Time shall be considered as the essence of this contract and the contractor hereby agrees to commence the work soon after the site is handed over or soon after the agreement is executed or from the 15th day of Issue of formal letter of acceptance whichever is early and to complete the entire work within 45 days subject nevertheless to the provisions for extension of time. 8. All payments by the Owner under this Contract will be made only at Thiruvananthapuram. 9. Arbitration shall not be a means to settle any dispute arising out or in any way connected with this Agreement. 10. Disputes arising out of or in any way connected with this Agreement shall be deemed to have arisen at Trivandrum and only Courts in Trivandrum shall have jurisdiction to determine the same. 11. Earnest Money deposit EMD at the rate of 2.00% of estimate PAC in the form of Banker's cheque, Demand draft or FDR pledged in the name of the Director, RGCB from any Nationalized/Scheduled Bank has to be furnished along with the tender. 2. Performance guarantee i. The contractor shall submit an irrevocable performance guarantee of 5% (Five percent) of Accepted value of work tendered for the proper performance of the contract agreement. ii. The guarantee should be from any Nationalised/Scheduled Banks, valid upto the stipulated date of completion plus 60 days beyond that. The performance guarantee shall be refunded to the contractor, soon after the completion of the work and issuance of completion certificate from consultant. iii. The times allowed for submission of performance guarantee shall be 10 days of issue of letter of acceptance. The period can be further extended if required by the Director for a maximum period of 5 days on the written request of the contractor. iv. The work is to be commenced soon after the site is handed over or before 15 days from the date of issue of letter of acceptance or soon after the agreement is executed whichever is early. v. The letter of commencement of the work shall be issued to the contractor only after he submits the performance guarantee in an acceptable form. 3. Security deposit The contractor shall permit the Employer at the time of making any payment to him for work done under the contract to deduct a sum at the rate of 5% of the gross amount of each running bill till the sum along with the sum already deposited as earnest money deposit will amount to security deposit of 5% of the tendered value of the work. The security deposit shall be refunded after the expiry of defect liability period of twelve months after the virtual time of completion. Both the performance guarantee & security amount bear no interest. 4. Compensation for delay The work shall be commenced within ten days on issue of the notice of award of the contract and period of completion shall be 2 months from that date or the date of submission of performance guarantee or date on which the contract is signed whichever is early. 11 If the contractor fails to maintain the required progress ie. 25% of work in each fortnight or to complete the work on or before the contract or extended date of completion, he shall pay compensation without prejudice to any other right or remedy available under the law of the Government on account of such breach, pay as agreed compensation the amount calculated at the rates stipulated below. Compensation : @ 1.5% per month of delay to be compiled per day basis Provided always that the total amount of compensation for delay to be paid shall not exceed 10% of the tendered value of work. The amount of compensation shall be adjusted against any sum payable to the contractor. 5. Time and Extension for delay The time allowed for the works as specified or the extended time granted in accordance with these conditions shall be the essence of the contract. The execution of work shall commence from such time period specified in the selection notice If the contractor fails to commence the work in the stipulated time the Employer will be at liberty to forfeit the earnest money deposit and performance guarantee absolutely. 6. Firm period The tender shall remain open for a period of Ninety days from the date of opening of tenders. If the tenderer withdraws his tender before the opening date or makes any modification in the terms and conditions of tender which are unacceptable to the Employer, 50% of the earnest money shall be liable for forfeiture. Also Employer is at liberty to forfeit whole of the earnest money if the tenderer where tender is accepted fails to commence the work in specified time or abandons the work before its completion. 7. Extra/Substituted Items 1. Extra items of work are items that are completely new and are in addition to the items contained in the contract. 2. Substituted items are items that are taken up with partial modification or in lieu of items of work in the contract. 3. One agreement item can be substituted by multiple items. 