The Inspector agreed that the proposal would be harmful to the character and appearance of the Conservation Area, representing an adverse impact on the local environment and as such would be contrary to Policy 6 (Rural Areas beyond the Green Belt) of the North Hertfordshire District Local Plan No.2 with Alterations. The Inspector advised that a recent amendment to Planning Policy Statement 3:(Housing) now excludes private residential gardens from the definition of previously developed land and so he considered that the area of the garden subject of the application contributed to the Conservation Area. Although the Inspector concluded that the proposal would not materially affect the character and appearance of the conservation area, which would therefore be preserved. This did not however outweigh his findings that the proposal would fail to preserve the special interest of the listed building and would be harmful to its significance. He concluded that the proposal would preserve the character and appearance of the locality including the Conservation Area and its setting. The Inspector concluded that the proposed development would mar the coherent and attractive character and appearance of both the host building and the street scene. It would therefore conflict with (saved) Policy 28 (House Extensions) of the North Hertfordshire District Local Plan No 2, with Alterations, which requires extensions to be sympathetic to the existing house in form and proportions.
