1 SPECIAL MEETING OF CLANE AREA COMMITTEE HELD ON THURSDAY, 21 JUNE 2001 DEVELOPMENT PLAN REVIEW Present: Councillor J Reilly, Councillor M Fitzpatrick, Councillor P J Sheridan, Councillor T McEvoy, Mr K Rushe (Brady Shipman Martin), Mr K Kelly, Administrative Officer, Ms A Rowan, Projects Office, Mr C Talbot, Projects Office, Ms A Aspell, Senior Staff Officer Clane Councillor Sheridan proposed that, due to the minor amendments to the Clane Draft Development Plan, the Plan be displayed as an Amended Draft for a period of one month. The Chairman requested confirmation of the timescale for completion of the Development Plan, were it to be displayed for a further period. Mr Kelly advised the members that it was intended to hold a Special Meeting of the County Council on or about 16 July 2001 in order to deal with Development Plans only. If the members were to approve the Amended Draft Clane Development Plan it would be put on display for one month from the end of July. Mr Kelly advised that subject to the coordination of the Development Plans with the Housing Strategy it may be possible to complete the procedure for the Clane Development Plan at the September meeting of the County Council. Mr Talbot advised the members that it is hoped to adopt the Housing Strategy by the end of July. The procedure to vary the 1999 County Development Plan will then be commenced. Mr Talbot outlined the present position with regard to completion of Section 38 Agreements relating to community gain. Mr Talbot advised that only one offer of housing had been confirmed in either Clane or Kilcock (ie. Shay Grace). Mr Talbot clarified that the Section 38 Agreements were on the basis of something being offered by the applicant and not on the basis of something being requested by the Planning Authority. Mr Talbot further outlined that conditions can be imposed by a planning permission. Clane Area Development Plan Meeting 21 June 2001 2 The Chairman requested clarification as to whether in a situation where a landowner offered community gain to a community group, would the landowner still be required to give 20% of lands for affordable housing. It was agreed that this matter would be clarified and discussed further. Ms Rowan advised the members that in a situation where no Section 38 Agreement had been signed the local authority would have to wait until such time as the developer decided to develop the site before constructing any dwellings. Mr Kelly advised the members that the Conservation Officer had recommended the removal of IP10 from the list of protected structures. Following a discussion the members agreed to remove IP10 from the list of protected structures. Councillor Sheridan again proposed the display of an Amended Draft Plan for Clane. Councillor Fitzpatrick seconded this proposal. Kilcock Mr Rushe presented a revised map showing the agreed alteration to zoning. The Chairman noted that correspondence had been received from Kilcock & District Community Council. Councillor Sheridan proposed that this item be put on the Agenda for the next meeting of the Clane Area Committee. The members agreed. Councillor Sheridan advised the members that he had received representations from Mr Davey with regard to the zoning of his lands, which are shown amenity on the Amended Draft map. Mr Davey has offered lands for a Scout Den at this location. Councillor Sheridan advised that Mr Davey is intending to apply for planning permission for two houses at this location. Mr Rushe pointed out that the site was within the 91m set back from the motorway and, therefore, not appropriate for residential development. Councillor Sheridan proposed that this land be altered to agricultural zoning. Councillor Fitzpatrick seconded this proposal. Councillor Fitzpatrick proposed that the Kilcock Amended Draft Development Plan be adopted (with the alteration agreed). Councillor Reilly seconded this proposal. Clane Area Development Plan Meeting 21 June 2001 3 Derrinturn Councillor Reilly advised the meeting that he appreciated the attendance of the County Manager, Mr Rushe, Mr Kelly and Ms Rowan at the public meeting held in Derrinturn. The Chairman noted that a letter had been received from a group in Derrinturn requesting that a site be agreed for construction of a new Church and car park. Councillor Fitzpatrick suggested that the parish lands be earmarked for Church related development. This should be highlighted in the Local Area Plan. The Chairman noted that the lands adjacent to the school had been suggested by the group. The Chairman pointed out that apart from 6 acres this land is privately owned. Mr Rushe advised the members that he would not recommend the relocation of the Church from its present site. The Chairman acknowledged that the existing church was now more or less beyond repair. The Chairman advised the meeting that he supports the efforts of the group to construct a new Church. The members agreed that the 15 acre site around the existing Church could perhaps be considered for development of a new Church and burial ground. Mr Rushe advised the members that two objectives had been added at page 13 of the Draft Local Area Plan. Mr Kelly brought the long term proposals of F & M Callan to the attention of the members. Following a discussion in relation to this development, the Chairman recommend that the planning permission currently on hands be allowed to proceed notwithstanding consideration of the Local Area Plan for Derrinturn. The members agreed. The Chairman requested clarification as to whether a Material Contravention would be required were the current application to be granted. Councillor Reilly proposed the display of the Draft Local Area Plan for Derrinturn. This proposal was seconded by Councillor Fitzpatrick. Councillor Fitzpatrick proposed the adoption of the minutes of the Special Meeting of the Clane Area Committee on 1 May 2001. This proposal was seconded by Councillor Sheridan.