8. Deviation/Variation, Extent and Pricing The Employer/Consultant shall have power (i) to make alteration in, omissions from, additions to or substituting for the original specifications, drawings, designs and instructions that may appear to him to be necessary or advisable during the progress of the work and (ii) to omit a part of the works due to unforeseen reasons and the contractor is bound to carry out the works in accordance with any instructions given to him in this regard and such alterations, omissions additions or substitutions shall form part of the works, conditions in all respects including rates. The time of completion of the work shall in the event of any deviations resulting in additional cost over the tendered value sum being ordered be extended if requested by the contractor as follows. 12 (iv) In the proportion which the additional cost of the altered additional or substituted work bears to the original tendered value plus. (ii) 25% of the time calculated (i) above or such further additional time as may be considered reasonable by the Employer/Consultant. 9. Deviation, Extra items and Pricing In the case of extra items (items that are completely new and are in addition to the items contained in the contract), the contractor shall provide a rate analysis and the Employer/Consultant shall scrutinize the rate analysis and determine rates based on the market rates and the contractor shall be paid in accordance with the rates so determined. In the case of substituted items (items that are taken up with partial substitution or in lieu of items of items of work in the contract), the rate for the agreement items (to be substituted) and substituted item shall also be determined in the manner as mentioned in the following para. a. If the market rate of the substituted item so determined is more than the market rate of the agreement item (to be substituted) the rate payable to the contractor for the substituted item shall be the rate for the agreement item (to be substituted) so increased to the extent of the difference between the market rates of substituted item and the agreement item (to be substituted) b. If the market rate of the substituted item so determined is less than the market rate of the agreement item (to be substituted) the rate payable to contractor for the substituted item shall be the rate for the agreement item (to be substituted) so decreased to the extent of the difference between the market rate of substituted item and the agreement item (to be substituted). 10. Deviations, Deviated Quantities, Pricing In the case of contract items, substituted items, contract cum substituted items which exceed the scheduled quantities the contractor shall prefer claim for revisions of rates supported by rate analysis, for the excess quantities provided that if the rates so claimed are in excess of the rates specified in the schedule of quantities the Employer/Consultant shall after giving consideration to the analysis given by contractor shall determine rates on the basis of market rates and the contractor shall be paid in accordance with the rates so determined. The provisions of the preceding paragraph shall also apply to the decrease in the rates of items for the work in excess of the scheduled quantities, the Employer/Consultant shall revise the rates with regard to market rates after notifying the contractor in advance and taking into consideration the reply to it (Notice). 11. Rate to be all inclusive The quoted rate shall be including cost of all materials, cement and steel and for clearing site before commencement as well as after completion, scaffolding centering the boxing, plant and equipments, storage, watching and lighting etc. The rate is also including Income tax, Sales tax / Work contract tax, Contribution to construction workers welfare fund etc. All statutory recoveries shall be made in the bill and remitted to respecting departments and certificates to this effect 13 issued to the contractor. The service tax shall be paid by the contractor to the concerned department on demand and will be reimbursed to him by Employer after satisfying that this has been actually and genuinely paid by the contractor. 12. Work to be executed in accordance with Specifications, Drawings, Orders etc The contractor shall execute the whole and every part of the work in the most substantial and workman like manner both as regards materials and otherwise in every respect in strict accordance with the specifications. The contractor shall also conform exactly, fully and faithfully to the design drawings and instruction given by the Employer/Consultant. The contractor shall comply with the provisions of the contract and with the care and diligence execute and maintain the works, and provide all labour and materials, tools and plants including for measurement and supervision of all works and structural plans and other things of temporary or permanent nature required for such execution and maintenance in so far as the necessity for providing these is specified or is reasonably inferred from the contract.The contractor shall take full responsibility for adequacy suitability and safety of all the works and methods of construction. 