It will be the responsibility of any person or organization to reimburse the City of Lexington for any damages incurred during the rental period. All persons and organizations are liable for any damages to property while being used. 2. Please contact the pro shop PRIOR to setting up your event if The Commons facility is not cleaned and prepared to your satisfaction. 3. No candles of any kind may be used. 4. Only non-flammable materials and decorations may be used in The Commons facility and these are subject to the approval of the Fire Department. 5. The electrical wiring may not be tampered with or changed in any way. 6. All doors must remain unlocked at all times while the building is occupied to comply with fire regulations. 7. All persons or organizations renting the building are responsible for knowing the location of all fire extinguishers. 8. All teenage activities must be properly chaperoned. 9. All children must be supervised. They are not allowed on the golf course, putting green or golf carts. For their own safety, they should not be allowed near the golf shop or in the traffic areas of the golf carts. 10. The maximum number of people allowed in the building is 300. 11. No nails, tacks, staples, or tape of any kind may be used anywhere in The Commons facility. 12. Nothing of any kind may be placed on any of the ceiling beams or light fixtures. No bulbs may be replaced in any of the light fixtures. Any light fixtures raised during an event must be lowered to original position. 13. The Commons on the Green building is a Non-Smoking facility. 14. No smoke machines or fog machines may be used in The Commons facility. 15. Rental fee will be charged in accordance with Resolution No 17-15, dated 2-9-15. To secure a reservation to the Commons on the Green on the date desired, the full rental fee must be paid. The full security deposit amount is due two weeks prior to the actual function. The completed lease and all necessary licenses and documents must be turned in at least two weeks prior to the event. Events requesting alcohol may lose their alcohol privileges if these deadlines are not met. All fees must be paid in full, and the lease agreement completed, before the key to The Commons facility may be picked up. The deposit will be refunded only if all rules and regulations have been obeyed and if the key has been returned to the pro shop. If it is necessary for the Lessor to repair any damage or missing equipment (i.e. tables, chairs) caused by the Lessee under this lease or to remedy infractions of the rules and regulations set out, the Lessor may retain that portion of the deposit necessary to cover the cost of such repair and remediation as determined by the Lessor. If the party renting The Commons facility should cancel, the following will be enforced: Party Cancels 61 or more days prior to the scheduled date - the rent will be fully refunded. Party Cancels within 31-60 days prior to the scheduled date, and The Commons cannot be rented to another party, 1/2 of the rent will be retained by the City. Party Cancels within 30 days prior to the scheduled date, and The Commons cannot be rented to another party, the entire rent paid will be retained by the City. The rates for the Commons on the Green are as follows: Rent Security Deposit Saturday* $900 $500 Friday or Sunday $750 $500 Friday / Sunday with Saturday rental Add $400/day Monday - Thursday $400 $500 16. No beer kegs*, beer dispensers, or bottled beer is permitted inside the building, front lawn, or back terrace of the club. In the event this rule is not carried out, the lessee will forfeit the entire deposit and the credit card authorization amount. 17. One or more City of Lexington police officer (s) (off duty) will be required. Please refer to Section 6(c) of the contract. This fee is paid by the lessor and is separate from all other fees. 18. If an event has to be closed down by the manager or by the police for infractions caused by the lessee or the event itself, the lessee will forfeit the entire deposit and the credit card authorization amount. 19. The type of event and the number of people attending will dictate the number of officers that are required. 20. If a band or DJ is going to be used for an event, they have 30 minutes to perform a sound check before the actual event. 21. If an event causes the occupancy level to be exceeded, the lessee will forfeit the entire deposit and the credit card authorization amount. The Following Rule Infractions Shall Cause Forfeiture of Entire Deposit and Loss of the Credit Card Authorization Amount. 1. If an event has to be closed down by the manager or by the police for infractions caused by the lessee or the event itself, the lessee will forfeit the entire deposit and the credit card authorization amount. 2. No beer kegs*, beer dispensers, or bottled beer is permitted inside the building, front lawn, or back patio of the Ballroom. Should any alcohol be brought into the Ballroom under any circumstances that were not approved, the event will be closed down and will result in a loss of the entire deposit and credit card authorization amount. 3. All children must be supervised. They are not allowed on the golf course, putting green, or golf carts. For their own safety, they should not be allowed near the golf shop or in the traffic areas of the golf carts. Failure to keep children under control and supervised will result in an early closing of the event and full loss of entire deposit and the credit card authorization amount. 4. If an event causes the occupancy level to be exceeded, the lessee will forfeit the entire deposit and the credit card authorization amount. Additional Rules and Regulations for the Commons on the Green Effective February 9, 2015 1. 2. 3. 4. 5. 6. There will be a limit of no more than 9 cases and 9 cans of 12 ounce beer for any event – that is 80 liters.* There will be a limit of 8 liters of spirituous liquor for any event.* All beer and/or alcohol must be in the building no later than (1) hour prior to the event and must be verified by a City Representative. No beer and/or alcohol will be allowed into the building at any time after (1) hour prior to the beginning of the event. All events Sunday thru Thursday must end no later than 10:00 pm. Events Friday and Saturday must end no later than Midnight. *By North Carolina State Law, some accommodations can be made for events that use a properly licensed and City of Lexington approved caterer. Please refer questions to the staff of the Commons on the Green. These changes, along with all the other rules and regulations pertaining to the Commons on the Green, will remain in place unless otherwise indicated. Any deviation of any of the rules and regulations could result in an early closure of event, loss of deposit, the credit card authorization amount, or both.
