome sexual advances, requests for sexual favors, and other verbal, nonverbal, or physical conduct of a sexual nature when: (1) submission to such conduct is made a term or condition of enrollment or employment; (2) submission to or rejection of such conduct is used as a basis for enrollment or employment-related decisions; or (3) such conduct has the effect of unreasonably interfering with school or work performance or creating an intimidating, hostile, or offensive environment. Sexual harassment also includes sexual assault, as defined below. 13 The Institution of Advanced Styles Sexual harassment is defined by the sexual nature of the conduct or communication, not the gender of the individuals involved. Therefore, it may be perpetrated by and against individuals of either gender, and between individuals who are of the same gender. The determination of what constitutes sexual harassment will vary with the particular circumstances. Uncivil conduct or common profanity generally do not meet the definition of sexual harassment, except where sexual in nature and so severe or pervasive as to deny or limit the individual’s ability to participate in or benefit from our program (in the case of a student) or to enjoy equal employment opportunity (in the case of an employee). A series of incidents may constitute sexual harassment, even if one of the incidents on its own would not rise to the level of harassment. At the same time, a single or isolated action may constitute sexual harassment when that action is sufficiently severe. While hostile-environment sexual harassment may encompass a wide range of conduct, some examples of specifically prohibited conduct includes: • Acts of verbal, non-verbal, or physical aggression, intimidation or hostility based on sex or sexually stereotyping • Use of offensive or demeaning terms that have a sexual connotation • Objectionable physical closeness, behavior, actions, or contact • Inappropriate or repeated suggestions regarding, or invitations to, social engagements or events, whether or not T.I.O.A.S-related • Suggestions, express or implied, that the terms or conditions of enrollment or employment\ may depend on the granting of sexual favors • Actions relating to a student’s or employee’s status with T.I.O.A.S which is in fact impacted by the grant or refusal of sexual favors • Jokes or remarks of a sexual nature • Showing or sending materials that have a sexual content or are of a sexual nature (such as cartoons, articles, pictures, etc.), either by e-mail, interoffice mail, internet or otherwise This list is not exhaustive. T.I.O.A.S reserves the right to determine whether particular conduct violates its Policy against Discrimination, Harassment, Bullying & Offensive Behavior, the Title IX policy (described below) or other policies. Sexual Assault Sexual assault is a form of sexual harassment. A range of conduct falls into the category of sexual assault, including without limitation sexual violence, sexual battery, sexual coercion, rape, or other sexual contact involving force, threat, or intimidation. Title IX Policy & Title IX Coordinator T.I.O.A.S is committed to complying with all laws that prohibit discrimination and harassment on the basis of sex in admission to, employment with, and otherwise in the operation of its educational program and activities. Among the applicable laws, Title IX of the Education Amendments of 1972 prohibits sex discrimination and sexual harassment by certain schools, including T.I.O.A.S. In compliance with Title IX, T.I.O.A.S is committed to ensuring that all its students have equal opportunity to benefit from our program and activities, and that all its employees enjoy equal employment opportunity, free from sex discrimination and sexual harassment. The protections of Title IX also extend to third parties. Academic Adjustments Based on Disability As set forth in the Policy Against Discrimination, Harassment, Bullying and Offensive Behavior, T.I.O.A.S policy prohibits unlawful discrimination against students based on protected characteristics, including disability. T.I.O.A.S is committed to working with qualified students with disabilities to provide equal access to the education that T.I.O.A.S provides and to create an inclusive environment for all. T.I.O.A.S will provide reasonable academic adjustments (including accommodations, auxiliary aids and services) to an otherwise qualified student with a disability. For purposes of this policy, the term “student” includes an enrolled student as well as any prospective student who requires reasonable academic adjustments in the application process, including in connection with the entrance examination. The purpose of academic adjustments based on disability is to provide an otherwise qualified student with equal access to T.I.O.A.S program courses, services and facilities. Accordingly, a reasonable academic adjustment is a modification of or exemption from any of our policies, procedures or practices that enables a student to fully participate in our educational program and meet program requirements by overcoming barriers posed by the student’s disability. By contrast, a requested academic adjustment will be denied as unreasonable if it would (1) Excuse a student from essential program requirements or institutional standards for program completion, (2) Conflict with licensing or other legal requirements, or (3) otherwise place an undue financial or administrative burden on the institution. Additionally, T.I.O.A.S is not required to provide a student with the academic adjustment(s) he or she most prefers, so long as it provides reasonable academic adjustments, where possible. If you wish to submit a request for academic adjustments based on disability, it will be necessary for the student to disclose and identify his or disability, and other related information to the instructor. All information will be held confidential between the student and instructor. Following its review, the instructor will take careful consideration and will issue the student a notice of determination. Academic Adjustments Based on Religion In compliance with applicable law, T.I.O.A.S will also provide otherwise qualified students with reasonable academic adjustments (or, accommodations) based on a student’s sincerely-held religious beliefs and/or practices. The purpose of academic adjustments based on religion is to provide an otherwise qualified with equal access to T.I.O.A.S program courses, services and facilities where a reasonable accommodation can be identified that does not pose an undue hardship on our facility or program. The decision to submit a Request for Academic Adjustments is voluntary on the part of the student. Additionally, a student who wishes to submit such a request should understand that, in order for T.I.O.A.S to consider the request, it will be necessary for the student to disclose and identify the religion at issue, as well as the specific religious belief and/or practice that the student believes conflicts with a policy, procedure or practice at T.I.O.A.S. Upon receipt of a request, the instructor will maintain the confidentiality of the information relating to a student’s religion and his or her request as required by law. Any such request for Academic Adjustments submitted by a student will be determined by the 15 