13. Measurement and Billing The contract is for the completed work to be paid for according to the actual quantities at the rate agreed upon in the tender schedule of rates & probable quantities. The measurements shall be done in accordance with the procedure followed in Central PWD. 14. Defect liability period Any defects or shortcomings found during execution of work and the period of 12 months (Defect liability period) from the completion of the entire work shall be attended/rectified by the contractor without any extra cost to the employer. In case of failure to do so within 10 days from such notice of the Employer, the rectification works will be carried out through other Agencies and expenses incurred shall be recovered from any sums due to the contractor. 15. Labour laws The contractor shall be governed by the labour laws/Acts in force from time to time. 16. Workmen's' compensation Provisions subsection (1) and (2) of section. 12 and subsection (1) of Section. 12 of workmen's compensation Act 1923 are applicable to the contractor. 17. Payment of wages The contractor shall pay to labour employed by him either directly or through sub contractor's wages not less than fair wages as defined in the CPWD contractor's labour regulations or as per provisions of the contract labour (Regulation and Abolition Act) Act 1970 and contract labour (Regulation and Abolition) Central rules 1971 wherever applicable. 14 18. No price escalation for any labour or material will be entertained in the contract. 19. Charges for water and electricity necessary for the work shall be paid, by the contractor. 20. Incase of any dispute or difference of opinion between the parties by the contract, either during the progress or after completion of work or after determination, abandonment or breach of contract as to interpretation of contract or as to any matter arising, the matter shall be referred to the Chief Controller of RGCB, and his decision shall be final and building on both the parties. If the contractor is not satisfied with the disposal he/they may approach appropriate Civil Court having jurisdiction over Thiruvananthapuram. S. Mohanan Nair Senior General Manager 21. TERMS OF PAYMENT: a) 40% of contract value on supply of materials at site b) 40% on fixing /.installation of the materials at site c) Balance 20% on satisfactory completion and handing over of the work to the fullest satisfaction of the Consultant and client. 15 SECTION – E TECHNICAL SPECIFICATIONS MATERIAL SPECIFICATIONS OF PROPOSED INTERIOR WORKS Wall Partitions The partition are done with V-panel, is a sandwiched panels comprising of two 5mm thickness fibre reinforced cement sheets, does not contain asbestos enclosing a light weight core of Portland cement and binders and mix of density modifier aggregates. They should have specially designed tongue and groove design which ensures perfect joint. They should possess good sound and thermal insulation. They should have very good resistive property to withstand humidity, water and termite. They can be dismantled and relocated. Doors MATERIAL: Door Frames and Leaves are made from Galvanized Steel. DOOR LEAVES: Constructed from 0.80mm Thick Galvanized Steel Sheet formed to provide a 46mm thick fully flush, double skin door shell with Lock Seam joints at stile edges. In-fill of Honeycomb Kraft Paper is used to give the required rigidity and effective acoustic insulation. DOOR FRAMES: Produced from 1.2mm (18G) thick galvanized steel sheet formed to single rebate profile of size 100mm X 58 mm. The Door Frames may be built into the brick or block walls using corrugated “TEE” anchors not welded to the Frames (First fix). Frames may also be fixed on plastered openings with the help of Anchor Fasteners (Second Fix). Door Frames are supplied to knockdown/welded form with butt joints for Bolted Assembly at site. VISION GLASS: Vision Glass with 6 MM clear float glass can be provided in Rectangular. The circular Vision Glass can be provided in 380 MM Dia only. Standard Rectangular sizes 200 mm x 300 mm, 450mm x 750 mm & 350 mm x 750 mm. 16 FINISH: The doorframes and door shutters are coated with Zinc Phosphate Primer to receive any paint on site or finished with Thermosetting Polyurethane paint of Aliphatic Grade providing high levels of scratch resistance and durability/Epoxy polyester powder for powder coating paint thickness 60 – 65 microns(Dry film thickness) HINGES: Stainless Steel Ball Bearing Butt Hinges 3 mm thick fixed flush to the frame and shutter (Profile 102x76x3mm thick) FLUSH BOLTS (DOUBLE DOOR) Concealed extended lever action flush bolts provided on the top of the door to the leading stile edge. Providing and fixing 12 mm thick prelaminated particle board flat press three layer or graded wood particle board conforming to IS: 12823 Grade I Type II, in panelling fixed in aluminum doors, windows shutters and partition frames with C.P. brass / stainless steel screws etc. complete as per architectural drawings and directions of Engineer-in-Charge. SECTION- F SAFETY CODE 1) The first aid appliances including adequate supply of sterilized dressing and cotton wool shall be maintained in a ready accessible place 2) An injured person shall be taken to a hospital without loss of time in cases where the injury necessitates hospitalization. 3) Hoisting machines and tackle if used in works, including their attachments ,anchorage and support shall be in perfect condition. 4) Fire hazard items shall not be allowed near the working site . 5) Adequate safety measures against fire, theft etc will be taken by the firm / supplier.