The Institution of Advanced Styles instructor based on an individualized assessment of the student’s religious beliefs and practices in light of the requirements of the cosmetology program, licensing or other legal requirements, and the administrative and/or financial burden posed by the requested adjustment(s). In each case, the core question before the instructor is whether the request for Academic Adjustments will affect the student’s full access to the education, service and facilities offered in T.I.O.A.S Cosmetology Program or whether it seeks to excuse the student from meeting the fundamental requirements of the program. Following its review the instructor will issue the student a notice of determination. Complaints, Investigations& Disciplinary Action If you believe you have been subjected to conduct in violation of T.I.O.A.S Equal Opportunity Policies, Student Behavioral Expectations Policies, or any other T.I.O.A.S policy or law by anyone in connection with your enrollment (e.g., an employee, fellow student, or guest), We encourage you to notify us immediately. It is important to document such complaints in writing providing a detailed description of the event, and any witnesses to the event. If you cannot resolve your complaint through T.I.O.A.S, please contact The Florida Department of Business and Regulation, The Florida Department of Education, or The Better Business Bureau. Investigations When a complaint is filed, a prompt and diligent investigation begins to determine if there has been a violation of policy or law. All complaints will be held in confidence at a professional discretion. Instructors will always keep the students safety first. All students or individuals involved with the investigations may be suspended pending the determination of the violation. Students are expected to comply and cooperate with the investigation. We will try concluding our determination in a timely manner, however we reserve the right to use as much time as needed for determination. Absence for Investigation In the case where the student is the subject of a complaint, T.I.O.A.S reserves the right to place the student on an absence for investigation. During an absence for investigation, the student will not be allowed to return to the facility and may not complete hours or services until the investigation is complete and all disciplinary actions have been taken. In the manner the complaint is not justified, the student filed against has the right to request an academic adjustment to render services/hours lost. The instructor will issue a notice of determination. Disciplinary Action T.I.O.A.S retains full discretion to determine what discipline (up to and including termination) is warranted. If an instructor needs to defuse a situation, or violation, they may dismiss any students involved or affected by the circumstance. Students who are dismissed due to disciplinary leave will not get credit or services during the leave. Disciplinary Actions: • Verbal Warning. Knowledge of the violation. • Three-Day Suspension. Generally, a three-day suspension is appropriate when the student has engaged in repeated acts of prior misconduct or the misconduct is severe. • Termination. Generally, termination of enrollment is appropriate when the student has engaged in 16 The Institution of Advanced Styles repeated acts of prior misconduct and the misconduct are severe in nature. However, certain types of misconduct is so severe, such as sexual harassment, or a threat to ones well-being, that T.I.O.A.S may choose to terminate the student’s enrollment upon a first offense. The following list provides examples of conduct that, when committed by a student, are likely to result in disciplinary action: • Verbal abuse or conduct towards a fellow student, staff member, or guest that demeans, harasses, or discriminates against that person on the basis of race, color, national origin, ethnic origin, religion, disability, gender, sex, sexual orientation, or any protected characteristic; • Sexual Harassment, sexually abusive, bullying, profane, or other offensive statements or conduct towards a fellow student, staff member, or guest; • Being non-compliant or other forms insubordination; • Chronic tardiness or absences that is disruptive to the learning environment, guests services, or otherwise; • Theft or destruction of property belonging to the institution, students, guests, or co-workers; • Acts or threats of violence towards a fellow student, staff member, or guest or the institutions property; • Violation of the drug and alcohol-free school policy; • Possession of alcohol, illegal drugs, firearms, explosives, weapons or other unlawful or dangerous materials or items on the institutions property; • Appearing intoxicated or under the influence of a controlled substance; • Cheating on an exam; • Copying or photographing testing materials; • Disrupting the learning environment; • Refusing a client; • Bringing unauthorized personal belongings • Violation of the logging in and out policy, including but not limited to signing for another student, or asking another student to sign in or out for you; signing for an instructor • Acts in violation of applicable federal, state, and local law or accreditor standards. This list does not limit the circumstances under which T.I.O.A.S may impose disciplinary action against students. Any conduct that falls below our standards of conduct is subject to disciplinary action. Anti-Retaliation Policy T.I.O.A.S will not retaliate against you for filing a good-faith complaint or for participating in good faith in an investigation of alleged misconduct. Likewise, T.I.O.A.S will not tolerate retaliation by others against you on these grounds. An employee or student who retaliates will be subject to disciplinary action, up to and including termination. Any student who feels that he or she has been subject to retaliation in violation of this policy should report the matter immediately. As noted, we suggest that a student make the complaint to an instructor. Student Record Access All students and instructors will hold their records and update them daily. Instructors and students have their own attendance and service log books which are updated consistently. Instructors will keep their log books on site of T.I.O.A.S for up to 5 years after the student graduates. FERPA & Release of Records T.I.O.A.S maintains student records and administers access to student records in compliance with law, including the Family Educational Rights and Privacy Act (FERPA). Under FERPA, the release of student 17 The Institution of Advanced Styles education records by T.I.O.A.S to third parties, other than a school department or official, is generally prohibited without the student’s written permission. FERPA also provides certain exceptions which permit the release of student education records without specific consent. In addition, T.I.O.A.S may release student directory information without consent, unless a student has specifically requested that such information not be released. Therefore, T.I.O.A.S will not disclose information from the academic records of a student, except as authorized by the student by filling out Consent to Release Student Information form provided by the instructor, as permitted under a FERPA exception; and/or as required by law.
